What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

A route in Appendix Ukraine (J) Scheme of the Jersey Immigration Rules for those affected by the conflict in Ukraine; the Ukraine Family (J) Scheme is described as the route for those applying from outside Jersey. The Ukraine (J) Schemes are not a route to settlement.

Which population, circumstances or geographic group does the mechanism cover?

Applicants from outside Jersey must have been living in Ukraine immediately before 1 January 2022. A Ukrainian national qualifies as a family member of a Jersey-based sponsor who is a British citizen, a person settled in Jersey, a work-permit holder under paragraphs 128 and 129, a refugee, a person with humanitarian protection, or an EEA or Swiss citizen with pre-settled status based on residence in Jersey before the end of the transition period. Family members are immediate family (partner, child under 18, parent of a child under 18, fiancé(e) or proposed civil partner), extended family (parent, grandparent, grandchild, adult child, sibling, aunt, uncle, niece, nephew, cousin) and the immediate family of extended family members. Non-Ukrainian family members may qualify if at least one member of the sponsor’s immediate family is Ukrainian.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

It is a direct application made online on the gov.uk website on the specified “Ukraine Scheme” form. A person coming to Jersey must apply for and be granted entry clearance before arrival. A person applying for permission to stay must be in Jersey and either have permission or have had permission immediately before 1 January 2022 that has since expired; visitor permission granted after 18 March 2022 does not count.

What happens after the request: registration, family handling, major support and rights where officially stated?

If all suitability and eligibility requirements are met the application is granted, otherwise refused. Permission is granted for up to 18 months, with access to public funds, work (including self-employment and voluntary work) and study permitted. A child under 18 not accompanying or joining a parent needs written consent from both parents, a parent with sole legal responsibility or a legal guardian, unless the decision-maker finds it reasonable to grant without it. The official source does not state registration steps or support while the application is pending.

The competent authority is the Jersey Customs and Immigration Service. Applications to the Jersey Ukraine Family Scheme should be made on the UK Homes for Ukraine scheme online form, and more information or advice can be requested from the Jersey Customs and Immigration Service by email at immigration@gov.je.
