What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

An asylum applicant is a person who asks to be recognised as a refugee under the Refugee Convention because removal from Jersey would breach Jersey's Convention obligations, or who otherwise requests international protection.

Which population, circumstances or geographic group does the mechanism cover?

Refugee status is granted to a person in Jersey or at a Jersey port of entry who is a refugee within Article 1A of the Refugee Convention and not within Article 1D, 1E or 1F. Asylum applications from EU nationals are declared inadmissible unless the Minister is satisfied that exceptional circumstances require full consideration.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

Every person may apply for asylum on their own behalf. An asylum application made at a port or airport in Jersey (other than one refused under paragraph 345) is referred by the Immigration Officer for determination; authorities likely to be approached must be able to advise how and where an application may be made. What happens after the request: registration, family handling, major support and rights where officially stated?

While the application is pending (other than one refused under paragraph 345), no action is taken to require the applicant or their dependants to leave Jersey. If no decision can be taken within 6 months, the applicant is informed of the delay or, on written request, given the expected time-frame. A person granted refugee status is issued a Jersey Residence Permit, which may be valid for five years and renewable, subject to security and conduct exceptions. Which competent authority, UN body or official assistance channel should the person use?

Asylum applications are determined by the Minister in accordance with the Refugee Convention. Decisions are notified in writing, with information on how to challenge a refusal where the applicant has no legal representative, and applicants must be allowed an effective opportunity to consult a competent legal adviser at their own expense or on legal aid.
