What exact status does accumulated residence lead to?

The status is the residence permit (Russian: vid na zhitelstvo; Turkmen: ýaşamak üçin ygtyýarnama): foreign nationals may reside in Turkmenistan if they hold a residence permit issued in the legally established order. Holders enter and stay in Turkmenistan with their border-crossing document without a visa, and the permit gives the right to cross the State border multiple times.

What qualifying residence period is required and when does the period begin?

Under Article 14(3) of the Migration Law, a foreign national or stateless person may apply for this residence permit after having resided in the territory of Turkmenistan for a period of not less than the last two years. The law does not state the exact starting point of this two-year count (e.g. first entry, first registration, or issuance of a specific prior document).

Limits of the record
  • Searched Migration Law Arts 14-17 and the MFA law for absence/continuity rules affecting accumulation of the qualifying residence period; only the two-year period itself (reserved to R2) and the Art 17 cancellation ground for an existing permit (moved to R5) exist.

What other major conditions apply, how is the status obtained, and what renewal, document-validity, retention or loss rules matter?

A foreign national or stateless person temporarily in Turkmenistan applies to the State Migration Service with a petition addressed to the President of Turkmenistan; the grant, refusal or cancellation is decided by an act of the President, and petitions must be considered within six months. The permit is issued for a term of up to five years in line with the validity of the holder's border-crossing document and is extended by the State Migration Service after the relevant checks. Grounds for cancellation include living continuously outside Turkmenistan for more than one year, except where circumstances beyond the person's control arising abroad prevented return.
