What exactly is the official special programme/status and why does it exist?

Admission to reside in Sint Maarten is either granted by operation of law or by permit; this declaration, issued on request by or on behalf of the Minister of Justice, shows that the holder has admission by operation of law, so no residence permit is needed.

The documents required for the government-employee declaration are: a passport picture; a colour copy of the valid passport bio page; a certificate of good conduct not older than 6 months for individuals aged 16 and older (sworn translation into English or Dutch if not issued in Sint Maarten); a school registration letter for the children; where a parent of the children stays in the country of origin, proof of custody by court decision registered at the Court on St. Maarten; and a job letter stating monthly income, working hours, position and date of employment, or a copy of the government employment contract if applicable.

What immigration status and rights result, how long do they last, can family be included, and what happens if the special qualifying circumstance ends?

For the Article 3(1)(a) government-posted category, admission by law lasts while the person remains in government service, and Labour Ordinance Article 3(a) exempts that category from the employer work-permit prohibition. Article 3(1)(g) admits the non-separated spouse and minor children by law, but the minister may attach conditions concerning a particular occupation to the spouse’s admission. Admission by law ends when its reason lapses; derivative spouse/child admission also ends then, except that a spouse independently admitted under Article 3(1)(f) retains that separate basis. The statute states no fixed term for this category.

De bepaling van artikel 4, tweede lid, is van overeenkomstige toepassing; c. ten aanzien van de meerderjarige Nederlander, die op grond van het bepaalde in artikel 3, eerste lid, onderdeel f, van rechtswege is toegelaten, door het niet langer beschikken over huisvesting en voldoende middelen van bestaan om in zijn levensonderhoud te voorzien; d. ten aanzien van de minderjarige Nederlander waarvan één van de ouders die het ouderlijk gezag uitoefent niet langer aan de voorwaarden, genoemd in artikel 3, eerste lid, onderdeel f, voldoet.     Artikel 13 Ingeval de toelating, van rechtswege toegekend of krachtens vergunning is verleend, eindigt, houdt tevens op de toelating van de echtgenoot en minderjarige kinderen. De vorige volzin is niet van toepassing op de echtgenoten die krachtens artikel 3, onderdeel f, van rechtswege zijn toegelaten.

    Artikel 3 Het verbod, bedoeld in artikel 2, eerste lid, is niet van toepassing met betrekking tot een vreemdeling: a. die ingevolge artikel 3, onderdelen a, b, c, d, e, g, h en i, van de Landsverordening toelating en uitzetting van rechtswege toelating tot verblijf in Sint Maarten heeft; b. die ingevolge artikel 3, onderdeel f, van de Landsverordening toelating en uitzetting van rechtswege toelating tot verblijf in Sint Maarten heeft, tenzij bij landsbesluit, houdende algemene maatregelen, om redenen van economisch belang een regeling wordt getroffen krachtens welke een tewerkstellingsvergunning wordt vereist; c. ten aanzien van wie, ingevolge bepalingen vastgesteld bij overeenkomsten met andere mogendheden dan wel bij een voor Sint Maarten verbindend besluit van een volkenrechtelijke organisatie, een tewerkstellingsvergunning niet mag worden verlangd; d. die beschikt over een door of namens de Minister van Justitie afgegeven verblijfsvergunning voor het verrichten van arbeid als zelfstandige in Sint Maarten, voor zover deze vreemdeling arbeid verricht als zelfstandige; e. die behoort tot een bij landsbesluit, houdende algemene maatregelen, aangewezen categorie functies.
