This route is for a parent who seeks leave to enter or remain in Jersey to exercise rights of access to a child resident in Jersey.
PERSONS EXERCISING RIGHTS OF ACCESS TO A CHILD RESIDENT IN JERSEY
The applicant must be the parent of a child who is resident in Jersey, and the parent or carer with whom the child permanently resides must be resident in Jersey.
(i) the applicant is the parent of a child who is resident in Jersey; and
(iii) the parent or carer with whom the child permanently resides is resident in Jersey;
For entry, the applicant must produce evidence of access rights: a Residence Order or Contact Order granted by a court in Jersey, or a certificate issued by a judicial authority in Jersey confirming the intention to maintain contact; and must intend to take an active role in the child's upbringing. For an extension under the post-1 January 2015 rules, a statement from the child's other parent (or the supervisor, if contact is supervised) that the applicant is maintaining contact is also accepted.
(iv) the applicant produces evidence that he has access rights to the child in the form of: (a) a Residence Order or a Contact Order granted by a Court in Jersey; or (b) a certificate issued by a judicial authority in Jersey confirming the applicant's intention to maintain contact with the child; and
(v) the applicant intends to take an active role in the child’s upbringing; and
(iii) a statement from the child’s other parent (or, if contact is supervised, from the supervisor) that the applicant is maintaining contact with the child; and
There must be adequate accommodation for the applicant and any dependants, without recourse to public funds, in accommodation the applicant owns or occupies exclusively, and the applicant must be able to maintain themself and any dependants adequately without recourse to public funds.
(vii) there will be adequate accommodation for the applicant and any dependants without recourse to public funds in accommodation which the applicant owns or occupies exclusively; and
(viii) the applicant will be able to maintain himself and any dependants adequately without recourse to public funds; and
The rules provide separate leave, extension and indefinite-leave provisions; the official post-2015 route includes a 60-month qualifying period. The official source does not state the length of each grant or the rights attached to the leave.
