EU nationals exercising free movement in Malta who are studying may have immediate family members join and accompany them: a spouse, a durable partner in a relationship with the EU national for at least two (2) years, and children under twenty-one (21). Children over twenty-one, parents and parents-in-law may be granted facilitation if fully dependent on the EU national due to serious health reasons. When do permanent/long-term rights arise and what continuity, absence or retention conditions matter?

EU nationals who have had actual and real residence in Malta for at least five (5) consecutive years may be entitled to permanent residence, provided they were exercising free-movement rights during that five-year period; evidence of residence for at least six (6) months in a twelve (12) month period throughout the five (5) years is required. The permanent-residence document is issued for ten (10) years. Once acquired, the status is only lost through absence from Malta for a period exceeding two consecutive years. Swiss nationals and their family members cannot apply under the Permanent Basis (per the Swiss Agreement).
