Malta's Startup Residence Programme is for third-country national startup founders and co-founders, core employees with specialised skills vital to the startup, and their family members (spouse, de-facto partner, minor children, and dependent adult children).

    3. Founders, co-founders, core employees and family members must: • be third-country nationals, non-EU, non-EEA and non-Swiss. Nationals from the currently sanctioned countries of (or have close ties with) Afghanistan, North Korea, Iran, Democratic Republic of Congo, Somalia, South Sudan, Sudan, Syria, Yemen and Venezuela are ineligible. This list of ineligible countries may be revised from time to time;

What must actually exist or be demonstrated: business plan, company, innovation, clients, contracts, economic activity, job creation or other substance?

The startup must be, or will be, engaged in Malta in one or more eligible activities: manufacturing; software development; industrial services analogous to manufacturing; health, biotechnology, pharmaceuticals and life sciences; eco startups in the blue, green and sustainable industries; or other innovative knowledge- and technology-enabled activities. It must have been registered for no longer than seven years globally (including Malta), must not have taken over another enterprise's activity or been formed through a merger, and the project must meet at least two of three criteria (income potential from various geographical markets; new, innovative or substantially improved products/services; new or substantially improved processes). A mandatory business plan on the provided template is required, and the company's business plan must be approved by Malta Enterprise.

What investment, capital, income, revenue, funding or viability evidence is central to this pathway?

The startup incorporated in Malta must place a tangible investment and/or paid-up share capital of not less than €25,000; where more than four co-founders apply, an additional €10,000 is required per additional co-founder, and at most six co-founders are eligible. Founders and co-founders must hold sufficient financial resources in their own bank statement to support themselves and any dependants. Core employees must have a full-time employment contract in Malta with the startup and an annual gross salary of at least €30,000.

What business/self-employed activity may the holder conduct? Are there important restrictions? What is the family position where clearly stated?

Permits are subject to the startup maintaining the approved business activity and meeting all other residence-permit prerequisites, as determined by Malta Enterprise and Residency Malta Agency. Founders and co-founders must have a physical and tangible presence in Malta, living and paying their taxes there, and must collaborate with Malta Enterprise throughout the permit, including a detailed business plan and annual or bi-annual monitoring reports. Family members' permits do not grant automatic access to the labour market, but existing processes can be used to apply for employment in Malta.

What approval/application sequence applies, how long is the status granted, how is it renewed, and what longer-term residence direction is officially stated?

Founders' and co-founders' residence permits are issued for three years and, upon successful completion, extended for a further five years; core employees' permits are issued for three years and extended for a further three years. Core employees apply online after the founders' and co-founders' permits are approved, and before residency cards are collected the startup must be fully incorporated in Malta, registered with the relevant local authorities, with its resident founder(s) registered as employees.
