Which family relationships qualify?

Third-country nationals and stateless persons who lead a family life within the meaning of the European Convention for the Protection of Human Rights and Fundamental Freedoms with EU, EFTA-EEA or Swiss citizens residing in Poland, and who do not fall into the category of family members enjoying EU freedom of movement. Where the relative is not a permanent partner but e.g. an adult child or sibling, additional elements of dependency (e.g. financial, or related to the need for care) must be demonstrated.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The family member joins or continues to reside with a citizen of an EU member state other than Poland, of an EFTA state party to the EEA agreement (Norway, Iceland, Liechtenstein) or of Switzerland, who resides in Poland. If the foreigner resides outside Poland, the application is submitted in paper form by the eligible family member (the EU/EFTA citizen residing in Poland).

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Evidence must show family life within the meaning of Art. 8 of the Convention with the EU/EFTA citizen, any dependency on that citizen where needed (e.g. an adult joining a parent), and justification for a stay exceeding 3 months. Examples: copy of the EU/EFTA citizen's passport or ID; the citizen's declaration of residing in Poland with the address; civil status certificates confirming family ties; evidence of common residence before the application, of direct/telephone/email contact, witness statements, marriage or registered civil partnership, common offspring. There is no closed list of documents; the evidence must show actual (not merely declared), permanent and close personal ties. Foreign-language documents need a sworn Polish translation.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The foreigner must have health insurance (under the Act of 27 August 2004 on publicly financed healthcare, or insurer confirmation covering treatment costs in Poland, e.g. ZUS certificate or private policy) and a stable and regular source of income sufficient to cover living costs for themselves and dependent family members: PLN 1,010 per month with no dependants, or PLN 823 per month for themselves and for each dependent family member.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

A temporary residence permit decided by the competent voivode (appeal to the Head of the Office for Foreigners). If in Poland, the foreigner applies electronically via MOS (stamp duty PLN 340), then attends the voivodeship office for travel document, fingerprints and signature; if abroad, the EU/EFTA citizen files on paper. Processing within 60 days of a complete application. Granted for the period necessary, more than 3 months, up to 3 years; it does not renew automatically — before expiry the foreigner must apply for a residence permit (same or different purpose). A residence card is issued; with it the holder may reside in Poland, cross the border without a visa and stay in other Schengen countries 90 days in any 180-day period; working generally requires a work permit (or a declaration for citizens of Ukraine, Belarus, Moldova or Armenia).
