What qualifying residence period is required and when does the period begin?
For the registered-residence route after an ordinary stay permit, captured Law 118/2010 Article 16(2) requires five continuous years counted from the date the Article 13 ordinary stay permit was issued, plus stable and effective residence in San Marino; the competent commission verifies the requirements and can refuse by reasoned decision. The five-year clock is therefore tied to issue of the ordinary permit, not simply the first entry date.

2. La Commissione Consiliare Permanente Affari Esteri, Emigrazione e Immigrazione
concede la residenza, previa verifica dei requisiti per ottenerla, allo straniero che viva in
maniera stabile ed effettiva in Repubblica in favore del quale sia stato rilasciato permesso di
soggiorno ordinario ai sensi dell’articolo 13, decorso il periodo di cinque anni continuativi
dalla data del rilascio del permesso di soggiorno. Con provvedimento motivato la
Commissione può negare la concessione della residenza.
