What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

This is the trafficking/violence-victim branch of San Marino's extraordinary stay permit: the same 'permesso di soggiorno straordinario' is issued to victims of trafficking and victims of violence, as those terms are defined by the international human-rights instruments ratified by San Marino.

Limits of the record
  • The definition of the covered victims (trafficking and violence victims as defined by ratified human-rights instruments) is in the opening clause of Art. 14(1-bis), already cited by the protected r1 answer.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

Issue is conditional on a positive opinion from the Equal Opportunities Authority, which may use public offices and services to make the necessary checks; the grant of extraordinary stay permits is decided by the Congress of State after the mandatory opinion of the Gendarmeria – Foreigners Office. The official source does not state where the victim lodges the request or whether a referral is required.

  • The law does not state where the victim lodges the request or whether a referral is required.

What happens after the request: registration, family handling, major support and rights where officially stated?

For victims of trafficking or violence, Article 14(1-bis) of the captured Law 118/2010 provides for an extraordinary stay permit in light of the person’s situation and/or cooperation in investigation or criminal proceedings; issue depends on a positive opinion from the Equal Opportunities Authority, which may make the necessary enquiries with public offices and services. Article 14(2) makes the permit temporary and provides for renewal for these victims on the indications of that Authority or the judicial authority. Article 14(1) grants healthcare, temporary social-security benefits and permission to work to an extraordinary permit issued for humanitarian social-protection needs. The captured wording does not establish that these benefits arise before permit issue, or expressly settle their application to the victim-specific permit in paragraph 1-bis.

Limits of the record
  • No separate registration procedure, pre-issuance benefits or victim-family processing rule is established by the captured Article 14. The scope of Article 14(1) benefits for paragraph 1-bis victim permits is not explicit.
  • The official coordinated text is explicitly updated to 3 June 2025 and is marked non-authentic by its publisher; the current index still links this exact ZIP/PDF on 25 September 2026. A bounded later-amendment search found no direct change to the cited Articles 13–16; this does not prove that no later law exists.
