What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

A statelessness determination and protection mechanism under Law No. 6149 on protection and naturalisation facilities for stateless persons: it governs the identification, protection, assistance and naturalisation facilities for stateless persons who are not refugees, and recognition has declaratory, humanitarian and apolitical effect.

Which population, circumstances or geographic group does the mechanism cover?

It covers any person not considered a national by any State under its law. Excluded: persons currently receiving protection or assistance from a UN body other than UNHCR; persons whose country of residence recognises the rights and obligations of its nationality; and persons with serious grounds to consider they committed a crime against peace, a war crime or a crime against humanity, a serious non-political crime outside their country of residence before admission, or acts contrary to UN purposes.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

A direct in-country application: it is lodged verbally or in writing with the Executive Secretariat of CONARE, in person or through a legal representative. At the border, migration authorities must forward within 24 hours the request of anyone without the required documents; once entry is authorised, the applicant must appear before the CONARE Executive Secretariat within 48 hours to formalise the request. Any public authority that identifies a possible stateless person must refer the case to the Secretariat.

What happens after the request: registration, family handling, major support and rights where officially stated?

The law preserves family unity; foreign-national family members have rights to identity documents and permanent residence. The Executive Secretariat of CONARE receives, registers and processes applications and informs applicants of their rights and obligations, and CONARE must facilitate access to free specialised legal assistance for applicants without means.

Which competent authority, UN body or official assistance channel should the person use?

The competent authority is the National Commission for Stateless Persons and Refugees (CONARE), whose Executive Secretariat receives, registers and processes applications and informs applicants of their rights and obligations. CONARE must facilitate access to free specialised legal assistance for applicants without means, and determination procedures, migration formalities and naturalisation are free of charge for the stateless person and family.
