What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

A person who fears persecution for a protected reason or faces a real risk of serious harm, including war, torture or inhuman treatment, may seek asylum/international protection in Belgium. The authorities decide whether refugee or subsidiary-protection status is granted; neither outcome is guaranteed.

Limits of the record
  • Protection depends on an individual assessment under the applicable refugee/subsidiary-protection rules; the route page is not a complete eligibility test.
  • Asylum in Belgium — protection grounds
If you fear to return to your country of origin (or country of previous residence in case you are stateless) because you are in danger of suffering serious harm for reasons related to your race, religion, nationality, political opinion, or membership of a particular social group or you flee war, torture, or inhumane and degrading treatment, you can apply for asylum (international protection) in Belgium.

Which population, circumstances or geographic group does the mechanism cover?

It covers people present on Belgian territory who fear returning to their country of origin (or, if stateless, their country of previous residence) because they are in danger of serious harm for reasons of race, religion, nationality, political opinion or membership of a particular social group, or who flee war, torture or inhuman and degrading treatment. It cannot be applied for from abroad.

You can only apply for international protection in Belgium if you are present on the Belgian territory. You cannot apply for asylum (international protection) in Belgium from abroad.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

The applicant must be physically present in Belgium; an application cannot be made from abroad. The application should be submitted at the Immigration Office for registration. Close family in another EU country may affect which state examines the claim under Dublin criteria.

Limits of the record
  • The page does not provide current registration appointment details or a complete evidence checklist.
  • Asylum in Belgium — territorial requirement
You can only apply for international protection in Belgium if you are present on the Belgian territory. You cannot apply for asylum (international protection) in Belgium from abroad.
  • Asylum in Belgium — filing
Applications for international protection should be submitted at the Immigration Office where your application will be registered.

What happens after the request: registration, family handling, major support and rights where officially stated?

The Immigration Office registers the application, while the CGRS examines it, interviews the applicant and decides at first instance. While the case is pending, the applicant may be required to remain in Belgium; leaving for another European country without authorisation can lead to return under the Dublin rules. The official source does not establish a guaranteed accommodation, income or support entitlement.

Limits of the record
  • Accommodation and material-support rules are not stated on this captured UNHCR page.
  • Asylum in Belgium — pending procedure
During the international protection procedure, you may have the obligation to stay in Belgium.
  • Asylum in Belgium — competent authorities
In Belgium, the authorities have the responsibility to process applications for asylum (international protection) and to decide whether somebody can be granted protection.
  • Asylum in Belgium — examination
The Office of the Commissioner General for Refugees and Stateless Persons (CGRS), the Belgian first instance international protection body, will examine your application, interview you and take a decision to grant you protection or not, in accordance with Belgian, European and international legislation.

Which competent authority, UN body or official assistance channel should the person use?

UNHCR states that it does not register or decide Belgian applications and cannot overturn a refusal. A negative CGRS decision may be appealed to the Council for Alien Law Litigation with a lawyer; the page warns that deadlines may be short and vary by appeal, and that later applications require new elements.

Limits of the record
  • The page gives a general 10–30 day appeal warning; exact deadlines and procedural rules must be verified against current Belgian authority notices for the decision type.
  • Asylum in Belgium — UNHCR role
In Belgium, therefore, UNHCR does not register refugees, does not examine applications for asylum (international protection) and does not issue refugee documents.
  • Asylum in Belgium — appeal
If you have received a negative decision from the CGRS, you have the right to appeal this decision before the Council for Alien Law Litigation (CALL) with the help of a (free) lawyer.
  • Asylum in Belgium — appeal deadline warning
Deadlines for appeals have to be respected and can be very short (between 10 and 30 days, depending on the appeal).

These are the answers currently recorded in the catalogue. A missing or partial answer is not an eligibility decision.
