What exactly is the official special programme/status and why does it exist?

A Slovak national type D visa authorises stay in Slovakia for its validity, which may be at most one year. It also permits stay in other Member States for up to 90 days in any 180-day period under the conditions of the Schengen Borders Code.

What immigration status and rights result, how long do they last, can family be included, and what happens if the special qualifying circumstance ends?

Section15(3) sets national visas for stays longer than three months, normally up to one year. The already-granted-residence and residence-application grounds in section15(1)(a)-(b) may receive120days, but the latter expressly excludes an application for business temporary residence under §22. Language-school visas follow study duration up to31July of the school year. Family members of asylum/subsidiary-protection beneficiaries under section15(2) receive the necessary period subject to its conditions. Section17(10)(c) permits cancellation if the person no longer fulfils the purpose for which the visa was granted. Ordinary national-visa procedure and the section15(2) family procedure are distinguished in section17(12); a universal statement that no refusal can be challenged is not established here.

    § 15 Národné vízum (1) Štátnemu príslušníkovi tretej krajiny môže byť udelené národné vízum, ak a) je to potrebné v súvislosti s udeleným pobytom v Slovenskej republike, b) je to potrebné v súvislosti s podaním žiadosti o udelenie pobytu podľa tohto zákona; to neplatí, ak ide o podanie žiadosti o prechodný pobyt podľa § 22 , c) je starší ako 15 rokov a je prijatý na jazykové vzdelávanie v jazykovej škole 32a ) v rozsahu najmenej 25 vyučovacích hodín týždenne, d) je to v záujme Slovenskej republiky alebo e) je to potrebné na plnenie záväzkov Slovenskej republiky vyplývajúcich z medzinárodných zmlúv. (2) Rodinnému príslušníkovi azylanta alebo cudzinca s udelenou doplnkovou ochranou, uvedenému v osobitnom predpise, 33 ) sa udelí národné vízum, ak neohrozuje bezpečnosť štátu alebo verejný poriadok. (3) Národné vízum sa udeľuje na pobyt dlhší ako tri mesiace, najviac na jeden rok. Národné vízum môže byť udelené a) na 120 dní, ak ide o udelenie národného víza podľa odseku 1 písm. a) alebo písm. b), b) na dĺžku jazykového vzdelávania na jazykovej škole, najviac do 31. júla príslušného školského roka, c) na nevyhnutný čas, ak ide o udelenie národného víza podľa odseku 2.

    (10) Ministerstvo zahraničných vecí alebo policajný útvar je oprávnený zrušiť národné vízum, ak a) zistí skutočnosti, ktoré by odôvodňovali neudelenie národného víza, b) je štátny príslušník tretej krajiny administratívne vyhostený, alebo ak mu bol uložený trest vyhostenia, c) štátny príslušník tretej krajiny neplní účel, na ktorý bolo národné vízum udelené, d) bol štátny príslušník tretej krajiny odsúdený za spáchanie úmyselného trestného činu, e) štátny príslušník tretej krajiny je nežiaducou osobou, f) štátny príslušník tretej krajiny závažným spôsobom alebo opakovane porušil povinnosť ustanovenú týmto zákonom alebo g) štátny príslušník tretej krajiny požiada o zrušenie platnosti národného víza.
