Limits of the record
  • Read Immigration Ordinance sections 17 and 23, Immigration Regulations regulation 10 in full and the Immigration Exemptions page. The exemption for a spouse or life partner of a person with St Helenian status carries no financial, accommodation, insurance or maintenance condition. The means and repatriation tests in section 20 and regulation 14 belong to entry permits, not to this exemption, and were deliberately not carried across.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

If satisfied that the applicant qualifies for exemption from holding an Entry Permit, the Board issues a certificate of exemption in the approved form, which remains valid as long as all the conditions of the relevant paragraph remain satisfied. The official source does not state a fixed duration, the rights granted or a route to independent or longer-term status.

Limits of the record
  • No fixed duration, no independent status and no longer-term residence direction are stated for the certificate.
  • Permission to work is treated separately from exemption from the Entry Permit requirement.
