What exactly is the official special programme/status and why does it exist?

A settlement route under Immigration Rules Appendix Gurkha and Hong Kong military unit veteran discharged before 1 July 1997, for Gurkhas or Hong Kong military unit veterans discharged before 1 July 1997 to settle in the UK; it also recognises grants under the earlier pre-1997 Gurkha scheme (the concession published on GOV.UK from 2008 to 2023). Veterans discharged on or after 1 July 1997 must use Appendix Armed Forces. The official source does not state why the route exists.

Which specific population, role, circumstance or historical/legal situation does it cover?

Nationals or citizens of Nepal who served in the Brigade of Gurkhas of the British Army, and nationals or citizens of China enlisted in Hong Kong (Hong Kong Chinese locally enlisted personnel) who served in the Hong Kong Military Service Corps of the British Army or the Hong Kong Squadron of the Royal Navy, discharged before 1 July 1997; plus their partner, children and dependent adult children, and the partner or child of a deceased veteran.

What circumstance, event, relationship, nomination, invitation or status activates access?

Discharge before 1 July 1997 after established military service for a continuous period of at least 4 years, unless the veteran receives a Ministry of Defence (MoD) disability pension or has an MoD gallantry medal. For family members: being the partner or child of a veteran who has entry clearance or settlement under the pre-1997 scheme or this appendix, is applying at the same time, or is deceased.

What sponsor, authority, nomination, certification, evidence or other step must occur before the status can be obtained?

From outside the UK, apply online for entry clearance on form VAF AF or in person at the Visa Application Centre in Kathmandu; in the UK, apply online on form SET(AF). Any fee must be paid, biometrics provided and a passport or other identity/nationality document supplied. Entry clearance must be obtained before arrival, a tuberculosis screening certificate provided where Appendix Tuberculosis applies, and the applicant must not fall for refusal under Part Suitability.

What immigration status and rights result, how long do they last, can family be included, and what happens if the special qualifying circumstance ends?

Applicants outside the UK are granted entry clearance for settlement; applicants in the UK are granted settlement. The partner, children and dependent adult children (and the partner or child of a deceased veteran) can also settle; children aged 18 or over must have been under 18 when the veteran was discharged, live in the same household and not have formed an independent family unit. A refusal can be challenged by Administrative Review.
