Which family relationships qualify?

Under Immigration Act Article 122(1)(k), this visa-waived temporary-residence ground is for a third-country-national parent of a minor child who has Portuguese nationality and resides in Portugal. The parent must actually exercise parental responsibilities and ensure that child’s maintenance and education.

Limits of the record
  • The catalogue/AIMA route title also mentions a resident minor child without Portuguese nationality, but that broader wording is not established by Article 122(1)(k). Article 122(4) addresses a distinct parent circumstance tied to a child under Article 122(1)(b); it should not be silently substituted for this route.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Duly authenticated birth certificate of the child, and proof of the effective exercise of parental authority and of contribution to the child's support.

What important financial, accommodation, insurance or maintenance responsibilities apply?

Proof of means of subsistence; a sworn declaration of the residential address stating the basis of occupation (e.g. owner, tenant), with a land-registry certificate/access code if owner or usufructuary, or a landlord/host declaration if tenant.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

It is a temporary residence permit granted without a residence visa (Article 122(1)(k)), applied for with the AIMA document list and Form Modelo 1. Holders enjoy the rights in Article 83 (education, subordinate and independent work, health, access to law and courts). Unless special provisions apply, a temporary residence permit is valid for two years from issue and renewable for successive three-year periods. The official source does not state a path to independent or longer-term status.

Limits of the record
  • How the status becomes independent or longer-term is not stated in the cited sources.
  • Two-year/three-year validity comes from the general Article 75 rule, not a route-specific provision.

These are the answers currently recorded in the catalogue. A missing or partial answer is not an eligibility decision.
