What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

Tolerated residence is a specific, non-standard residence status for a foreign national in defined humanitarian or exceptional circumstances, granted for a maximum of 180 days.

Section58 covers a minor found in Slovakia; protection of private/family life where the person is not a security/public-order threat, with the specified family-reunification/permanent-family cases restricted to people without a valid travel document who otherwise credibly establish identity; trafficking victims aged18or more; and cases arising from international obligations. On request of a criminal-proceedings authority, it also covers an illegally employed person under particularly exploitative conditions or an illegally employed minor whose presence is necessary for proceedings. Section58(3) treats the adult trafficking victim’s reflection period of up to90days, extendable by30days, as tolerated residence.

    § 58 (1) Policajný útvar udelí tolerovaný pobyt štátnemu príslušníkovi tretej krajiny, ak nie sú dôvody na zamietnutie žiadosti podľa § 59 ods. 12 , a) ktorý je maloletou osobou nájdenou na území Slovenskej republiky, b) ak to vyžaduje rešpektovanie jeho súkromného a rodinného života a neohrozuje bezpečnosť štátu alebo verejný poriadok; štátnemu príslušníkovi tretej krajiny podľa § 27 ods. 1 a § 43 ods. 1 písm. a) až d) možno tento pobyt udeliť len vtedy, ak nie je držiteľom platného cestovného dokladu a hodnoverne preukáže svoju totožnosť iným spôsobom, c) ktorý je obeťou obchodovania s ľuďmi, 69 ) ak má najmenej 18 rokov; policajný útvar alebo osoba poverená ministerstvom vnútra oboznámi štátneho príslušníka tretej krajiny s možnosťou a podmienkami udelenia tolerovaného pobytu z tohto dôvodu a o právach a povinnostiach, ktoré z neho vyplývajú, d) ak to vyplýva z medzinárodných záväzkov Slovenskej republiky. (2) Policajný útvar na základe žiadosti orgánu činného v trestnom konaní môže udeliť tolerovaný pobyt štátnemu príslušníkovi tretej krajiny, ktorý bol nelegálne zamestnaný za osobitne vykorisťujúcich pracovných podmienok, alebo nelegálne zamestnanej maloletej osobe, ak je prítomnosť tohto štátneho príslušníka tretej krajiny na území Slovenskej republiky nevyhnutná na účely trestného konania. Tolerovaný pobyt policajný útvar udelí na 180 dní. Policajný útvar môže predĺžiť tolerovaný pobyt o 180 dní, a to aj opakovane, až do právoplatného skončenia trestného konania alebo do doby, pokiaľ štátnemu príslušníkovi tretej krajiny nebude uhradená dlžná suma odmeny za vykonanú prácu. Orgán činný v trestnom konaní alebo osoba poverená ministerstvom vnútra oboznámi štátneho príslušníka tretej krajiny s možnosťou a podmienkami udelenia tolerovaného pobytu z tohto dôvodu a o právach a povinnostiach, ktoré z neho vyplývajú. (3) Za tolerovaný pobyt sa považuje obdobie najviac 90 dní, počas ktorých sa štátny príslušník tretej krajiny, ktorý je obeťou obchodovania s ľuďmi a má najmenej 18 rokov, rozhodne, či bude spolupracovať s orgánmi činnými v trestnom konaní pri objasňovaní trestného činu súvisiaceho s obchodovaním s ľuďmi; túto lehotu možno na žiadosť osoby poverenej ministerstvom vnútra predĺžiť o 30 dní.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

An application for grant or extension of tolerated residence must be submitted personally on the official form to the Police Department in Slovakia. For the personal/family-life ground, the official source requires criminal-record extracts from the citizenship country and specified countries of residence. If the person meets the conditions to apply for family-reunion temporary residence or five-year permanent residence, this tolerated-residence ground is available only without a valid passport and with identity established by another trustworthy means.

During tolerated residence, business and work are generally prohibited. The employment exceptions cover residence on private/family-life grounds, an extension because of human-trafficking victim status, and residence for victims of particularly exploitative illegal employment. These employment exceptions do not permit business activity.
