EU nationals legally residing in Malta for more than five (5) years may be entitled to permanent residence once they have had actual and real residence in Malta for at least five (5) consecutive years. Swiss nationals and their family members cannot apply under the Permanent basis. The official source does not state from which date the qualifying period starts to run.

As per Swiss Agreement , Swiss nationals and their family members cannot apply under the Permanent Basis.
Only residence while exercising free-movement rights counts for EU nationals during the five-year period; family members count residence while accompanying the EU national and residing with him in Malta as his family member, for at least five (5) years.
For EU nationals to be considered as having acquired the right of permanent residence, it is imperative that the EU nationals were exercising their freedom of movement rights during such (5) five-year period.
In order for family members to be considered as having acquired the right of permanent residence, the family member must have been accompanying the EU national, and resided with him in Malta as his family member, for at least five (5) years.
Applicants must submit evidence in their own name that they resided in Malta for at least six (6) months in a twelve (12) month period throughout the five (5) years, and a letter to the Chief Executive Officer stating the date of first arrival in Malta and all periods of absence from Malta during the last 5 years.

Applicant must submit sufficient evidence on their own name, that s/he has resided in Malta for at least six (6) months in a twelve (12) month period throughout the five (5) years.
A Union citizen with five years' continuous legal residence in Malta, and non-EU family members who legally resided with them for a continuous period of five years, may apply through the Expatriates Unit Portal under the Permanent basis; the residency card is issued with a ten (10) years expiry date. Once acquired, permanent residence is lost only through absence from Malta exceeding two consecutive years. Renewal requires one piece of evidence for each year since permanent residence was acquired.
A Union citizen who has resided legally for a continuous period of five years in Malta and his family members who are not nationals of a Member State and who have legally resided with the Eu national in Malta for a continuous period of five years, may apply for a residency card under the permanent basis which will be issued with ten (10) years expiry date.

Documents required for Renewal of Application Once permanent residence is acquired, the Union citizen and his family members shall only lose such status of permanent residence through absence from Malta for a period exceeding two consecutive years.
Applicant must submit one sufficient evidence for each year from when the permanent residence was acquired.
