Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The applicant must be the surviving foreign parent of a qualifying child of a resident San Marino citizen. The provision allows that parent to request an ordinary stay permit when its stated conditions and the law's other requirements are met.

Limits of the record
  • Searched Art. 13(10-bis)/(10-ter) and Art. 13 generally for rules on proving parentage or dependency: none. The eligibility clause belongs to r1 (protected).

What important financial, accommodation, insurance or maintenance responsibilities apply?

A surviving foreign parent may request an ordinary residence permit where the child is a resident San Marino citizen, is no older than 25, is a qualifying child and is financially dependent on the parent. Article 13(10-bis) also refers to the requirements of the law without resolving here whom its marital or cohabitation condition qualifies. Article 13(8) requires suitable insurance valid in San Marino for ordinary-permit holders not otherwise covered for sickness, accident and maternity. Article 13(4) specifies adequate housing and annual income for family reunification, but the cited text does not resolve whether those paragraph 4 requirements also apply to this surviving-parent case.
