What exact status does accumulated residence lead to?

The consulted Somalia Investment Promotion Office page lists temporary residence and permanent residence among the visa types issued to foreigners. It does not state that accumulated residence under this route leads to a specific status.

See recorded sources
Limits of the record
  • The page does not identify the catalogue route as a status obtained through accumulated residence.

What qualifying residence period is required and when does the period begin?

The temporary stay permit itself may not exceed one (1) year. The law's residence-based status is permanent residence: it may be granted to a foreigner of good reputation who applies, after at least five (5) continuous years.

Limits of the record
  • When the five-year period begins is not stated.
  • Catalogue: the Temporary Stay Permit (Art 18) is not itself a residence-based status; the period belongs to permanent residence (Art 19).

Which types of residence count fully, partially or not at all where the official rules specify this?

Only lawful presence in Somalia counts toward the permanent-residence period. No rules on partial counting or specific statuses are stated.

What absence/continuity rules affect accumulation of the qualifying residence period?

Permanent residence may be granted after lawful presence in Somalia for a period of not less than five (5) consecutive years, so the qualifying residence must be continuous.

  • Somali 'xariir ah' is translated as 'consecutive'.

What other major conditions apply, how is the status obtained, and what renewal, document-validity, retention or loss rules matter?

Under Article 18 (Qodobka 18aad, temporary stay permit) of the Somali immigration law: a temporary stay permit may be granted to any foreigner, except an unwelcome foreigner, who either holds an acceptable permit under Article 12(1) of the Law, or provides a guarantee from the interested person or another person that satisfies the Agency officer. The Director General of the Immigration and Citizenship Agency may waive the conditions in paragraph (1)(ii) where the foreigner shows other means to cover their needs during the stay and the cost of a return ticket or travel to another country. Every non-permanent stay permit must clearly state the duration of stay; without a permit under Article 12 (sh) the foreigner may not engage in profit-making activities in the country. The temporary stay permit cannot exceed one (1) year, and the holder must comply with the conditions stated in the permit.

  • Paragraph (1) uses sub-items a) and b) while paragraph (2) refers to '(1)(ii)'; the mapping to b) (guarantee) is our reading.
