Which family relationships qualify?

The parent of a minor (under 18) Dutch child who has already been born; a step-parent, foster parent or other person who acts as a parent may also qualify. The child must be heavily dependent on the applicant, who cares for the child and is responsible for their upbringing.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The right derives from a minor Dutch child (under 18) who already lives in the Netherlands or will live there with the applicant. The applicant must not hold EU/EEA or Swiss nationality and must not have lawful residence in the Netherlands, another EU/EEA Member State or Switzerland.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

The applicant must show that the minor Dutch child is heavily dependent on them, meaning the child would have to leave the EU with them if no residence document is granted, and that they care for the child and are responsible for the upbringing (occasional help is usually not sufficient). To travel without a visa, documents proving parenthood are needed, for example the birth certificate, deed of recognition or adoption papers. Official foreign documents must be legalised and translated into Dutch, English, French or German.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

The application can only be made from within the Netherlands (a free Schengen visa facilitation may be needed to travel); the form is sent digitally or by post; the fee is €85; the IND decides within 6 months. The holder is free to work without a work permit. The residence document is usually valid for 5 years but expires on the day the Dutch child turns 18. After at least 5 years with this document the holder may be able to apply for a permanent residence permit.
