What qualifying residence period is required and when does the period begin?

Five years of continuous lawful residence in Montenegro are required, on the basis of approved temporary residence, or recognised refugee status or approved additional protection under the Asylum Law (Official Gazette RCG 45/06), or approved asylum or subsidiary protection under the law on international and temporary protection of foreigners. The official source does not state a separate start date for the period.

Time spent on temporary residence previously approved for schooling, specialisation, vocational training or practical training counts only at half. For a person granted asylum or subsidiary protection, half of the time from filing the international-protection application to the decision granting protection counts, but if that time exceeded 18 months it counts in full.

What absence/continuity rules affect accumulation of the qualifying residence period?

Residence is considered continuous even if, during the five years, the foreigner was absent from Montenegro several times for up to ten months in total, or once for up to six months.

What other major conditions apply, how is the status obtained, and what renewal, document-validity, retention or loss rules matter?

Other conditions: a valid foreign travel document (or stateless person's travel document); stable, regular and sufficient means of subsistence; health insurance; secured accommodation; knowledge of Montenegrin sufficient for basic communication; and proof of having met tax obligations during the temporary residence permit. The permit is refused where national or internal security requires. The application is filed in person with the Ministry at the place of residence on the prescribed form; at filing the foreigner must hold approved temporary residence, recognised refugee status or additional protection, or a right of residence established by a decision granting international protection. Language proof is not required from those who completed primary, secondary or higher education in Montenegro, nationals of former-SFRY states, those under 14 and those over 65. Those whose five years were based on refugee/additional protection or asylum/subsidiary protection need not meet the travel-document and health-insurance conditions; those whose five years were based on recognised statelessness need not meet the means, insurance and accommodation conditions. Permanent residence is granted for an indefinite period, while the permit is issued with a five-year validity and must be renewed. Permanent residence ceases, among other grounds, if the foreigner has emigrated from Montenegro or resided continuously in another state for more than one year.
