Critical Skills Work Visa — Points-Based System

(4) Subject to any prescribed requirements, a critical skills work visa may be issued by the Director- General to an individual possessing such skills or qualifications determined to be critical for the Republic from time to time by the Minister by notice in the Gazette and to those members of his or her immediate family determined by the Director-General under the circumstances or as may be prescribed.

If the 100-point threshold is reached through an occupation contained on the critical skills list, and provided all other prescribed requirements are met, the applicant may be issued with a critical skills work visa.

(5) An application for a critical skills work visa shall be accompanied by proof that the applicant falls within the critical skills category in the form of-

(c) proof of evaluation of the foreign qualification by SAQA and translated by a sworn translator into one of the official languages of the Republic.

NB: An applicant must meet all other prescribed requirements (for example, police clearance, medical report, etc.) for a critical skills work visa or general work visa, and must earn 100 points to obtain a visa.

(a) a confirmation, in writing, from the professional body, council or board recognised by SAQA in terms of section 13(1)(i) of the National Qualifications Framework Act, or any relevant government Department confirming the skills or qualifications of the applicant and appropriate post qualification experience;

(b) if required by law, proof of application for a certificate of registration with the professional body, council or board recognised by SAQA in terms of section 13(1)(i) of the National Qualifications Framework Act; and

(1) An applicant for a general work visa, critical skills work visa or intra-company transfer work visa shall submit- (a) a written undertaking by the employer accepting responsibility for the costs related to the deportation of the applicant and his or her dependant family members, should it become necessary; and

(7) A spouse and dependant children of a holder of a critical skills work visa shall be issued with an appropriate visa valid for a period not exceeding the period of validity of the applicant's critical skills work visa.

(6) A critical skills work visa shall be issued for a period not exceeding five years.

Subject to section 25 and any prescribed requirements, the Director-General may issue a permanent residence permit to a foreigner who-

(a) has been the holder of a work visa in terms of this Act for five years and has proven to the satisfaction of the Director-General that he or she has received an offer for permanent employment;

(5) An applicant who applies for a permanent residence permit in terms of section 26(a) of the Act shall submit proof of a work visa contemplated in section 19 of the Act, for a continuous period of five years.
