    2. Subject to paragraphs 3 and 4, the requirements for the grant of St Helenian status in the case of a person who is the spouse or life partner of a person having St Helenian status are that— (a) the marriage or life partnership has been in existence for at least 3 years; (b) the applicant is of good character; (c) the applicant was in St Helena at the beginning of a period of 3 years ending with the date of the application and that— (i) the total number of days on which the applicant was absent from St Helena in that period does not exceed 150; (ii) the number of days on which the applicant was absent from St Helena in the period of twelve months so ending does not exceed 100; and (iii) the applicant was not in either of those periods undergoing a sentence of imprisonment nor in breach of any of the laws relating to immigration; or that the Governor in Council has granted (under paragraph 4) a dispensation from the requirements of sub-paragraphs (i) and (ii) (or either of them) of this paragraph; but nothing in this paragraph prevents a person who is the spouse or life partner of a person having St Helenian status from applying for status under paragraph 1.

Limits of the record
  • Read Schedule II paragraph 2, Immigration Ordinance section 15, Immigration Regulations regulation 4 and the official St Helenian Status page. They set character, relationship-duration, presence and absence requirements, and a dispensation power, but no financial, accommodation, insurance or maintenance responsibility for this route.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

The applicant applies in his or her own name in the approved form. The result is St Helenian status, which carries the automatic right of entry to St Helena, a right held by all persons holding St Helenian Status whether automatically or by grant. The official source does not state how long the status lasts.
