Which family relationships qualify?

The spouse of the Romanian citizen; a foreigner living with the Romanian citizen, if neither has another marriage and they have a child together; children of the Romanian citizen, spouse or partner, including adopted children, under 21 or dependent (and those registered in that capacity in another member state); and first-degree ascendants of the Romanian citizen or spouse.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Spouses provide a marriage certificate issued by the Romanian authorities (a marriage concluded abroad must be transcribed at the Romanian civil status office) and a written declaration that the foreigner has not entered into another marriage. Children provide a birth certificate or other kinship documents from the competent authorities, translated and superlegalised or apostilled. A foreign parent of a minor Romanian citizen must prove the minor is in their care or that they regularly pay maintenance.

What important financial, accommodation, insurance or maintenance responsibilities apply?

Proof of legal possession of the living space at the declared address in Romania, proof of social health insurance and a medical certificate are required.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

After entry the family member obtains a residence permit from the General Inspectorate for Immigration territorial unit in the county of residence, applying in person at least 30 days before the visa-based right to stay expires, or online via portaligi.mai.gov.ro. The first permit is decided within up to 90 days, later permits within 30 days, extendable by 15 days. The temporary right may be extended for periods of up to 5 years, and the permit must be renewed at least 30 days before expiry. An independent right of residence may be granted when the original conditions end (reaching adulthood or 21, death of the sponsor/Romanian citizen, divorce or end of the partnership).

    After entering Romania you must obtain a residence permit. It certifies your right to stay in Romania and you can get it from the territorial units of the General Inspectorate for Immigration in the county where you live.
