Which family relationships qualify?

The BN(O) Household Member route is for the adult child (aged 18 or over and born on or after 1 July 1997) of a BN(O) status holder or of the partner of a BN(O) status holder. The Household Member's dependent partner, dependent child and, in exceptional circumstances, other family members with a high degree of dependency may also apply under this route.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

For a first application (without existing permission on the Hong Kong BN(O) route), the applicant must be the child of a person who is, or was before their death, a British National (Overseas) under the Hong Kong (British Nationality) Order 1986; or the child of a partner of a BN(O) Status Holder who forms part of the same household as the BN(O) Status Holder, where the BN(O) Status Holder has, or is at the same time being granted, entry clearance or permission on the BN(O) Status Holder route.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

An applicant for leave to remain who already has leave on the Hong Kong British National (Overseas) route meets the relationship requirement. For the child of a partner of a BN(O) Status Holder, forming part of the same household means normally living with the BN(O) Status Holder.

What important financial, accommodation, insurance or maintenance responsibilities apply?

An applicant for leave to remain who has been in Jersey for 12 months or more meets the financial requirement. Otherwise (entry clearance, or permission to stay after less than 12 months in the UK, or after 12 months' Leave Outside the Rules following an unsuccessful BN(O) application), the decision maker must be satisfied that the applicant, or a person who has or is being granted permission on the BN(O) Status Holder route, can and will maintain and accommodate the applicant adequately in Jersey without recourse to public funds for at least 6 months. Accommodation is not adequate if it is or will be overcrowded or contravenes a statutory public health requirement.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

Entry clearance applications are made online on gov.uk on the form specified in the UK Immigration Rules, and entry clearance must be obtained before arriving in Jersey. A child of a BN(O) Status Holder, or an applicant already holding permission on the route, is granted 5 years or 30 months (plus up to 28 days of any remaining BN(O) permission), according to the period applied for; a child of a partner on the BN(O) Status Holder route without existing permission is granted permission ending on the same date as the BN(O) Status Holder's. There is no access to public funds; work (including self-employment and voluntary work) is permitted except as a professional sportsperson or sports coach, study is allowed, and the Hong Kong BN(O) routes are routes to settlement.
