What must actually exist or be demonstrated: business plan, company, innovation, clients, contracts, economic activity, job creation or other substance?

The applicant must be established in the UK as an independent service supplier, must not have a branch in the Netherlands, must have a contract for services with a client in the Netherlands for a maximum of 12 months, and must supply services directly to that client.

What business/self-employed activity may the holder conduct? Are there important restrictions? What is the family position where clearly stated?

The holder may work as an independent professional without a work permit for the specific profession; other work is allowed only if a work permit has been granted. Family reunification is not allowed with this residence permit.

  • Working as an independent professional
    The back of your resident permit states: ‘Work permit is not required for specific work, other work is allowed if a work permit has been granted’ (in Dutch: TWV niet vereist voor specifieke arbeid, andere arbeid toegestaan mits TWV is verleend). It means that you are allowed to work as an independent professional without a work permit. However, you do need a work permit for other types of work.
  • Family reunification
    Family reunification is not allowed with this residence permit.

What approval/application sequence applies, how long is the status granted, how is it renewed, and what longer-term residence direction is officially stated?

The residence permit is valid for the duration of the contract and for a maximum of 12 months. If the permit was valid for less than 12 months, it can be extended up to the maximum of 12 months. After reaching the maximum period of 12 months, a new residence permit can be applied for after a period of 12 months for the same employer and role, or for different work or a different employer. The official source does not state the application sequence or a longer-term residence direction.
