Which family relationships qualify?

The applicant must be aged 18 or over and be the parent, grandparent, brother, sister, son or daughter of a qualifying BN(O)-route person.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The relative must be related to a person who is: (a) a BN(O) status holder with entry clearance or permission to stay under the BN(O) Status Holder route, or who has made a valid application for it; (b) the dependent partner of a BN(O) Status Holder with such permission or a valid application; (c) the child of a BN(O) status holder with entry clearance or permission (or a valid application) under the BN(O) Household Member route; (d) the dependent partner of such a child on the Household Member route; or (e) both a British citizen and a BN(O) status holder.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

For a first application the applicant must show dependency: as a result of age, illness or disability they require long-term personal care to perform everyday tasks, and they cannot obtain the required level of help in Hong Kong, even with the practical and financial help of the BN(O) sponsor or partner, because the help is not available and no one in Hong Kong can reasonably provide it, or it is not affordable.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The decision maker must be satisfied that the BN(O) Status Holder or their partner, or the BN(O) Household Member or their partner, is able to and will maintain and accommodate the relative adequately in Jersey without recourse to public funds for at least 6 months. Accommodation is not adequate if overcrowded or in breach of a statutory public health requirement; credible promises of future third-party support may be relied on.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

Entry clearance is applied for online on gov.uk and must be obtained before arriving in Jersey. Permission is granted for 30 months (plus up to 28 days of any remaining BN(O) permission) or 5 years, as applied for, with no access to public funds; work, including self-employment and voluntary work, is permitted except as a professional sportsperson or sports coach. The Hong Kong BN(O) routes are stated to be routes to settlement.
