Which citizenship, status or regional agreement creates the person's right to move/reside?

British citizens and their family members with a permanent right of residence in Norway at the end of 31 December 2020, and foreign nationals under § 19-33 who meet the conditions for permanent right of residence (Immigration Act § 115 or § 116), have a right to a permanent residence permit (Immigration Act § 62).

Under which circumstances can the person reside: worker, self-employed, student, jobseeker, self-funded person or another recognised basis?

Throughout the entire residence period the person must have met the conditions for at least one basis for the right of residence: employee, self-employed person, student, person with sufficient funds, or family member of such a person.

What entry, registration or residence-document formalities remain?

Those with a permanent right of residence at the end of 31 December 2020 had to apply for a permanent residence permit and residence card by 31 December 2021; those already holding a permanent residence permit or settlement permit had to order a residence card by 31 December 2021 (Immigration Act § 64a). The deadline is waived where there are reasonable grounds for missing it.

A family member of a UK national who has lived in Norway for at least five continuous years with a residence permit under the Separation Agreement must apply for a permanent residence permit to continue living in Norway; the UK national must meet the requirements for a permanent residence permit before the family member can apply.

When do permanent/long-term rights arise and what continuity, absence or retention conditions matter?

A permanent right of residence granted before the end of the transition period is not lost by stays outside Norway of up to five consecutive years; lawful residence both before and after 31 December 2020 counts towards the § 115/§ 116 residence time. British citizens and family members may alternatively obtain a permanent residence permit after three years' continuous residence if Immigration Act § 62 conditions are met. The permanent permit lapses if the person stays outside Norway for more than five consecutive years.
