Which family relationships qualify?

Dependants are the spouse, partner and children of the work permit holder; child dependants are granted permission only if under 18 at the time of application.

See recorded sources

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The sponsor must hold a long-term or intra-company transfer work permit issued for more than 12 months; the dependants' permissions are linked to the conditions of that permit. Holders of temporary work permits in any sector cannot bring dependants.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Dependant applications are assessed under Jersey Immigration Rules paragraph 194 (spouse or civil partner), 197 (child) and 295J (unmarried partner). Where only one parent relocates with a child, that parent must evidence sole responsibility, meaning the other parent has abdicated or abandoned responsibility and the relocating parent exercises sole control over the child's day-to-day welfare.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The work permit holder must be able to accommodate and maintain the dependants adequately without recourse to public funds. Affordability is tested by comparing available net income (after rent, childcare and loan repayments) with the income support figure for an equivalent household; available net income must be greater than that figure.

The work permit holder must ensure that they can adequately accommodate and maintain their dependants without recourse to public funds (see definition of recourse to public funds on page 34). A work permit holder must consider the impact that moving a family to Jersey will have, including being aware of limited housing stock, high rental prices and costs of childcare.
When calculating whether an applicant, or sponsor, is able to maintain and accommodate themselves and any dependants, available net income (once rent, childcare and loan repayments has been removed) is compared against the income support figure that a similar household would be eligible for. Available net income must be greater than the income support figure.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

Adult dependants do not need a work permit and face no immigration restriction on the type of employment, but cannot switch into work permit employment. Their permissions are tied to the validity of the work permit holder's permissions. The initial leave to enter is applied for from abroad via GOV.UK; later leave to remain, indefinite leave to remain and citizenship applications are submitted directly to Jersey Customs and Immigration.

Dependants' permissions are tied to the validity of the work permit holders' permissions, and they cannot apply in country for work permit employment in their own right (see section on Dependants of long-term work permit holders).
