This route is for anyone who undertakes an economic activity in corporate form in San Marino; it is a general company-founder/owner residence, open to any incorporated business rather than a narrower start-up or high-tech scheme.

What must actually exist or be demonstrated: business plan, company, innovation, clients, contracts, economic activity, job creation or other substance?

Residence for economic reasons is granted to the natural person who holds at least 51% of the company's share capital, so a controlling ownership stake in the San Marino company is what must exist. The residence is granted, even for an existing business, if at least 1 permanent employee is hired from the job-placement lists for an incentivised sector, or at least 3 for a non-incentivised sector; if more workers are hired (including fixed-term), at least 50% must come from those lists, and minimum hires are full-time.

What investment, capital, income, revenue, funding or viability evidence is central to this pathway?

Before registration, a real guarantee on a bank deposit of euro 75,000 in favour of the Eccellentissima Camera must be provided (replaceable by a bank or insurance surety for the same amount), to be raised to euro 150,000 within two years of obtaining residence or replaced by purchase of an existing property of at least that value, on pain of revocation. The applicant must not have registered debts (own or of participated San Marino companies) above euro 20,000, unless a payment deferral is duly honoured.

Residence for economic reasons is also granted to a spouse not legally separated (with no separation, dissolution or annulment proceedings pending), to a dependent unmarried child up to 25 (for minors, with the other parent's consent or court authorisation), and to a dependent child unable to support themselves due to disability. These family holders may register on the job-placement lists. The economic-reasons resident has no access to the subsidised-housing benefits of Law no. 110 of 15 December 1994 and Law no. 44 of 31 March 2015. What approval/application sequence applies, how long is the status granted, how is it renewed, and what longer-term residence direction is officially stated?

The Ufficio Attività Economiche notifies the Civil Status Office of the applicant's details for registration in the register of residents for economic reasons, if requested. If the grounds lapse, the beneficiary has ninety days to restore the requirements; otherwise the Ufficio Attività Economiche reports it to the Civil Status, Demographic and Electoral Services Office, whose Head orders revocation. After ten years from registration, with commitments fulfilled and after verification of the Art. 17(1)-(2) requirements and habitual dwelling, the residence is consolidated and extends to the cohabiting family unit. Up to 50 such residences may be granted per year (excluding para 8 family members), modifiable annually by delegated decree.
