Which family relationships qualify?

Children, legally adopted children, stepchildren or other dependants for whom a Belonger, PRC holder or work permit holder is a legal guardian may be sponsored; for this section 'work permit' means a New Business Permit or a Standard Work Permit. Children under eighteen are generally classified as dependants of their parents, and children attending a college or university full time continue to be classified as dependants, on an annual basis, up to the age of twenty-five, with proof of full-time education.

Limits of the record
  • A dependent child who turns eighteen and is not attending a college or university and wishes to reside in Bermuda requires permission in their own right to do so.
  • Dependent children whose courses are online are not permitted to seek employment or work in Bermuda without the Minister's permission.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The sponsor must be a Belonger, PRC holder or work permit holder who is the child's parent or legal guardian; for this section of the policy 'work permit' means a New Business Permit or a Standard Work Permit.

Limits of the record
  • The policy does not state expressly that holders of other work permit types cannot sponsor a dependent child; that follows only from the definition of 'work permit' in section 5.
  • Parents and other relatives of the permit holder are not sponsored dependants and must apply for separate permission to reside with an independent means of income.
  • chars 91720-92472
A sponsored dependent is limited to the following: ▶ spouse of a PRC holder or work permit holder (married or in a Domestic Partnership in accordance with Bermuda law); ▶ partner of a Bermudian, PRC holder or work permit holder (see the detailed guidelines on the Department of Immigration website: https://www.gov.bm/partner-genuine-and-subsisting-relationships); or ▶ child(ren) and legally adopted children, stepchildren, or other dependents for which a belonger, PRC holder or work permit holder is a legal guardian. For this section, the term ‘work permit’ means a New Business Permit or Standard Work Permit.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Proof of full-time education must be provided for a dependent child aged eighteen to twenty-five attending a college or university full time. Where a child is to be treated as a dependant for a longer duration or on an ongoing basis, for example because the child is unable for medical or other exceptional reasons to live independently, the Minister's express permission is required and proof, such as an official letter from the medical practitioner, must be submitted. The official source does not state the documents needed to prove the parent-child relationship, adoption or guardianship.

Limits of the record
  • The policy states no documentary requirement for proving the parent-child relationship, adoption, step-relationship or legal guardianship itself.

Proof (i.e. an official letter from the medical practitioner) must be submitted to support the exceptional circumstances.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

A sponsored dependant of a work permit holder may land in Bermuda as a bona fide resident once an entry/re-entry permit is issued; to obtain one, employers follow the instructions in the relevant forms when requesting a work permit. The permit issued is aligned with the end date of the sponsor's work permit, and if the dependant's passport or multi re-entry visa expires first the permit is granted to coincide with the passport expiry and can be amended once a certified copy of the new passport is submitted. Where a sponsored dependant obtains their own work permit the entry/re-entry permit is no longer valid and should be returned; if that work permit later expires and no new one is issued, they can apply for a new entry/re-entry document as a sponsored dependant.

See recorded sources
Limits of the record
  • The entry/re-entry permit allows the holder to seek employment unless otherwise stated on the permit, but section 5.1 states that sponsored dependent children are only given permission to reside, not to seek employment.
  • Where a sponsored dependant arrives in Bermuda without the entry/re-entry document, an undocumented fee may be levied at the airport.
  • chars 97240-99067
A sponsored dependent of a work permit holder may be permitted to land in Bermuda as a bona fide resident after the issuance of an entry/re-entry permit. The entry/re-entry permit allows the holder to seek employment unless otherwise stated on the entry/re-entry permit. To obtain an entry/re-entry permit, employers must follow the instructions in the relevant forms when requesting a work permit. For all successful applications, the sponsored dependent(s) will be issued an entry/re-entry permit that is aligned with the end date of the sponsor’s work permit. If the passport (or multi re-entry visa, where applicable) of the sponsored dependent expires before the end date of the sponsor’s work permit, the entry/re- entry permit will be granted to coincide with the sponsored dependent’s passport expiry date. Once a certified copy of the new passport is submitted to the Department, a request to amend the dates of the entry/re- entry permit can be made. It is essential that the sponsored dependent always carries the original entry/re-entry document when travelling. Where a sponsored dependent arrives in Bermuda without the entry/re-entry document, an undocumented fee may be levied at the airport (see Appendix III). Where a sponsored dependent of a work permit holder obtains their own work permit, the entry/re-entry permit issued to them will no longer be valid. The entry/re-entry permit should be returned to the Department. In cases where the same sponsored dependent’s work permit expires and where they are not issued a new work permit, they can apply for a new entry/re-entry document as a sponsored dependent of the work permit holder.
