Recognition of refugee status (reconocimiento de la condición de refugiado) in Paraguay, a protection status governed by Law No. 1.938/2002, the General Law on Refugees.

Which population, circumstances or geographic group does the mechanism cover?

It covers a person who, owing to a well-founded fear of persecution for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside their country of nationality and cannot or, owing to that fear, will not avail themselves of that country's protection.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

It is an in-country or border request: recognition can be requested at the CONARE office; it cannot be requested from outside Paraguay (for example at a Paraguayan embassy or consulate in the country of origin); the request must be made at the border or inside Paraguayan territory.

What happens after the request: registration, family handling, major support and rights where officially stated?

After the first data-registration interview the applicant is given a Refugee Application Certificate (Constancia de Solicitud de Refugio), which accredits them as a refugee-status applicant and their regular stay in the country; this provisional certificate allows them to work and move lawfully within the country. To keep it valid and avoid falling into irregular status, with the risk of the case being closed, it must always be extended before it expires; the applicant must set a domicile and keep it updated.

Which competent authority, UN body or official assistance channel should the person use?

Recognition of refugee status in Paraguay is requested at the office of CONARE. First-time applicants ask to be scheduled for an interview by email to solicitorefugio@mre.gov.py; enquiries on refugee status, notes for identity cards and other reports go to conare@mre.gov.py.
