Which family relationships qualify?

SMART O covers the spouse and legitimate children of SMART Visa holders. The Board of Investment states that the applicant must be a legal dependant, spouse or child, of a SMART visa holder, and that children must be under 20 years old, with an exception that children of SMART "T" holders who are over 20 years old can apply for SMART "O" under certain conditions. The page also refers specifically to dependants of the SMART "S" two-year visa holder.

Limits of the record
  • The page does not state the conditions under which an over-20 child of a SMART T holder qualifies, and its wording ties the general dependency rule to the SMART S two-year visa without listing the other categories.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The sponsor is the SMART Visa holder. The dependency is defined against that person: the applicant must be the legal dependant, spouse or child, of a SMART visa holder, and the privileges granted to the dependant run for the same duration as the SMART visa holder's own permission. No Thai national or permanent resident sponsor is involved in this route.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

Dependants are granted permission to stay for the same duration as the SMART visa holder. The spouse, and children of a SMART "T" holder, are granted permission to stay and work with no work permit required; children generally are granted permission to stay only. Where a child of a SMART "T" holder works, the page requires the child to be at least 18 years old and the job not to be on the prohibited list of occupations and professions for foreigners, and a change of job requires additional endorsements. The dependant also gets 90-day reporting extended to one year, no re-entry permit, and airport fast-track where available. The page states no route from dependency to an independent status. The official source does not state the application process.
