    PHOTOGRAPHY AND PERFORMANCE OF OVERSEAS ARTISTS PUSPAL 1.0 INTRODUCTION 1.1 All applications for filming by Foreign Film Production Companies and performances by Foreign Artistes must go through a one-stop application center managed by the responsible Ministry. 2.0 ELIGIBLE APPLICANT CATEGORIES 2.1 Foreign Artistes An individual or a group of individuals who are not Malaysian citizens and not permanent residents of Malaysia, who are filmed in a movie or hold a performance. 2.2 Foreign Crew An individual or a group of individuals who are not Malaysian citizens and not permanent residents of Malaysia, who are involved in a movie filming or a performance in Malaysia. This includes directors, camera operators, technical staff, makeup artists, crew, officers, and personnel, as well as any other positions required for a foreign performance and film production. 3.0 APPLICATION REQUIREMENTS 3.1 Applicants must be outside of Malaysia when submitting the application. 3.2 Applicants are only allowed to enter Malaysia after obtaining approval for their Professional Visit Pass (PLIK) and Visa with Reference (VDR). 3.3 You can refer to the PUSPAL Guidelines (GPP) for more information regarding the application for Foreign Film Production and Foreign Artiste Performances. OBJECTIVE These Guidelines are intended to clarify the following matters: 1.1 Government policy regarding the application process for performances by Foreign Artistes (FAs); 1.2 The determination of detailed procedures related to the application process and approval for performances by FAs in Malaysia; 1.3 The determination of comprehensive procedures for incident management on the performance day. 2. BACKGROUND 2.1 Based on a Cabinet decision in 2001, all applications involving filming by Foreign Film Production Companies (FFPCs) and performances by FAs shall go through a one-stop process managed by the appointed Ministry. 2.2 These Guidelines are applicable to performances by FAs in Malaysia. For filming by FFPCs in Malaysia, please refer to PUSPAL Guidelines on Filming by FFPCs. 2.3 The Government, through the Ministry, has set up: (a) a one-stop agency to coordinate applications for filming by FFPCs and performances by FAs, known as the Unit for Application for Foreign Filming and Performance by Foreign Artiste (PUSPAL); and (b) a committee known as JK-PUSPAL, to consider applications for foreign filming and performances by FAs made through PUSPAL. 2.4 The PUSPAL Guidelines serve as a medium to clarify the application procedure and related regulations, whilst taking into account the relationship between PUSPAL and related Government Agencies in granting licences/permits/approvals for filming by FFPCs and performances by FAs in Malaysia. 2.5 The PUSPAL Guidelines were first published in 2005, and have been revised in 2007, 2010, 2015 and 2022. 3. INTERPRETATION For the purposes of these Guidelines, the following interpretations shall be applied to the meanings in reference to - 8 “Applicant” means any party qualified to make an application for the performance of FAs in Malaysia; “artistic” means works such as poetry, painting, music, and other compositions created with talent (competence), a product of creation and description of art, something related to art, beauty (refined); “Committee for Application for Foreign Filming and Performance by Foreign Artiste (JK-PUSPAL)” means a committee comprising of several Government Agencies responsible for considering applications for filming and performance by FAs; “cigarette” means any product consisting wholly or partially of tobacco, which is cut, shredded or manufactured, or of any tobacco derivative or substitute, rolled up in a single or more wrapper, or any electronic and non-electronic cigarette devices which can be immediately smoked; “closed premises” means any place upon which any construction or structure has been erected, any premise or building whether permanent or temporary, or any other place in which any form of entertainment is held and where the public is allowed entry, with or without payment; “culture” refers to the entire way of life (including the actions, behaviour and thinking) and the result of all activities and creations in material or spiritual form (tangible and intangible) of a society; “drugs” means any dangerous drugs or substances set out in the First Schedule of the Dangerous Drugs Act 1952 [Act 234]; “entertainment” means an artistic and cultural activity that is exhibited and performed to an audience, for the purpose of entertaining the public or any class of the public; “end of performance” means a mode of action to end a performance by turning off: (a) the lights on stage; (b) the audio system; or (c) both at the same time. “foreign artistes (FAs)” means any individual or group of individuals who are neither Malaysian citizens nor permanent residents of Malaysia, who carries out a performance; “foreign crew (FC)” means any individual or a group of individuals who are neither citizens nor permanent residents of Malaysia, involved in an artistic and cultural performance, including directors, camerapersons, make-up artists, crew, officials, staff and any other position required for any performance; 9 “gambling” means any game based on chance or skill and chance played as bets, either monetary or goods in lieu of money, and includes any such games stipulated by any law in force; “Government” means the Federal Government; “Government Agency” means the ministry, department or statutory body of the Federal Government or State Government or local authority; “incident” means any unplanned occasion that involves: (a) public safety; or (b) the contravention of the code of ethics stipulated in Part 6. “liquor” means intoxicating liquor as defined in by Section 2 of the Customs Act 1967 [Act 235]; “local artistes (LAs)” means any individual or group of individuals who are Malaysian citizens or permanent residents of Malaysia, who carries out a performance; “local authority” means (a) any local authority established or deemed to be established under the Local Government Act 1976 [Act 171]; (b) the Datuk Bandar Kuala Lumpur appointed in accordance with Section 3 of the Federal Capital Act 1960 [Act 190]; (c) the local authority established under the Federal Territory of Labuan (Amendment of Local Government Ordinance) Act 1993; (d) the local authority established under the Perbadanan Putrajaya Act 1995 [Act 536]; (e) any local authority in Sabah established or deemed to be established under the Local Government Ordinance 1961; (f) any local authority in Sarawak established or deemed to be established under the Local Authorities Ordinance 1996; or (g) includes any individual or group of individuals appointed or authorised under any written law to carry out and implement the power and function given to and imposed on any local authority under any written law; “local crew (LC)” means any individual or a group of individuals who are citizens or permanent residents of Malaysia, involved in an artistic and cultural performance in Malaysia, including directors, camerapersons, make-up artists, crew, officials, staff and any other position required for a performance; 10 “Maximum Approval Value” means the maximum number of FAs approved to carry out performances at a premise at any given time; “Minister and the Ministry” means the Minister and Ministry responsible for the entry of FAs and/or FCs; “nation” means Malaysia, unless otherwise stated; “open premises” means public venues or any open space allocated or designated for public use or opened to the public at any given time, with or without payment; “Organiser” refers to - (a) any company specialising in organising artistic and cultural performances involving FAs and/or FCs; (b) any management of any hotel or tourist accommodation premises or entertainment premises intending to hold performances by FAs at said hotel or premise; (c) any registered society or organisation intending to carry out performances by FAs; or (d) any individual officer or officers employed by such a company, management or registered society or organisation; “performance” means: (a) any artistic and cultural activity carried out in relation to the performing arts, whether in a closed or open premise and whether entrance fees are charged or not; (b) any artistic and cultural activity held in the following venues - (i) Hotels; (ii) Entertainment centres; (iii) Entertainment premises; (iv) Cultural centres; (v) Stadiums; (vi) TV stations (recording); or (vii) Other premises approved by JK-PUSPAL; (c) any artistic and cultural activity that involves - (i) Performance or concert in an open or closed premise; (ii) Promotion of FA’s album, songs or films; and (iii) Promotion of goods and products; 11 “performance capacity” means the maximum number of patrons attending the performance, which are further classified below: Capacity *Number of Patrons Attending “Small Capacity Performance” Less than or equal to 500 “Medium Capacity Performance” 501 to 5,000 “Large Capacity Performance” More than 5,000 *Based on expected number of tickets sold. The list of performance venue in Malaysia is in Appendix A. “performance period” means the number of hours or number of days in which a performance by an FA is held; “Professional Visit Pass (PLIK)” means any work permit issued by JIM to foreign nationals who intend to carry out specific work for a short, defined period of time in Malaysia; “PUSPAL Monitoring Team” means the group consisting of JK-PUSPAL members and/or PUSPAL Unit members that will assist in monitoring any Capacity Performance; “PUSPAL Officer(s)” means an identified representative from JK-PUSPAL that is responsible for leading the PUSPAL Monitoring Team at any Capacity Performance; “representation” means the process of fact preparation for the consideration of JK-PUSPAL, for the purposes of maintaining its decision or otherwise; “Responsible Organiser(s)” means an identified representative(s) from the Organiser that is responsible for the application and monitoring of any Capacity Performance; “Temporary Work Period” means the number of days calculated from the date the FA and/or FC enters Malaysia and carries out temporary work, until the date the FA and/or FC leaves Malaysia; “tobacco” means the Nicotiana tabacum plant species or any part of it, whether cured or not, including hybrids of the species, hybrids resulting from crossbreeding of the species or crossbreeding with other species or hybrids of the plant and genetically engineered versions of the species or hybrids; and 12 “withholding tax” means the tax levied on non-residents (individuals/bodies other than individuals) on remuneration or other income in connection with services carried out or provided in Malaysia, in accordance with the Income Tax Act 1967 [Act 53] and any relevant Public Rulings existing and effective as at the date of the Performance. 4. APPLICATION 4.1 All performances by FAs in Malaysia are under the supervision of PUSPAL and subject to the Guidelines except, (a) All performances by FAs in Sabah and Sarawak; (b) FAs and/or Foreign Crew (FC) under the category of Commercial Officer whose contract with their employer exceeds 180 days continuously, without an application for extension in the relevant period; (c) Performances by FAs declared by the Ministry of Tourism, Arts and Culture (MOTAC) as being part of a Cultural Exchange Program; and (d) Performances by FAs declared by the Ministry of Foreign Affairs (KLN) or MOTAC as being part of a Cultural Cooperation Program between Malaysia and any foreign State. 4.2 Notwithstanding Item 4.1, all performances by FAs excluded from the supervision of PUSPAL and the application of these Guidelines are subject to taxation laws, immigrations laws and other relevant laws in force. 4.3 Any party interested in the Cultural Exchange Program or Cultural Cooperation Program mentioned in Items 4.1(c) and 4.1(d) respectively should refer to the International Relations Division (Culture), MOTAC for further information. 13 GPP 6.0 PART 2: COMMITTEE FOR APPLICATION FOR FOREIGN FILMING AND PERFORMANCE BY FOREIGN ARTISTE (JK-PUSPAL) 5. FUNCTION The function of JK-PUSPAL is to consider and make decisions on applications for foreign filming and performances by FAs. 6. COMPOSITION JK-PUSPAL shall comprise of the following members: Chairman : Secretary General of the Ministry of Communications Acting Chairman : Any Deputy Officer of the Ministry of Communications as assigned by the Chairman Permanent Members : With reference to the respective functions as prescribed in Appendix B Ministry of Tourism, Arts & Culture (MOTAC) 1. Undersecretary of Policy Division (Culture) or representative Royal Malaysian Police (PDRM) 2. Director of Special Branch or representative 3. Chief Public Relations Officer or representative 4. Designated Officer in-charge Police District or representative Department of Immigration of Malaysia (JIM) 5. Director General or representative 15 Inland Revenue Board Malaysia (LHDNM) 6. Director of Foreign Taxpayer Branch or representative Royal Malaysian Customs Department (KASTAM) 7. Director General or representative Ministry of Foreign Affairs (KLN) 8. Secretary General or representative Ministry of Home Affairs (KDN) 9. Undersecretary of Enforcement and Control Division or representative National Film Development Corporation Malaysia (FINAS) 10. Chief Executive Officer or representative Department of Islamic Development of Malaysia (JAKIM) 11. Director General or representative Kuala Lumpur City Hall (DBKL) 12. Executive Director of Socio-Economic Development or representative National Department for Culture and Arts (JKKN) 13. Director General or representative Associate Members (ex- : A representative from any Government or officio) private agency, as prescribed in Appendix B. Secretariat : PUSPAL Unit 16 7. QUORUM The minimum number of permanent members required to convene a JK- PUSPAL meeting is seven (7). LHDNM, JIM and PDRM are required to attend each meeting. 8. DECISION ON APPLICATION 8.1 Any decision made by JK-PUSPAL on any application shall be the decision of the majority of the members present at the meeting. 8.2 Any decision made by JK-PUSPAL on any application shall be made known to the Applicant in writing, or through telephone, or through the PUSPAL’s portal. 8.3 Any Applicant who is not satisfied with the decision made by JK-PUSPAL may make a representation for consideration. The decision from an appeal is considered as final result. 8.4 When an appeal is approved, the Applicant may be charged with additional guarantee on top of existing one that has to be paid to the Local Authority for an amount that will be decided by JK-PUSPAL, based on the risks and capacity size of the performance. 8.5 Any party affected by any decision made by JK-PUSPAL is not entitled to claim any damages or compensation or take any legal action against the Government. 9. MANAGEMENT For the purpose of carrying out management and responsibilities under these Guidelines, JK-PUSPAL shall be operated/facilitated by PUSPAL Unit under the purview of the Ministry. 17 GPP 6.0 PART 3: APPLICATIONS 10. REGISTRATION WITH PUSPAL 10.1 Any individual/organisation that intends to submit an application for the first time must be registered with PUSPAL. 10.2 The following documents are required for registration: (a) Application Letter for Registration; and (b) Certified Business Registration Slip (CTC MYDATA SSM) or a duly certified copy thereof. 10.3 Any first-time applicant will also be interviewed and assessed by JK- PUSPAL. 11. QUALIFICATION OF APPLICANT 11.1 Only Organisers that have been registered with PUSPAL are entitled to submit an application. 11.2 Any representative acting on behalf of an Organiser shall include a Letter of Authorisation at the time of submission. 11.3 An Organiser and/or its representative is required to have an income tax number that has been registered with LHDNM. 12. CATEGORY OF PERFORMANCE BY FA IN MALAYSIA & TEMPORARY WORK PERIOD (TWP). An application for performance by FA in Malaysia may refer to any of the following categories: No. Category Explanation Maximum (TWP) 1. Entertainment Any performance by a FA at any 90 days Premises entertainment premise or three (3) Performance star hotel and above, which possesses an entertainment licence and contract with specific period. 2. Concert Music performance by singers or 90 days musicians in front of a large audience, and may involve the sale of tickets with pricing that varies based on seating categories. 19 No. Category Explanation Maximum (TWP) 3. Singing/Music Music performance by singers or 90 days musicians in front of an audience, at a scale smaller than concerts. 4. Theatre/Opera/ (i) Any visual performance that 90 days Magic Show/ involves elements of drama, Orchestra music, singing and alike; or (ii) Any performance intended to assist local opera artistes or existing opera bodies in the country; or (iii) Any magic show performance in front of an audience; or (iv) Any orchestra performance intended to assist local orchestra artistes. 5. Dance/ (i) Any performance consisting of 90 days Acrobatics/ whole-body movements, Circus/Self- synchronised to the rhythm of Defence music be it in traditional, modern or contemporary form; or (ii) Any performance that involves bodily movements requiring agility, skill and flexibility; or (iii) Any performance by a group of entertainers consisting of various skills such as acrobatics, clowns and alike; or (iv) Any showcase of self- defence/martial arts in front of an audience. 6. Promotion Any promotional program for a 90 days specified cause or item such as animated characters, artistes, albums, songs, concerts, films, drawings, books, products and alike. 7. Contract Artiste Where an FA enters into a contract 365 days with an Organiser for a duration that exceeds 90 days for various performances (such as album recordings, promotional activities, television station appearances etc.) during a TWP, and the average payment rate is not less than RM 20 No. Category Explanation Maximum (TWP) 3,000 per month. FAs under this category refers to those affiliated with television stations and recording companies. 8. Master of Includes individuals or a group of 90 days Ceremony/Host individuals who are directly involved in any events and manage the stage such as hosts, speakers, moderators, reviewers, comedians and educators. 9. Music Festival An event featuring musical 90 days performances by various singers or musicians which may take place on multiple stages within a designated premise and may span across several days. 10. Others Includes individuals or a group of 90 days individuals who are directly involved in any events, perform on stage and other performers apart from those stated in the above-mentioned categories. 13. PRE-APPLICATION 13.1 Applicants falling under the category of Concert, Music Festival, Entertainment Premise Performance (DJ) and Master of Ceremony/Host are required to submit a Pre-Application in the manner prescribed in Appendix C, for the purpose of reviewing the initial status and concept of the FAs performance before any official application such performance can be submitted to PUSPAL. 13.2 Any decision on the Pre-Application shall not be considered as a final decision for any performance by FA in Malaysia. However, any advertising, promotion and ticket sales for any performance by FA in Malaysia shall obtain the pre-approval. 13.3 The Applicant shall be notified regarding the decision on the Pre- Application within 14 days from the date the Pre-Application was received. 21 14. APPLICATIONS FOR PERFORMANCE BY FOREIGN ARTISTES (FAs) IN MALAYSIA 14.1 NEW APPLICATION (a) Subject to Item 13 of these Guidelines, any Applicant who intends to submit an application for performance by FA in any category is required to submit a complete application within the period as mentioned in Appendix D. Applications submitted later than the specified period will not be considered for processing. (b) A complete application must be submitted within the above- mentioned period(s) for the purpose of: (i) Ensuring smooth coordination for the process of obtaining visas with references (VDR) from the relevant office or Malaysian embassies or high commissions in the foreign country of any FA and/or FC that requires a visa to enter Malaysia. (ii) Addressing any issues (such as incomplete applications) are resolved before the start of the performance period. (iii) Facilitating the application process for any permits or approvals that may be required from local authorities and other relevant Government Agencies before the start of the performance period. (c) For the purposes of such application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix D. (d) The application procedure is illustrated in Appendix E. 14.2 ADDITIONAL APPLICATION (a) Any Applicant who intends to submit a subsequent application for the same category of performance must submit an Additional Application no later than 14 days before the start date of the TWP prescribed in Item 12 of these Guidelines. (b) For the purposes of such Additional Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix F. 22 14.3 SPECIAL CONDITIONS FOR APPROVAL (a) JK-PUSPAL may require a preliminary viewing or hearing of any live or recorded performance by FA before granting approval for any application. JK-PUSPAL may grant a Maximum Approval Value based on reasonable consideration and determination of the number of FAs required in any particular performance, for all categories of performance. (b) Notwithstanding the above, an Applicant is also required to abide by special conditions (if any) in respect of the relevant category of performance by FA as prescribed in Appendix G. 15. WITHDRAWAL OF APPLICATION 15.1 Any Applicant who wishes to withdraw their application whether or not approval has been granted by JK-PUSPAL, is required to submit a letter requesting withdrawal along with any justification and supporting documents. 15.2 Submission must be made by writing and online to PUSPAL Unit as soon as possible. 15.3 The Organiser shall make a clear statement/announcement of any cancellation of a performance via any platform accessible by the public. 15.4 Any loss is at the sole risk and responsibility of the Organiser. 16. APPROVAL & DISMISSAL OF APPLICATION 16.1 Per Item 8, any decision made by JK-PUSPAL shall be communicated to the Applicant within 14 days from the date of receipt of any application, except for problematic or incomplete applications that may be rectified by the Applicant. 16.2 An application may be dismissed by JK-PUSPAL due to the following reasons: (a) The contents of the application are incomplete or inaccurate, and the Applicant has failed to rectify the application; and/or (b) The Organiser and/or representative has been blacklisted by JK-PUSPAL; and/or (c) Background checks on the performance reveal that the FA has negatively touched on national policies, religious issues, ethnic issues, cultural sensitivities and/or any other matter that prejudices public interest; and/or 23 (d) Background checks on the performance reveal that the FA has violated the Code of Ethics as stated in Part 6 of these Guidelines, and there is suggestion that the FA would not be willing to comply if the application was approved; and/or (e) There are written directives from any Local Authority or Government Agency opposing the application; and/or (f) Any other reason deemed reasonable at the discretion of JK- PUSPAL. 17. ANCILLARY APPLICATIONS 17.1 APPLICATION FOR EXTENSION OF TEMPORARY WORK PERIOD (TWP) (a) An application for extension of TWP for FAs and/or FC shall only be considered where; (i) The FA is from an ASEAN country; and (ii) No warning or negative reports has been made by any party regarding the FA, their performance or the Organiser during any previous performance. (b) The maximum period of extension of TWP that may be granted is 90 days for all categories of performance by FAs except the category of Contract Artiste, where no extension will be granted. (c) Any application for extension of TWP must be submitted no later than 14 days before the date such work period is scheduled to expire. (d) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix H. 17.2 APPLICATION FOR SHORTENING OF TEMPORARY WORK PERIOD (TWP) (a) An application for shortening of TWP for FAs and/or FC must be submitted to PUSPAL Unit. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix I. 24 17.3 APPLICATION FOR CHANGE OF DATE OR POSTPONEMENT OF PERFORMANCE (a) Subject to the Regulations of the relevant Government Agencies, an application for change of date or postponement of performance shall only be considered where the proposed date does not exceed 30 days from the original date of performance by FA. (b) An application for change of date or postponement of performance must be submitted no later than seven (7) days after the start date of performance by FA. (c) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix J. (d) Where the proposed date exceeds 30 days from the original date of performance by FA, approval for such performance will be revoked and the Organiser shall be required to resubmit their application for performance as a fresh application. 17.4 APPLICATION FOR CHANGE OF FOREIGN ARTISTE (FA) AND/OR FOREIGN CREW (FC) (a) Any Applicant who, after having received approval from JK-PUSPAL and with specific reasons, intends to (i) Change any FA and/or FC from such persons originally applied for; (ii) Substitute any FA and/or FC whose TWPs have been shortened; or (iii) Replace any FA and/or FC who have failed to enter Malaysia - must submit an Application no later than 14 working days before the start date of the TWP as prescribed in Item 12 of these Guidelines. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix K. (c) Where an application falls under the category of Entertainment Premise Performance, an application for change of FA and/or FC are limited to two (2) times only. 25 17.5 APPLICATION FOR TRANSFER OF FOREIGN ARTISTE (FA) AND/OR FOREIGN CREW (FC) FROM EXISTING ORGANISER TO NEW ORGANISER (a) An application to transfer any FA and/or FC still under contract to perform with an existing Organiser is not permitted unless the PLIK issued for the FA and/or FC under the existing Organiser has expired or been terminated prematurely. (b) Any application for performance by FA in Malaysia by the new Organiser must be submitted as a fresh application to JK-PUSPAL. (c) Notwithstanding Items 17.5(a) and 17.5(b), any application to any FA and/or FC from one Organiser to another after the expiry of TWP must also be submitted as a fresh application to JK-PUSPAL. (d) If such application is supported, the FA and/or FC must exit and re- enter Malaysia without having to observe any cooling-off period. (e) The new Organiser will also be responsible for obtaining a new PLIK for the FA and/or FC from JIM. 26

    10. REGISTRATION WITH PUSPAL 10.1 Any individual/ organisation that intends to submit an application for the first time must be registered with PUSPAL. 10.2 The following documents are required for registration: (a) Application Letter for Registration; (b) A copy of the film production license issued by FINAS for the LFPC; and (c) Certified Business Registration Slip (CTC MYDATA SSM) or a duly certified copy thereof. 10.3 Any first-time applicant will also be interviewed and assessed by JK- PUSPAL. 11. QUALIFICATIONS OF APPLICANT 11.1 Only LFPCs are eligible to be an Applicant. 11.2 Any Production’s Representative acting on behalf of an LFPC shall include a Letter of Authorisation in the application submission. 11.3 The LFPC and/or its representative must have an income tax number that has been registered with LHDNM. 11.4 The Foreign Filming Application Flowchart is illustrated in Appendix B. 12. CATEGORY OF FILM PRODUCTION AND TEMPORARY WORK PERIOD (TWP) 12.1 An application for foreign film production in Malaysia may refer to any of the following categories: No. Category Explanation 1. Advertisements Shooting a short film to promote a product, service or information for the purpose of informing the public. 2. Documentary Non-fiction film production that displays information or facts about a certain subject. 3. Feature A story or event recorded as a moving image (Movie/Drama) and shown in cinemas or on television. 17 No. Category Explanation 4. TV Programmes Television shows either recorded or live. 5. Others Filming other than Commercials, Documentaries, Feature Films and TV Programmes. 12.2 The TWP for FAs and/or FCs is based on the requirements of the foreign film production and shall not exceed 180 days. 12.3 However, LFPCs are allowed to submit applications to extend the TWP beyond 180 days based on the requirements of the foreign film production. 12.4 If the approved TWP exceeds 180 days, an Interim PLIK approval will be granted by JIM. 12.5 JK-PUSPAL may set a reasonable TWP at its own discretion, subject to JK-PUSPAL's considerations and relevant Government Agency regulations.

What organisation, institution, religious body, charity, teacher or host must support the activity?

For foreign filming, a PUSPAL-registered local film-production company with a FINAS production licence applies; performances use a registered organiser. An authorised representative and LHDN tax registration are required where relevant. PUSPAL project approval must be secured before the separate Immigration PVP and any required Visa With Reference. Filming requires at least 30% locally registered crew, subject to PUSPAL discretion; concert, music-festival and singing/music performances similarly require at least 30% local technical crew unless PUSPAL determines another ratio.

OBJECTIVE These Guidelines are intended to clarify the following matters: 1.1 Government policy regarding the application process for performances by Foreign Artistes (FAs); 1.2 The determination of detailed procedures related to the application process and approval for performances by FAs in Malaysia; 1.3 The determination of comprehensive procedures for incident management on the performance day. 2. BACKGROUND 2.1 Based on a Cabinet decision in 2001, all applications involving filming by Foreign Film Production Companies (FFPCs) and performances by FAs shall go through a one-stop process managed by the appointed Ministry. 2.2 These Guidelines are applicable to performances by FAs in Malaysia. For filming by FFPCs in Malaysia, please refer to PUSPAL Guidelines on Filming by FFPCs. 2.3 The Government, through the Ministry, has set up: (a) a one-stop agency to coordinate applications for filming by FFPCs and performances by FAs, known as the Unit for Application for Foreign Filming and Performance by Foreign Artiste (PUSPAL); and (b) a committee known as JK-PUSPAL, to consider applications for foreign filming and performances by FAs made through PUSPAL. 2.4 The PUSPAL Guidelines serve as a medium to clarify the application procedure and related regulations, whilst taking into account the relationship between PUSPAL and related Government Agencies in granting licences/permits/approvals for filming by FFPCs and performances by FAs in Malaysia. 2.5 The PUSPAL Guidelines were first published in 2005, and have been revised in 2007, 2010, 2015 and 2022. 3. INTERPRETATION For the purposes of these Guidelines, the following interpretations shall be applied to the meanings in reference to - 8 “Applicant” means any party qualified to make an application for the performance of FAs in Malaysia; “artistic” means works such as poetry, painting, music, and other compositions created with talent (competence), a product of creation and description of art, something related to art, beauty (refined); “Committee for Application for Foreign Filming and Performance by Foreign Artiste (JK-PUSPAL)” means a committee comprising of several Government Agencies responsible for considering applications for filming and performance by FAs; “cigarette” means any product consisting wholly or partially of tobacco, which is cut, shredded or manufactured, or of any tobacco derivative or substitute, rolled up in a single or more wrapper, or any electronic and non-electronic cigarette devices which can be immediately smoked; “closed premises” means any place upon which any construction or structure has been erected, any premise or building whether permanent or temporary, or any other place in which any form of entertainment is held and where the public is allowed entry, with or without payment; “culture” refers to the entire way of life (including the actions, behaviour and thinking) and the result of all activities and creations in material or spiritual form (tangible and intangible) of a society; “drugs” means any dangerous drugs or substances set out in the First Schedule of the Dangerous Drugs Act 1952 [Act 234]; “entertainment” means an artistic and cultural activity that is exhibited and performed to an audience, for the purpose of entertaining the public or any class of the public; “end of performance” means a mode of action to end a performance by turning off: (a) the lights on stage; (b) the audio system; or (c) both at the same time. “foreign artistes (FAs)” means any individual or group of individuals who are neither Malaysian citizens nor permanent residents of Malaysia, who carries out a performance; “foreign crew (FC)” means any individual or a group of individuals who are neither citizens nor permanent residents of Malaysia, involved in an artistic and cultural performance, including directors, camerapersons, make-up artists, crew, officials, staff and any other position required for any performance; 9 “gambling” means any game based on chance or skill and chance played as bets, either monetary or goods in lieu of money, and includes any such games stipulated by any law in force; “Government” means the Federal Government; “Government Agency” means the ministry, department or statutory body of the Federal Government or State Government or local authority; “incident” means any unplanned occasion that involves: (a) public safety; or (b) the contravention of the code of ethics stipulated in Part 6. “liquor” means intoxicating liquor as defined in by Section 2 of the Customs Act 1967 [Act 235]; “local artistes (LAs)” means any individual or group of individuals who are Malaysian citizens or permanent residents of Malaysia, who carries out a performance; “local authority” means (a) any local authority established or deemed to be established under the Local Government Act 1976 [Act 171]; (b) the Datuk Bandar Kuala Lumpur appointed in accordance with Section 3 of the Federal Capital Act 1960 [Act 190]; (c) the local authority established under the Federal Territory of Labuan (Amendment of Local Government Ordinance) Act 1993; (d) the local authority established under the Perbadanan Putrajaya Act 1995 [Act 536]; (e) any local authority in Sabah established or deemed to be established under the Local Government Ordinance 1961; (f) any local authority in Sarawak established or deemed to be established under the Local Authorities Ordinance 1996; or (g) includes any individual or group of individuals appointed or authorised under any written law to carry out and implement the power and function given to and imposed on any local authority under any written law; “local crew (LC)” means any individual or a group of individuals who are citizens or permanent residents of Malaysia, involved in an artistic and cultural performance in Malaysia, including directors, camerapersons, make-up artists, crew, officials, staff and any other position required for a performance; 10 “Maximum Approval Value” means the maximum number of FAs approved to carry out performances at a premise at any given time; “Minister and the Ministry” means the Minister and Ministry responsible for the entry of FAs and/or FCs; “nation” means Malaysia, unless otherwise stated; “open premises” means public venues or any open space allocated or designated for public use or opened to the public at any given time, with or without payment; “Organiser” refers to - (a) any company specialising in organising artistic and cultural performances involving FAs and/or FCs; (b) any management of any hotel or tourist accommodation premises or entertainment premises intending to hold performances by FAs at said hotel or premise; (c) any registered society or organisation intending to carry out performances by FAs; or (d) any individual officer or officers employed by such a company, management or registered society or organisation; “performance” means: (a) any artistic and cultural activity carried out in relation to the performing arts, whether in a closed or open premise and whether entrance fees are charged or not; (b) any artistic and cultural activity held in the following venues - (i) Hotels; (ii) Entertainment centres; (iii) Entertainment premises; (iv) Cultural centres; (v) Stadiums; (vi) TV stations (recording); or (vii) Other premises approved by JK-PUSPAL; (c) any artistic and cultural activity that involves - (i) Performance or concert in an open or closed premise; (ii) Promotion of FA’s album, songs or films; and (iii) Promotion of goods and products; 11 “performance capacity” means the maximum number of patrons attending the performance, which are further classified below: Capacity *Number of Patrons Attending “Small Capacity Performance” Less than or equal to 500 “Medium Capacity Performance” 501 to 5,000 “Large Capacity Performance” More than 5,000 *Based on expected number of tickets sold. The list of performance venue in Malaysia is in Appendix A. “performance period” means the number of hours or number of days in which a performance by an FA is held; “Professional Visit Pass (PLIK)” means any work permit issued by JIM to foreign nationals who intend to carry out specific work for a short, defined period of time in Malaysia; “PUSPAL Monitoring Team” means the group consisting of JK-PUSPAL members and/or PUSPAL Unit members that will assist in monitoring any Capacity Performance; “PUSPAL Officer(s)” means an identified representative from JK-PUSPAL that is responsible for leading the PUSPAL Monitoring Team at any Capacity Performance; “representation” means the process of fact preparation for the consideration of JK-PUSPAL, for the purposes of maintaining its decision or otherwise; “Responsible Organiser(s)” means an identified representative(s) from the Organiser that is responsible for the application and monitoring of any Capacity Performance; “Temporary Work Period” means the number of days calculated from the date the FA and/or FC enters Malaysia and carries out temporary work, until the date the FA and/or FC leaves Malaysia; “tobacco” means the Nicotiana tabacum plant species or any part of it, whether cured or not, including hybrids of the species, hybrids resulting from crossbreeding of the species or crossbreeding with other species or hybrids of the plant and genetically engineered versions of the species or hybrids; and 12 “withholding tax” means the tax levied on non-residents (individuals/bodies other than individuals) on remuneration or other income in connection with services carried out or provided in Malaysia, in accordance with the Income Tax Act 1967 [Act 53] and any relevant Public Rulings existing and effective as at the date of the Performance. 4. APPLICATION 4.1 All performances by FAs in Malaysia are under the supervision of PUSPAL and subject to the Guidelines except, (a) All performances by FAs in Sabah and Sarawak; (b) FAs and/or Foreign Crew (FC) under the category of Commercial Officer whose contract with their employer exceeds 180 days continuously, without an application for extension in the relevant period; (c) Performances by FAs declared by the Ministry of Tourism, Arts and Culture (MOTAC) as being part of a Cultural Exchange Program; and (d) Performances by FAs declared by the Ministry of Foreign Affairs (KLN) or MOTAC as being part of a Cultural Cooperation Program between Malaysia and any foreign State. 4.2 Notwithstanding Item 4.1, all performances by FAs excluded from the supervision of PUSPAL and the application of these Guidelines are subject to taxation laws, immigrations laws and other relevant laws in force. 4.3 Any party interested in the Cultural Exchange Program or Cultural Cooperation Program mentioned in Items 4.1(c) and 4.1(d) respectively should refer to the International Relations Division (Culture), MOTAC for further information. 13 GPP 6.0 PART 2: COMMITTEE FOR APPLICATION FOR FOREIGN FILMING AND PERFORMANCE BY FOREIGN ARTISTE (JK-PUSPAL) 5. FUNCTION The function of JK-PUSPAL is to consider and make decisions on applications for foreign filming and performances by FAs. 6. COMPOSITION JK-PUSPAL shall comprise of the following members: Chairman : Secretary General of the Ministry of Communications Acting Chairman : Any Deputy Officer of the Ministry of Communications as assigned by the Chairman Permanent Members : With reference to the respective functions as prescribed in Appendix B Ministry of Tourism, Arts & Culture (MOTAC) 1. Undersecretary of Policy Division (Culture) or representative Royal Malaysian Police (PDRM) 2. Director of Special Branch or representative 3. Chief Public Relations Officer or representative 4. Designated Officer in-charge Police District or representative Department of Immigration of Malaysia (JIM) 5. Director General or representative 15 Inland Revenue Board Malaysia (LHDNM) 6. Director of Foreign Taxpayer Branch or representative Royal Malaysian Customs Department (KASTAM) 7. Director General or representative Ministry of Foreign Affairs (KLN) 8. Secretary General or representative Ministry of Home Affairs (KDN) 9. Undersecretary of Enforcement and Control Division or representative National Film Development Corporation Malaysia (FINAS) 10. Chief Executive Officer or representative Department of Islamic Development of Malaysia (JAKIM) 11. Director General or representative Kuala Lumpur City Hall (DBKL) 12. Executive Director of Socio-Economic Development or representative National Department for Culture and Arts (JKKN) 13. Director General or representative Associate Members (ex- : A representative from any Government or officio) private agency, as prescribed in Appendix B. Secretariat : PUSPAL Unit 16 7. QUORUM The minimum number of permanent members required to convene a JK- PUSPAL meeting is seven (7). LHDNM, JIM and PDRM are required to attend each meeting. 8. DECISION ON APPLICATION 8.1 Any decision made by JK-PUSPAL on any application shall be the decision of the majority of the members present at the meeting. 8.2 Any decision made by JK-PUSPAL on any application shall be made known to the Applicant in writing, or through telephone, or through the PUSPAL’s portal. 8.3 Any Applicant who is not satisfied with the decision made by JK-PUSPAL may make a representation for consideration. The decision from an appeal is considered as final result. 8.4 When an appeal is approved, the Applicant may be charged with additional guarantee on top of existing one that has to be paid to the Local Authority for an amount that will be decided by JK-PUSPAL, based on the risks and capacity size of the performance. 8.5 Any party affected by any decision made by JK-PUSPAL is not entitled to claim any damages or compensation or take any legal action against the Government. 9. MANAGEMENT For the purpose of carrying out management and responsibilities under these Guidelines, JK-PUSPAL shall be operated/facilitated by PUSPAL Unit under the purview of the Ministry. 17 GPP 6.0 PART 3: APPLICATIONS 10. REGISTRATION WITH PUSPAL 10.1 Any individual/organisation that intends to submit an application for the first time must be registered with PUSPAL. 10.2 The following documents are required for registration: (a) Application Letter for Registration; and (b) Certified Business Registration Slip (CTC MYDATA SSM) or a duly certified copy thereof. 10.3 Any first-time applicant will also be interviewed and assessed by JK- PUSPAL. 11. QUALIFICATION OF APPLICANT 11.1 Only Organisers that have been registered with PUSPAL are entitled to submit an application. 11.2 Any representative acting on behalf of an Organiser shall include a Letter of Authorisation at the time of submission. 11.3 An Organiser and/or its representative is required to have an income tax number that has been registered with LHDNM. 12. CATEGORY OF PERFORMANCE BY FA IN MALAYSIA & TEMPORARY WORK PERIOD (TWP). An application for performance by FA in Malaysia may refer to any of the following categories: No. Category Explanation Maximum (TWP) 1. Entertainment Any performance by a FA at any 90 days Premises entertainment premise or three (3) Performance star hotel and above, which possesses an entertainment licence and contract with specific period. 2. Concert Music performance by singers or 90 days musicians in front of a large audience, and may involve the sale of tickets with pricing that varies based on seating categories. 19 No. Category Explanation Maximum (TWP) 3. Singing/Music Music performance by singers or 90 days musicians in front of an audience, at a scale smaller than concerts. 4. Theatre/Opera/ (i) Any visual performance that 90 days Magic Show/ involves elements of drama, Orchestra music, singing and alike; or (ii) Any performance intended to assist local opera artistes or existing opera bodies in the country; or (iii) Any magic show performance in front of an audience; or (iv) Any orchestra performance intended to assist local orchestra artistes. 5. Dance/ (i) Any performance consisting of 90 days Acrobatics/ whole-body movements, Circus/Self- synchronised to the rhythm of Defence music be it in traditional, modern or contemporary form; or (ii) Any performance that involves bodily movements requiring agility, skill and flexibility; or (iii) Any performance by a group of entertainers consisting of various skills such as acrobatics, clowns and alike; or (iv) Any showcase of self- defence/martial arts in front of an audience. 6. Promotion Any promotional program for a 90 days specified cause or item such as animated characters, artistes, albums, songs, concerts, films, drawings, books, products and alike. 7. Contract Artiste Where an FA enters into a contract 365 days with an Organiser for a duration that exceeds 90 days for various performances (such as album recordings, promotional activities, television station appearances etc.) during a TWP, and the average payment rate is not less than RM 20 No. Category Explanation Maximum (TWP) 3,000 per month. FAs under this category refers to those affiliated with television stations and recording companies. 8. Master of Includes individuals or a group of 90 days Ceremony/Host individuals who are directly involved in any events and manage the stage such as hosts, speakers, moderators, reviewers, comedians and educators. 9. Music Festival An event featuring musical 90 days performances by various singers or musicians which may take place on multiple stages within a designated premise and may span across several days. 10. Others Includes individuals or a group of 90 days individuals who are directly involved in any events, perform on stage and other performers apart from those stated in the above-mentioned categories. 13. PRE-APPLICATION 13.1 Applicants falling under the category of Concert, Music Festival, Entertainment Premise Performance (DJ) and Master of Ceremony/Host are required to submit a Pre-Application in the manner prescribed in Appendix C, for the purpose of reviewing the initial status and concept of the FAs performance before any official application such performance can be submitted to PUSPAL. 13.2 Any decision on the Pre-Application shall not be considered as a final decision for any performance by FA in Malaysia. However, any advertising, promotion and ticket sales for any performance by FA in Malaysia shall obtain the pre-approval. 13.3 The Applicant shall be notified regarding the decision on the Pre- Application within 14 days from the date the Pre-Application was received. 21 14. APPLICATIONS FOR PERFORMANCE BY FOREIGN ARTISTES (FAs) IN MALAYSIA 14.1 NEW APPLICATION (a) Subject to Item 13 of these Guidelines, any Applicant who intends to submit an application for performance by FA in any category is required to submit a complete application within the period as mentioned in Appendix D. Applications submitted later than the specified period will not be considered for processing. (b) A complete application must be submitted within the above- mentioned period(s) for the purpose of: (i) Ensuring smooth coordination for the process of obtaining visas with references (VDR) from the relevant office or Malaysian embassies or high commissions in the foreign country of any FA and/or FC that requires a visa to enter Malaysia. (ii) Addressing any issues (such as incomplete applications) are resolved before the start of the performance period. (iii) Facilitating the application process for any permits or approvals that may be required from local authorities and other relevant Government Agencies before the start of the performance period. (c) For the purposes of such application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix D. (d) The application procedure is illustrated in Appendix E. 14.2 ADDITIONAL APPLICATION (a) Any Applicant who intends to submit a subsequent application for the same category of performance must submit an Additional Application no later than 14 days before the start date of the TWP prescribed in Item 12 of these Guidelines. (b) For the purposes of such Additional Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix F. 22 14.3 SPECIAL CONDITIONS FOR APPROVAL (a) JK-PUSPAL may require a preliminary viewing or hearing of any live or recorded performance by FA before granting approval for any application. JK-PUSPAL may grant a Maximum Approval Value based on reasonable consideration and determination of the number of FAs required in any particular performance, for all categories of performance. (b) Notwithstanding the above, an Applicant is also required to abide by special conditions (if any) in respect of the relevant category of performance by FA as prescribed in Appendix G. 15. WITHDRAWAL OF APPLICATION 15.1 Any Applicant who wishes to withdraw their application whether or not approval has been granted by JK-PUSPAL, is required to submit a letter requesting withdrawal along with any justification and supporting documents. 15.2 Submission must be made by writing and online to PUSPAL Unit as soon as possible. 15.3 The Organiser shall make a clear statement/announcement of any cancellation of a performance via any platform accessible by the public. 15.4 Any loss is at the sole risk and responsibility of the Organiser. 16. APPROVAL & DISMISSAL OF APPLICATION 16.1 Per Item 8, any decision made by JK-PUSPAL shall be communicated to the Applicant within 14 days from the date of receipt of any application, except for problematic or incomplete applications that may be rectified by the Applicant. 16.2 An application may be dismissed by JK-PUSPAL due to the following reasons: (a) The contents of the application are incomplete or inaccurate, and the Applicant has failed to rectify the application; and/or (b) The Organiser and/or representative has been blacklisted by JK-PUSPAL; and/or (c) Background checks on the performance reveal that the FA has negatively touched on national policies, religious issues, ethnic issues, cultural sensitivities and/or any other matter that prejudices public interest; and/or 23 (d) Background checks on the performance reveal that the FA has violated the Code of Ethics as stated in Part 6 of these Guidelines, and there is suggestion that the FA would not be willing to comply if the application was approved; and/or (e) There are written directives from any Local Authority or Government Agency opposing the application; and/or (f) Any other reason deemed reasonable at the discretion of JK- PUSPAL. 17. ANCILLARY APPLICATIONS 17.1 APPLICATION FOR EXTENSION OF TEMPORARY WORK PERIOD (TWP) (a) An application for extension of TWP for FAs and/or FC shall only be considered where; (i) The FA is from an ASEAN country; and (ii) No warning or negative reports has been made by any party regarding the FA, their performance or the Organiser during any previous performance. (b) The maximum period of extension of TWP that may be granted is 90 days for all categories of performance by FAs except the category of Contract Artiste, where no extension will be granted. (c) Any application for extension of TWP must be submitted no later than 14 days before the date such work period is scheduled to expire. (d) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix H. 17.2 APPLICATION FOR SHORTENING OF TEMPORARY WORK PERIOD (TWP) (a) An application for shortening of TWP for FAs and/or FC must be submitted to PUSPAL Unit. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix I. 24 17.3 APPLICATION FOR CHANGE OF DATE OR POSTPONEMENT OF PERFORMANCE (a) Subject to the Regulations of the relevant Government Agencies, an application for change of date or postponement of performance shall only be considered where the proposed date does not exceed 30 days from the original date of performance by FA. (b) An application for change of date or postponement of performance must be submitted no later than seven (7) days after the start date of performance by FA. (c) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix J. (d) Where the proposed date exceeds 30 days from the original date of performance by FA, approval for such performance will be revoked and the Organiser shall be required to resubmit their application for performance as a fresh application. 17.4 APPLICATION FOR CHANGE OF FOREIGN ARTISTE (FA) AND/OR FOREIGN CREW (FC) (a) Any Applicant who, after having received approval from JK-PUSPAL and with specific reasons, intends to (i) Change any FA and/or FC from such persons originally applied for; (ii) Substitute any FA and/or FC whose TWPs have been shortened; or (iii) Replace any FA and/or FC who have failed to enter Malaysia - must submit an Application no later than 14 working days before the start date of the TWP as prescribed in Item 12 of these Guidelines. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix K. (c) Where an application falls under the category of Entertainment Premise Performance, an application for change of FA and/or FC are limited to two (2) times only. 25 17.5 APPLICATION FOR TRANSFER OF FOREIGN ARTISTE (FA) AND/OR FOREIGN CREW (FC) FROM EXISTING ORGANISER TO NEW ORGANISER (a) An application to transfer any FA and/or FC still under contract to perform with an existing Organiser is not permitted unless the PLIK issued for the FA and/or FC under the existing Organiser has expired or been terminated prematurely. (b) Any application for performance by FA in Malaysia by the new Organiser must be submitted as a fresh application to JK-PUSPAL. (c) Notwithstanding Items 17.5(a) and 17.5(b), any application to any FA and/or FC from one Organiser to another after the expiry of TWP must also be submitted as a fresh application to JK-PUSPAL. (d) If such application is supported, the FA and/or FC must exit and re- enter Malaysia without having to observe any cooling-off period. (e) The new Organiser will also be responsible for obtaining a new PLIK for the FA and/or FC from JIM. 26

    10. REGISTRATION WITH PUSPAL 10.1 Any individual/ organisation that intends to submit an application for the first time must be registered with PUSPAL. 10.2 The following documents are required for registration: (a) Application Letter for Registration; (b) A copy of the film production license issued by FINAS for the LFPC; and (c) Certified Business Registration Slip (CTC MYDATA SSM) or a duly certified copy thereof. 10.3 Any first-time applicant will also be interviewed and assessed by JK- PUSPAL. 11. QUALIFICATIONS OF APPLICANT 11.1 Only LFPCs are eligible to be an Applicant. 11.2 Any Production’s Representative acting on behalf of an LFPC shall include a Letter of Authorisation in the application submission. 11.3 The LFPC and/or its representative must have an income tax number that has been registered with LHDNM. 11.4 The Foreign Filming Application Flowchart is illustrated in Appendix B. 12. CATEGORY OF FILM PRODUCTION AND TEMPORARY WORK PERIOD (TWP) 12.1 An application for foreign film production in Malaysia may refer to any of the following categories: No. Category Explanation 1. Advertisements Shooting a short film to promote a product, service or information for the purpose of informing the public. 2. Documentary Non-fiction film production that displays information or facts about a certain subject. 3. Feature A story or event recorded as a moving image (Movie/Drama) and shown in cinemas or on television. 17 No. Category Explanation 4. TV Programmes Television shows either recorded or live. 5. Others Filming other than Commercials, Documentaries, Feature Films and TV Programmes. 12.2 The TWP for FAs and/or FCs is based on the requirements of the foreign film production and shall not exceed 180 days. 12.3 However, LFPCs are allowed to submit applications to extend the TWP beyond 180 days based on the requirements of the foreign film production. 12.4 If the approved TWP exceeds 180 days, an Interim PLIK approval will be granted by JIM. 12.5 JK-PUSPAL may set a reasonable TWP at its own discretion, subject to JK-PUSPAL's considerations and relevant Government Agency regulations.

PROCEDURE (a) Pursuant to Item 18 of these Guidelines, an Applicant is required to obtain a valid Professional Visit Pass (PLIK) for each FA and/or FC that intends to enter Malaysia. (b) For the purposes of such application, an Applicant is required to furnish the following documents: No. Document Remarks 1. Passport of each FA and/or FC Passport must be valid for at least six (6) months and contain three (3) empty pages at the time of application. 2. Bank Guarantee Information on Rate of Bank Guarantee available on PUSPAL’s portal. 2. PAYMENT OF FEE (a) The amount to be paid by the Organiser for issuance of PLIK shall be determined based on the rate stated in Schedule Three of the Immigration Rules 1963. (b) Any PLIK issued for any FA and/or FC may be exempted from payment of fee if: (i) The status of the performance is recognised under Cultural Exchange Program; or (ii) Entry is pursuant to Government invitation. 68 APPENDIX M

  • 13. SCRIPT REVIEW APPLICATION
    13. SCRIPT REVIEW APPLICATION 13.1 LFPCs that wish to apply for a foreign filming under the Feature (Film/Drama) category are required to submit a Script Review Application. 13.2 For the purposes of the Script Review Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix C. 13.3 Additional conditions that may cause the review application to be rejected can also be found in Appendix C. 13.4 The result of the Script Review Application will allow the Applicant to submit a Foreign Filming Application. 13.5 The result of the Script Review Application will be notified to the Applicant within 14 days from the date of acknowledgement of receipt of the Script Review Application. 14. APPLICATIONS FOR FOREIGN FILMING IN MALAYSIA 14.1 NEW APPLICATION (a) This process is for first-time applications for a foreign film title. 18 (b) A complete application must be submitted no later than 30 days before the starting date of TWP prescribed in Item 12 of these Guidelines. (c) For the purposes of such New Application, the Applicant is required to submit all documents in the manner and as prescribed in Appendix D. 14.2 ADDITIONAL APPLICATION (a) Any Applicant who intends to submit a subsequent application for the same category of foreign filming must submit an Additional Application no later than 14 working days before the start date of the TWP prescribed in Item 12 of these Guidelines. (b) For the purposes of such Additional Application, the Applicant is required to submit all documents in the manner and as prescribed in Appendix E. 14.3 SPECIAL CONDITIONS FOR APPROVAL (a) Letter of Undertaking LFPCs shall ensure that FFPCs sign a Letter of Undertaking and ensure that the FFPCs, including FAs and/or FCs, will comply with the PUSPAL requirements, provisions of prevailing laws, regulations, and codes of ethics throughout the filming process. (b) Involvement of LC in Foreign Filming LFPCs shall ensure that at least 30% of the filming crew consists of local crew members registered with any local film association. However, the ratio of local crew involvement in a foreign film production may be reasonably determined at the discretion of JK- PUSPAL. (c) Import and Export of Filming Equipment and Goods Goods imported into and exported out of the country by FAs and/or FCs are subject to declaration and approval from KASTAM. (d) Requirement of PDRM in Foreign Filming: (i) LFPCs shall liaise with the PDRM when involving assistance and services required, whether involving the role of the PDRM in the film, traffic control, use of firearms by specifying the location address, date, and time of filming, as well as the type of assistance required, within 30 days before the filming date; 19 (ii) The services of officers and members of the PDRM will be subject to government service charges, and the LFPC is responsible for ensuring that insurance coverage is provided to the officers and members involved; and (iii) The LFPC will be liable to pay compensation at the rate determined by the PDRM if it has caused any damage to the use of PDRM premises and assets. (e) Other special conditions: (i) film shooting shall be modified or postponed if the location, date, or time of shooting is deemed inappropriate after considering aspects of safety, public tranquility, local sensitivities, or other matters related to relevant Government Agency regulations; (ii) LFPCs shall ensure that no filming activities or use of images of prohibited areas, as stipulated in the Protected Areas and Protected Places Act 1959 [Act 298], occur without the approval of the responsible authority; (iii) LFPCs shall ensure that film shooting activities do not involve actions resulting in environmental damage and pollution, as well as damage to public property; (iv) film shooting is encouraged to take place in attractive tourist locations, showcasing the cultural uniqueness, artistic heritage of the country, and local products; (v) recognition that the film or specific scenes therein are made in Malaysia shall be stated either at the beginning or end of the film unless directed otherwise, subject to the discretion of JK- PUSPAL; (vi) LFPCs need to get approval from Security Division, KDN if the filming involved explosive materials; (vii) LFPCs need to ensure that the filming is performed according to the script that has been approved according to the JK- PUSPAL requirements; and (viii) LFPCs must submit the final product of the foreign film to PUSPAL Unit using any suitable format before the official screening for that film. 20
  • APPENDIX G: SPECIAL CONDITIONS FOR APPROVAL
    APPENDIX G: SPECIAL CONDITIONS FOR APPROVAL 1. Pursuant to Item 14.3(b), an Applicant is also required to abide by special conditions prescribed for the categories of performance listed in this Appendix. 2. Performances under the Category of Entertainment Premise Performance. (a) Performance by FA in Hotel is only allowed to be carried out in hotels with a minimum of three (3) star rating. (b) Performance by FA in Entertainment Premise is only allowed to be carried out in premises with valid premise and entertainment licences. (c) Inclusion of performance by LA is encouraged. However, exceptions may be granted as deemed reasonable at the discretion of JK-PUSPAL. (d) Changes of performance space must be notified to PUSPAL. (e) In regards to performance space, Organisers must adhere to the following guide: Performances by FA and LA should be Single Performance Space scheduled alternately or combined together. One performance space must be filled by the Two Performance Spaces LA, while the other space may be filled by the FA. One performance space must be filled by the > Two Performance Spaces LA, while the other space(s) may be filled by the LA and/or FA as deemed appropriate. 3. Performances under the Category of Concert, Music Festival and Singing/Music. (a) Organisers are encouraged to involve LA in any performance by FA. (b) At least 30% of technical workers involved in any performance by FA must consist of LC. However, the ratio of LC involvement may be determined as deemed reasonable at the discretion of JK-PUSPAL. (c) Duration of Large Capacity Performances cannot exceed two (2) consecutive days and is subject to the approval of the relevant Local Authority. (d) Large Capacity Performances are encouraged to be held indoors to facilitate security control and avoid public disturbances. However, application for conducting the performance at an open space that is far from residential and supported by sufficient security measures can be considered, including any additional conditions that may be imposed by JK-PUSPAL. (e) Organisers must submit a security procedure plan when submitting an application to JK-PUSPAL, and will be called upon to provide explanation if necessary. An Organiser is not allowed to be represented by a representative for this matter. 61 APPENDIX G (f) Organisers must also submit the security procedure plan to PDRM for their confirmation on the following: (i) organisers must appoint trained security and medical personnel in a ratio reasonable to the expected number of attendees as per paragraph 3(j); (ii) organisers must liaise with PDRM to obtain any permits for holding performances, on matters related to traffic control, or on any matter requiring assistance and services of the police; (iii) organisers must ensure security checks, including body and bag inspections, are conducted by trained security personnel at all entry points; and (iv) organisers must ensure that the performance venue is equipped with functioning CCTVs. (g) Organisers must ensure that the performance venue has adequate parking facilities and does not disrupt public traffic flow. Organisers are encouraged to choose performance venues with access to public transportation facilities. (h) Organisers must take any necessary steps before, during and after the performance to ensure that there are no activities related to smoking, alcohol and/or drugs being carried out at the performance venue. (i) The number of attendees, taking into account the venue’s capacity, must be proposed to JK-PUSPAL. The number of attendees must not exceed 10,000 persons aged eighteen (18) or above. JK-PUSPAL may require the Organiser to submit information on ticket sales for any performance when deemed reasonably necessary. (j) Organisers are advised to appoint a reasonable number of trained security personnel, paramedics/medical personnel and ambulances, or according to the guide as follow: (i) appoint trained security personnel at a ratio of one (1) security personnel for every 50 attendees, i.e., at a ratio of (1:50); (ii) appoint trained paramedics and medical personnel at a ratio of one (1) paramedic/medical personnel for every 250 attendees, i.e., at a ratio of (1:250); and (iii) provide ambulance facilities at a ratio of one (1) ambulance for every 1,000 attendees, i.e., at a ratio of (1:1000). A designated area for medical assistance must be provided at the venue. (k) Organisers must involve relevant Government Agencies such as the relevant Local Authority, National Anti-Drugs Agency (AADK), Malaysia Volunteers Corps Department (RELA) and the Malaysia Civil Defence Force (APM) to ensure smooth and secure performances without compromising public peace. Each Agency involved must be given a designated space at the performance venue to carry out their duties. 62 APPENDIX G (l) Organisers must ensure that drinking water is available throughout the performance, and placed in areas easily visible and accessible to attendees. (m) Organisers must comply with all fire safety regulations set by the Fire and Rescue Department of Malaysia. 4. Performances under the Category of Promotion. (a) Upon lapse of TWP, an Organiser may submit a new application 90 days after the end of TWP of the FA. However, applications submitted less than 90 of such period may only be considered if there are reasonable grounds as determined by JK- PUSPAL. 5. Performances under the Category of Contract Artiste. (a) Organisers must arrange for opening of an Income Tax File for the FA within the 90 days of the TWP if the FA does not yet have a Malaysian Income Tax File number. (b) In addition to the application submitted to JK-PUSPAL, Organisers must submit the schedule of performances by the FA for the first 90 days of the TWP. The schedule of performances may be submitted to PUSPAL via email, and can be submitted in stages at least seven (7) days before the performance date. 63 APPENDIX H

The applicant supplies its letter and corporate documents, colour photographs and passport details for each crew member, stamped contracts/security bond, CP600FA and IMM12. Filming requires the foreign-company background, filming timetable/locations and, for feature productions, prior script-review approval. Pass issuance requires at least six months' passport validity, three empty pages and a bank guarantee.

SCRIPT REVIEW APPLICATION 13.1 LFPCs that wish to apply for a foreign filming under the Feature (Film/Drama) category are required to submit a Script Review Application. 13.2 For the purposes of the Script Review Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix C. 13.3 Additional conditions that may cause the review application to be rejected can also be found in Appendix C. 13.4 The result of the Script Review Application will allow the Applicant to submit a Foreign Filming Application. 13.5 The result of the Script Review Application will be notified to the Applicant within 14 days from the date of acknowledgement of receipt of the Script Review Application. 14. APPLICATIONS FOR FOREIGN FILMING IN MALAYSIA 14.1 NEW APPLICATION (a) This process is for first-time applications for a foreign film title. 18 (b) A complete application must be submitted no later than 30 days before the starting date of TWP prescribed in Item 12 of these Guidelines. (c) For the purposes of such New Application, the Applicant is required to submit all documents in the manner and as prescribed in Appendix D. 14.2 ADDITIONAL APPLICATION (a) Any Applicant who intends to submit a subsequent application for the same category of foreign filming must submit an Additional Application no later than 14 working days before the start date of the TWP prescribed in Item 12 of these Guidelines. (b) For the purposes of such Additional Application, the Applicant is required to submit all documents in the manner and as prescribed in Appendix E. 14.3 SPECIAL CONDITIONS FOR APPROVAL (a) Letter of Undertaking LFPCs shall ensure that FFPCs sign a Letter of Undertaking and ensure that the FFPCs, including FAs and/or FCs, will comply with the PUSPAL requirements, provisions of prevailing laws, regulations, and codes of ethics throughout the filming process. (b) Involvement of LC in Foreign Filming LFPCs shall ensure that at least 30% of the filming crew consists of local crew members registered with any local film association. However, the ratio of local crew involvement in a foreign film production may be reasonably determined at the discretion of JK- PUSPAL. (c) Import and Export of Filming Equipment and Goods Goods imported into and exported out of the country by FAs and/or FCs are subject to declaration and approval from KASTAM. (d) Requirement of PDRM in Foreign Filming: (i) LFPCs shall liaise with the PDRM when involving assistance and services required, whether involving the role of the PDRM in the film, traffic control, use of firearms by specifying the location address, date, and time of filming, as well as the type of assistance required, within 30 days before the filming date; 19 (ii) The services of officers and members of the PDRM will be subject to government service charges, and the LFPC is responsible for ensuring that insurance coverage is provided to the officers and members involved; and (iii) The LFPC will be liable to pay compensation at the rate determined by the PDRM if it has caused any damage to the use of PDRM premises and assets. (e) Other special conditions: (i) film shooting shall be modified or postponed if the location, date, or time of shooting is deemed inappropriate after considering aspects of safety, public tranquility, local sensitivities, or other matters related to relevant Government Agency regulations; (ii) LFPCs shall ensure that no filming activities or use of images of prohibited areas, as stipulated in the Protected Areas and Protected Places Act 1959 [Act 298], occur without the approval of the responsible authority; (iii) LFPCs shall ensure that film shooting activities do not involve actions resulting in environmental damage and pollution, as well as damage to public property; (iv) film shooting is encouraged to take place in attractive tourist locations, showcasing the cultural uniqueness, artistic heritage of the country, and local products; (v) recognition that the film or specific scenes therein are made in Malaysia shall be stated either at the beginning or end of the film unless directed otherwise, subject to the discretion of JK- PUSPAL; (vi) LFPCs need to get approval from Security Division, KDN if the filming involved explosive materials; (vii) LFPCs need to ensure that the filming is performed according to the script that has been approved according to the JK- PUSPAL requirements; and (viii) LFPCs must submit the final product of the foreign film to PUSPAL Unit using any suitable format before the official screening for that film. 20

The 2025 PUSPAL guides distinguish 10% crew withholding from 30% income tax for crew under a Malaysian employment contract, and direct the applicant to LHDN for the appropriate treatment and payment before work. How long can they stay, can they change host/activity, can family accompany, and can the status be extended?

The filming temporary work period normally cannot exceed 180 days, but justified extensions may be considered; approved periods exceeding 180 days use an interim pass. Extension requests require reasonable filming interruption, no negative reports and submission at least 14 working days before expiry. Performance crew follow their approved performance period and specific extension conditions, not an automatic filming allowance. Changing organiser or production company requires a fresh application, termination/expiry of the prior pass, exit/re-entry and new immigration permission. No automatic permanent-residence or general dependant entitlement is established.

    PHOTOGRAPHY AND PERFORMANCE OF OVERSEAS ARTISTS PUSPAL 1.0 INTRODUCTION 1.1 All applications for filming by Foreign Film Production Companies and performances by Foreign Artistes must go through a one-stop application center managed by the responsible Ministry. 2.0 ELIGIBLE APPLICANT CATEGORIES 2.1 Foreign Artistes An individual or a group of individuals who are not Malaysian citizens and not permanent residents of Malaysia, who are filmed in a movie or hold a performance. 2.2 Foreign Crew An individual or a group of individuals who are not Malaysian citizens and not permanent residents of Malaysia, who are involved in a movie filming or a performance in Malaysia. This includes directors, camera operators, technical staff, makeup artists, crew, officers, and personnel, as well as any other positions required for a foreign performance and film production. 3.0 APPLICATION REQUIREMENTS 3.1 Applicants must be outside of Malaysia when submitting the application. 3.2 Applicants are only allowed to enter Malaysia after obtaining approval for their Professional Visit Pass (PLIK) and Visa with Reference (VDR). 3.3 You can refer to the PUSPAL Guidelines (GPP) for more information regarding the application for Foreign Film Production and Foreign Artiste Performances.     10. REGISTRATION WITH PUSPAL 10.1 Any individual/ organisation that intends to submit an application for the first time must be registered with PUSPAL. 10.2 The following documents are required for registration: (a) Application Letter for Registration; (b) A copy of the film production license issued by FINAS for the LFPC; and (c) Certified Business Registration Slip (CTC MYDATA SSM) or a duly certified copy thereof. 10.3 Any first-time applicant will also be interviewed and assessed by JK- PUSPAL. 11. QUALIFICATIONS OF APPLICANT 11.1 Only LFPCs are eligible to be an Applicant. 11.2 Any Production’s Representative acting on behalf of an LFPC shall include a Letter of Authorisation in the application submission. 11.3 The LFPC and/or its representative must have an income tax number that has been registered with LHDNM. 11.4 The Foreign Filming Application Flowchart is illustrated in Appendix B. 12. CATEGORY OF FILM PRODUCTION AND TEMPORARY WORK PERIOD (TWP) 12.1 An application for foreign film production in Malaysia may refer to any of the following categories: No. Category Explanation 1. Advertisements Shooting a short film to promote a product, service or information for the purpose of informing the public. 2. Documentary Non-fiction film production that displays information or facts about a certain subject. 3. Feature A story or event recorded as a moving image (Movie/Drama) and shown in cinemas or on television. 17 No. Category Explanation 4. TV Programmes Television shows either recorded or live. 5. Others Filming other than Commercials, Documentaries, Feature Films and TV Programmes. 12.2 The TWP for FAs and/or FCs is based on the requirements of the foreign film production and shall not exceed 180 days. 12.3 However, LFPCs are allowed to submit applications to extend the TWP beyond 180 days based on the requirements of the foreign film production. 12.4 If the approved TWP exceeds 180 days, an Interim PLIK approval will be granted by JIM. 12.5 JK-PUSPAL may set a reasonable TWP at its own discretion, subject to JK-PUSPAL's considerations and relevant Government Agency regulations.

    17. ANCILLIARY APPLICATIONS 17.1 APPLICATION FOR EXTENSION OF TEMPORARY WORK PERIOD (TWP) (a) The Applicant may apply to extend the TWP for FA and/or FC currently engaged in film shooting in Malaysia. 21 (b) Subject to the maximum allowable TWP, any extension application must be submitted no later than 14 working days before the expiry date of the TWP prescribed in Item 12 of these Guidelines. (c) Applications to extend the TWP will be considered if: (i) filming activities were interrupted for reasonable reasons; and (ii) no remarks or negative reports were received from any party regarding the film production. (d) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix F. 17.2 APPLICATION FOR SHORTENING OF TEMPORARY WORK PERIOD (TWP) (a) An application for shortening of TWP for FAs and/or FC must be submitted to PUSPAL Unit. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix G. 17.3 APPLICATION FOR CHANGE OF DATE OR POSTPONEMENT OF FILMING (a) Subject to the Regulations of the relevant Government Agencies, an application for change of date or postponement of performance shall only be considered where the proposed date does not exceed 30 days from start date of the shooting of the foreign film. (b) An application for change of date or postponement of filming must be submitted no later than seven (7) days after the starting date of filming. (c) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix H. (d) Where the proposed date exceeds 30 days from the original date of performance by FA, approval for such performance will be revoked and the LFPC shall be required to resubmit their application for performance as a fresh application. 22 17.4 APPLICATION FOR CHANGE OF FOREIGN ARTISTE (FA) AND/OR FOREIGN CREW (FC) (a) Any Applicant who, after having received approval from JK- PUSPAL and with specific reasons, intends to: (i) change any FA and/or FC from such persons originally applied for; (ii) substitute any FA and/or FC whose TWPs have been shortened; or (iii) replace any FA and/or FC who have failed to enter Malaysia must submit an Application no later than 14 working days before the start date of the TWP as prescribed in Item 12 of these Guidelines. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix I. 17.5 APPLICATION FOR TRANSFER OF FOREIGN ARTIST (FA) AND/OR FOREIGN CREW (FC) FROM EXISTING LOCAL FILM PRODUCTION COMPANY (LFPC) TO NEW LOCAL FILM PRODUCTION COMPANY (LFPC) (a) An application to transfer any FA and/or FC still under contract to perform with an existing LFPC is not permitted unless the PLIK issued for the FA and/or FC under the existing LFPC has expired or been terminated prematurely. (b) Any application for performance by FA in Malaysia by the new LFPC must be submitted as a new application to JK-PUSPAL. (c) Notwithstanding Items 17.5(a) and 17.5(b), any application to any FA and/or FC from one LFPC to another after the expiry of TWP must also be submitted as a fresh application to JK-PUSPAL. (d) If such application is supported, the FA and/or FC must exit and re- enter Malaysia without having to observe any cooling-off period. OBJECTIVE These Guidelines are intended to clarify the following matters: 1.1 Government policy regarding the application process for performances by Foreign Artistes (FAs); 1.2 The determination of detailed procedures related to the application process and approval for performances by FAs in Malaysia; 1.3 The determination of comprehensive procedures for incident management on the performance day. 2. BACKGROUND 2.1 Based on a Cabinet decision in 2001, all applications involving filming by Foreign Film Production Companies (FFPCs) and performances by FAs shall go through a one-stop process managed by the appointed Ministry. 2.2 These Guidelines are applicable to performances by FAs in Malaysia. For filming by FFPCs in Malaysia, please refer to PUSPAL Guidelines on Filming by FFPCs. 2.3 The Government, through the Ministry, has set up: (a) a one-stop agency to coordinate applications for filming by FFPCs and performances by FAs, known as the Unit for Application for Foreign Filming and Performance by Foreign Artiste (PUSPAL); and (b) a committee known as JK-PUSPAL, to consider applications for foreign filming and performances by FAs made through PUSPAL. 2.4 The PUSPAL Guidelines serve as a medium to clarify the application procedure and related regulations, whilst taking into account the relationship between PUSPAL and related Government Agencies in granting licences/permits/approvals for filming by FFPCs and performances by FAs in Malaysia. 2.5 The PUSPAL Guidelines were first published in 2005, and have been revised in 2007, 2010, 2015 and 2022. 3. INTERPRETATION For the purposes of these Guidelines, the following interpretations shall be applied to the meanings in reference to - 8 “Applicant” means any party qualified to make an application for the performance of FAs in Malaysia; “artistic” means works such as poetry, painting, music, and other compositions created with talent (competence), a product of creation and description of art, something related to art, beauty (refined); “Committee for Application for Foreign Filming and Performance by Foreign Artiste (JK-PUSPAL)” means a committee comprising of several Government Agencies responsible for considering applications for filming and performance by FAs; “cigarette” means any product consisting wholly or partially of tobacco, which is cut, shredded or manufactured, or of any tobacco derivative or substitute, rolled up in a single or more wrapper, or any electronic and non-electronic cigarette devices which can be immediately smoked; “closed premises” means any place upon which any construction or structure has been erected, any premise or building whether permanent or temporary, or any other place in which any form of entertainment is held and where the public is allowed entry, with or without payment; “culture” refers to the entire way of life (including the actions, behaviour and thinking) and the result of all activities and creations in material or spiritual form (tangible and intangible) of a society; “drugs” means any dangerous drugs or substances set out in the First Schedule of the Dangerous Drugs Act 1952 [Act 234]; “entertainment” means an artistic and cultural activity that is exhibited and performed to an audience, for the purpose of entertaining the public or any class of the public; “end of performance” means a mode of action to end a performance by turning off: (a) the lights on stage; (b) the audio system; or (c) both at the same time. “foreign artistes (FAs)” means any individual or group of individuals who are neither Malaysian citizens nor permanent residents of Malaysia, who carries out a performance; “foreign crew (FC)” means any individual or a group of individuals who are neither citizens nor permanent residents of Malaysia, involved in an artistic and cultural performance, including directors, camerapersons, make-up artists, crew, officials, staff and any other position required for any performance; 9 “gambling” means any game based on chance or skill and chance played as bets, either monetary or goods in lieu of money, and includes any such games stipulated by any law in force; “Government” means the Federal Government; “Government Agency” means the ministry, department or statutory body of the Federal Government or State Government or local authority; “incident” means any unplanned occasion that involves: (a) public safety; or (b) the contravention of the code of ethics stipulated in Part 6. “liquor” means intoxicating liquor as defined in by Section 2 of the Customs Act 1967 [Act 235]; “local artistes (LAs)” means any individual or group of individuals who are Malaysian citizens or permanent residents of Malaysia, who carries out a performance; “local authority” means (a) any local authority established or deemed to be established under the Local Government Act 1976 [Act 171]; (b) the Datuk Bandar Kuala Lumpur appointed in accordance with Section 3 of the Federal Capital Act 1960 [Act 190]; (c) the local authority established under the Federal Territory of Labuan (Amendment of Local Government Ordinance) Act 1993; (d) the local authority established under the Perbadanan Putrajaya Act 1995 [Act 536]; (e) any local authority in Sabah established or deemed to be established under the Local Government Ordinance 1961; (f) any local authority in Sarawak established or deemed to be established under the Local Authorities Ordinance 1996; or (g) includes any individual or group of individuals appointed or authorised under any written law to carry out and implement the power and function given to and imposed on any local authority under any written law; “local crew (LC)” means any individual or a group of individuals who are citizens or permanent residents of Malaysia, involved in an artistic and cultural performance in Malaysia, including directors, camerapersons, make-up artists, crew, officials, staff and any other position required for a performance; 10 “Maximum Approval Value” means the maximum number of FAs approved to carry out performances at a premise at any given time; “Minister and the Ministry” means the Minister and Ministry responsible for the entry of FAs and/or FCs; “nation” means Malaysia, unless otherwise stated; “open premises” means public venues or any open space allocated or designated for public use or opened to the public at any given time, with or without payment; “Organiser” refers to - (a) any company specialising in organising artistic and cultural performances involving FAs and/or FCs; (b) any management of any hotel or tourist accommodation premises or entertainment premises intending to hold performances by FAs at said hotel or premise; (c) any registered society or organisation intending to carry out performances by FAs; or (d) any individual officer or officers employed by such a company, management or registered society or organisation; “performance” means: (a) any artistic and cultural activity carried out in relation to the performing arts, whether in a closed or open premise and whether entrance fees are charged or not; (b) any artistic and cultural activity held in the following venues - (i) Hotels; (ii) Entertainment centres; (iii) Entertainment premises; (iv) Cultural centres; (v) Stadiums; (vi) TV stations (recording); or (vii) Other premises approved by JK-PUSPAL; (c) any artistic and cultural activity that involves - (i) Performance or concert in an open or closed premise; (ii) Promotion of FA’s album, songs or films; and (iii) Promotion of goods and products; 11 “performance capacity” means the maximum number of patrons attending the performance, which are further classified below: Capacity *Number of Patrons Attending “Small Capacity Performance” Less than or equal to 500 “Medium Capacity Performance” 501 to 5,000 “Large Capacity Performance” More than 5,000 *Based on expected number of tickets sold. The list of performance venue in Malaysia is in Appendix A. “performance period” means the number of hours or number of days in which a performance by an FA is held; “Professional Visit Pass (PLIK)” means any work permit issued by JIM to foreign nationals who intend to carry out specific work for a short, defined period of time in Malaysia; “PUSPAL Monitoring Team” means the group consisting of JK-PUSPAL members and/or PUSPAL Unit members that will assist in monitoring any Capacity Performance; “PUSPAL Officer(s)” means an identified representative from JK-PUSPAL that is responsible for leading the PUSPAL Monitoring Team at any Capacity Performance; “representation” means the process of fact preparation for the consideration of JK-PUSPAL, for the purposes of maintaining its decision or otherwise; “Responsible Organiser(s)” means an identified representative(s) from the Organiser that is responsible for the application and monitoring of any Capacity Performance; “Temporary Work Period” means the number of days calculated from the date the FA and/or FC enters Malaysia and carries out temporary work, until the date the FA and/or FC leaves Malaysia; “tobacco” means the Nicotiana tabacum plant species or any part of it, whether cured or not, including hybrids of the species, hybrids resulting from crossbreeding of the species or crossbreeding with other species or hybrids of the plant and genetically engineered versions of the species or hybrids; and 12 “withholding tax” means the tax levied on non-residents (individuals/bodies other than individuals) on remuneration or other income in connection with services carried out or provided in Malaysia, in accordance with the Income Tax Act 1967 [Act 53] and any relevant Public Rulings existing and effective as at the date of the Performance. 4. APPLICATION 4.1 All performances by FAs in Malaysia are under the supervision of PUSPAL and subject to the Guidelines except, (a) All performances by FAs in Sabah and Sarawak; (b) FAs and/or Foreign Crew (FC) under the category of Commercial Officer whose contract with their employer exceeds 180 days continuously, without an application for extension in the relevant period; (c) Performances by FAs declared by the Ministry of Tourism, Arts and Culture (MOTAC) as being part of a Cultural Exchange Program; and (d) Performances by FAs declared by the Ministry of Foreign Affairs (KLN) or MOTAC as being part of a Cultural Cooperation Program between Malaysia and any foreign State. 4.2 Notwithstanding Item 4.1, all performances by FAs excluded from the supervision of PUSPAL and the application of these Guidelines are subject to taxation laws, immigrations laws and other relevant laws in force. 4.3 Any party interested in the Cultural Exchange Program or Cultural Cooperation Program mentioned in Items 4.1(c) and 4.1(d) respectively should refer to the International Relations Division (Culture), MOTAC for further information. 13 GPP 6.0 PART 2: COMMITTEE FOR APPLICATION FOR FOREIGN FILMING AND PERFORMANCE BY FOREIGN ARTISTE (JK-PUSPAL) 5. FUNCTION The function of JK-PUSPAL is to consider and make decisions on applications for foreign filming and performances by FAs. 6. COMPOSITION JK-PUSPAL shall comprise of the following members: Chairman : Secretary General of the Ministry of Communications Acting Chairman : Any Deputy Officer of the Ministry of Communications as assigned by the Chairman Permanent Members : With reference to the respective functions as prescribed in Appendix B Ministry of Tourism, Arts & Culture (MOTAC) 1. QUORUM The minimum number of permanent members required to convene a JK- PUSPAL meeting is seven (7). LHDNM, JIM and PDRM are required to attend each meeting. 8. DECISION ON APPLICATION 8.1 Any decision made by JK-PUSPAL on any application shall be the decision of the majority of the members present at the meeting. 8.2 Any decision made by JK-PUSPAL on any application shall be made known to the Applicant in writing, or through telephone, or through the PUSPAL’s portal. 8.3 Any Applicant who is not satisfied with the decision made by JK-PUSPAL may make a representation for consideration. The decision from an appeal is considered as final result. 8.4 When an appeal is approved, the Applicant may be charged with additional guarantee on top of existing one that has to be paid to the Local Authority for an amount that will be decided by JK-PUSPAL, based on the risks and capacity size of the performance. 8.5 Any party affected by any decision made by JK-PUSPAL is not entitled to claim any damages or compensation or take any legal action against the Government. 9. MANAGEMENT For the purpose of carrying out management and responsibilities under these Guidelines, JK-PUSPAL shall be operated/facilitated by PUSPAL Unit under the purview of the Ministry. 17 GPP 6.0 PART 3: APPLICATIONS 10. QUALIFICATION OF APPLICANT 11.1 Only Organisers that have been registered with PUSPAL are entitled to submit an application. 11.2 Any representative acting on behalf of an Organiser shall include a Letter of Authorisation at the time of submission. 11.3 An Organiser and/or its representative is required to have an income tax number that has been registered with LHDNM. 12. CATEGORY OF PERFORMANCE BY FA IN MALAYSIA & TEMPORARY WORK PERIOD (TWP). An application for performance by FA in Malaysia may refer to any of the following categories: No. Category Explanation Maximum (TWP) 1. Entertainment Any performance by a FA at any 90 days Premises entertainment premise or three (3) Performance star hotel and above, which possesses an entertainment licence and contract with specific period. 2. Concert Music performance by singers or 90 days musicians in front of a large audience, and may involve the sale of tickets with pricing that varies based on seating categories. 19 No. Category Explanation Maximum (TWP) 3. Singing/Music Music performance by singers or 90 days musicians in front of an audience, at a scale smaller than concerts. 4. Theatre/Opera/ (i) Any visual performance that 90 days Magic Show/ involves elements of drama, Orchestra music, singing and alike; or (ii) Any performance intended to assist local opera artistes or existing opera bodies in the country; or (iii) Any magic show performance in front of an audience; or (iv) Any orchestra performance intended to assist local orchestra artistes. 5. Dance/ (i) Any performance consisting of 90 days Acrobatics/ whole-body movements, Circus/Self- synchronised to the rhythm of Defence music be it in traditional, modern or contemporary form; or (ii) Any performance that involves bodily movements requiring agility, skill and flexibility; or (iii) Any performance by a group of entertainers consisting of various skills such as acrobatics, clowns and alike; or (iv) Any showcase of self- defence/martial arts in front of an audience. 6. Promotion Any promotional program for a 90 days specified cause or item such as animated characters, artistes, albums, songs, concerts, films, drawings, books, products and alike. 7. Contract Artiste Where an FA enters into a contract 365 days with an Organiser for a duration that exceeds 90 days for various performances (such as album recordings, promotional activities, television station appearances etc.) during a TWP, and the average payment rate is not less than RM 20 No. Category Explanation Maximum (TWP) 3,000 per month. FAs under this category refers to those affiliated with television stations and recording companies. 8. Master of Includes individuals or a group of 90 days Ceremony/Host individuals who are directly involved in any events and manage the stage such as hosts, speakers, moderators, reviewers, comedians and educators. 9. Music Festival An event featuring musical 90 days performances by various singers or musicians which may take place on multiple stages within a designated premise and may span across several days. 10. Others Includes individuals or a group of 90 days individuals who are directly involved in any events, perform on stage and other performers apart from those stated in the above-mentioned categories. 13. PRE-APPLICATION 13.1 Applicants falling under the category of Concert, Music Festival, Entertainment Premise Performance (DJ) and Master of Ceremony/Host are required to submit a Pre-Application in the manner prescribed in Appendix C, for the purpose of reviewing the initial status and concept of the FAs performance before any official application such performance can be submitted to PUSPAL. 13.2 Any decision on the Pre-Application shall not be considered as a final decision for any performance by FA in Malaysia. However, any advertising, promotion and ticket sales for any performance by FA in Malaysia shall obtain the pre-approval. 13.3 The Applicant shall be notified regarding the decision on the Pre- Application within 14 days from the date the Pre-Application was received. 21 14. APPLICATIONS FOR PERFORMANCE BY FOREIGN ARTISTES (FAs) IN MALAYSIA 14.1 NEW APPLICATION (a) Subject to Item 13 of these Guidelines, any Applicant who intends to submit an application for performance by FA in any category is required to submit a complete application within the period as mentioned in Appendix D. Applications submitted later than the specified period will not be considered for processing. (b) A complete application must be submitted within the above- mentioned period(s) for the purpose of: (i) Ensuring smooth coordination for the process of obtaining visas with references (VDR) from the relevant office or Malaysian embassies or high commissions in the foreign country of any FA and/or FC that requires a visa to enter Malaysia. (ii) Addressing any issues (such as incomplete applications) are resolved before the start of the performance period. (iii) Facilitating the application process for any permits or approvals that may be required from local authorities and other relevant Government Agencies before the start of the performance period. (c) For the purposes of such application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix D. (d) The application procedure is illustrated in Appendix E. 14.2 ADDITIONAL APPLICATION (a) Any Applicant who intends to submit a subsequent application for the same category of performance must submit an Additional Application no later than 14 days before the start date of the TWP prescribed in Item 12 of these Guidelines. (b) For the purposes of such Additional Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix F. 22 14.3 SPECIAL CONDITIONS FOR APPROVAL (a) JK-PUSPAL may require a preliminary viewing or hearing of any live or recorded performance by FA before granting approval for any application. JK-PUSPAL may grant a Maximum Approval Value based on reasonable consideration and determination of the number of FAs required in any particular performance, for all categories of performance. (b) Notwithstanding the above, an Applicant is also required to abide by special conditions (if any) in respect of the relevant category of performance by FA as prescribed in Appendix G. 15. WITHDRAWAL OF APPLICATION 15.1 Any Applicant who wishes to withdraw their application whether or not approval has been granted by JK-PUSPAL, is required to submit a letter requesting withdrawal along with any justification and supporting documents. 15.2 Submission must be made by writing and online to PUSPAL Unit as soon as possible. 15.3 The Organiser shall make a clear statement/announcement of any cancellation of a performance via any platform accessible by the public. 15.4 Any loss is at the sole risk and responsibility of the Organiser. 16. APPROVAL & DISMISSAL OF APPLICATION 16.1 Per Item 8, any decision made by JK-PUSPAL shall be communicated to the Applicant within 14 days from the date of receipt of any application, except for problematic or incomplete applications that may be rectified by the Applicant. 16.2 An application may be dismissed by JK-PUSPAL due to the following reasons: (a) The contents of the application are incomplete or inaccurate, and the Applicant has failed to rectify the application; and/or (b) The Organiser and/or representative has been blacklisted by JK-PUSPAL; and/or (c) Background checks on the performance reveal that the FA has negatively touched on national policies, religious issues, ethnic issues, cultural sensitivities and/or any other matter that prejudices public interest; and/or 23 (d) Background checks on the performance reveal that the FA has violated the Code of Ethics as stated in Part 6 of these Guidelines, and there is suggestion that the FA would not be willing to comply if the application was approved; and/or (e) There are written directives from any Local Authority or Government Agency opposing the application; and/or (f) Any other reason deemed reasonable at the discretion of JK- PUSPAL. 17. ANCILLARY APPLICATIONS 17.1 APPLICATION FOR EXTENSION OF TEMPORARY WORK PERIOD (TWP) (a) An application for extension of TWP for FAs and/or FC shall only be considered where; (i) The FA is from an ASEAN country; and (ii) No warning or negative reports has been made by any party regarding the FA, their performance or the Organiser during any previous performance. (b) The maximum period of extension of TWP that may be granted is 90 days for all categories of performance by FAs except the category of Contract Artiste, where no extension will be granted. (c) Any application for extension of TWP must be submitted no later than 14 days before the date such work period is scheduled to expire. (d) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix H. 17.2 APPLICATION FOR SHORTENING OF TEMPORARY WORK PERIOD (TWP) (a) An application for shortening of TWP for FAs and/or FC must be submitted to PUSPAL Unit. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix I. 24 17.3 APPLICATION FOR CHANGE OF DATE OR POSTPONEMENT OF PERFORMANCE (a) Subject to the Regulations of the relevant Government Agencies, an application for change of date or postponement of performance shall only be considered where the proposed date does not exceed 30 days from the original date of performance by FA. (b) An application for change of date or postponement of performance must be submitted no later than seven (7) days after the start date of performance by FA. (c) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix J. (d) Where the proposed date exceeds 30 days from the original date of performance by FA, approval for such performance will be revoked and the Organiser shall be required to resubmit their application for performance as a fresh application. 17.4 APPLICATION FOR CHANGE OF FOREIGN ARTISTE (FA) AND/OR FOREIGN CREW (FC) (a) Any Applicant who, after having received approval from JK-PUSPAL and with specific reasons, intends to (i) Change any FA and/or FC from such persons originally applied for; (ii) Substitute any FA and/or FC whose TWPs have been shortened; or (iii) Replace any FA and/or FC who have failed to enter Malaysia - must submit an Application no later than 14 working days before the start date of the TWP as prescribed in Item 12 of these Guidelines. (b) For the purposes of such Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix K. (c) Where an application falls under the category of Entertainment Premise Performance, an application for change of FA and/or FC are limited to two (2) times only. 25 17.5 APPLICATION FOR TRANSFER OF FOREIGN ARTISTE (FA) AND/OR FOREIGN CREW (FC) FROM EXISTING ORGANISER TO NEW ORGANISER (a) An application to transfer any FA and/or FC still under contract to perform with an existing Organiser is not permitted unless the PLIK issued for the FA and/or FC under the existing Organiser has expired or been terminated prematurely. (b) Any application for performance by FA in Malaysia by the new Organiser must be submitted as a fresh application to JK-PUSPAL. (c) Notwithstanding Items 17.5(a) and 17.5(b), any application to any FA and/or FC from one Organiser to another after the expiry of TWP must also be submitted as a fresh application to JK-PUSPAL. (d) If such application is supported, the FA and/or FC must exit and re- enter Malaysia without having to observe any cooling-off period. (e) The new Organiser will also be responsible for obtaining a new PLIK for the FA and/or FC from JIM. 26
  • 18. PROFESSIONAL VISIT PASS (PLIK)
    18. PROFESSIONAL VISIT PASS (PLIK) 18.1 Upon the approval of an Application under Part 3 of these Guidelines, a PLIK shall be issued pursuant to the Immigration Act 1953/63 [Act 155] and Immigration Rules 1963. 18.2 Any FA and/or FC who carries out a performance in Malaysia without a valid pass or in contravention of any terms of a valid pass is said to have committed an offence under the abovementioned Immigration Act 1953/63 [Act 155] and Immigration Rules 1963. 19. ISSUANCE OF PLIK 19.1 Matters relating to application and issuance of PLIK must be settled at the designated Immigration Counter at PUSPAL’s office during regular office hours. 19.2 For the purposes of such application, an Organiser is required to submit all documents and make such payments as prescribed in Appendix L. 20. INTERIM PLIK 20.1 Where an application for performance under the category of Contract Artiste is approved by JK-PUSPAL for a period exceeding one hundred and 180 days, only an Interim PLIK shall be issued. 20.2 Where an Interim PLIK has been issued for any FA and/or FC, the Organiser is required to apply for renewal of PLIK prior to its expiry. 21. INTERIM PLIK 21.1 Failure to depart the country within the stipulated timeframe shall constitute an offence under the Immigration Act 1959/63 [Act 155]. 28

    23. DRESS CODE DURING PERFORMANCE 23.1 FAs are required to wear attire that is appropriate, and are prohibited from: (a) Dressing in such a manner that resembles the opposite gender; (b) Wearing clothes that are immodest or excessively revealing; (c) Wearing clothes that display symbols, images or words that are obscene, culturally insensitive or politically associated; and (d) Removing clothes during performance. 23.2 In reference to Item 23.1(c), clothes or material that are obscene, culturally insensitive or politically associated include but are not limited to: (a) Clothing containing reference to cigarettes, drugs and alcohol; (b) Clothing satirising, ridiculing or mimicking any particular religious belief or ethnic group; and (c) Clothing promoting any political ideology, racial conflict or sexual identity. 24. CONDUCT DURING PERFORMANCE 24.1 FAs are required to observe decorum during their performance at all times. 24.2 FAs are prohibited from displaying any conduct or speech that contradicts with local religious, social and cultural values such as: (a) Throwing dangerous objects at the audience; (b) Engaging in any wild, violent or obscene behaviour on stage or encouraging members of the audience to do the same; (c) Engaging in any action or speech that may incite, glorify, advocate or criticise any particular group, religion, sexual identity, government or country; (d) Displaying any flag, symbol, insignia or material item that can be associated with any particular group, religion, sexual identity, political ideology, government or country; and 32 (e) Entering areas where audience members are seated or standing which could lead to potential harm. 24.3 In reference to Item 24.2(b), wild, violent or obscene behaviour includes but is not limited to: (a) Excessive vulgarity where the context of the performance does not otherwise require; (b) Destroying any private or public property; (c) Inciting or encouraging a revolt; and (d) Kissing and similar displays of public affection or sexuality. 25. RESTRICTIONS ON SPONSORSHIP, PROMOTION AND SALE 25.1 All sponsorship by and/or direct promotion of any brands related to cigarette/tobacco/electronic smoking device, gambling, alcoholic, sexual products, and/or anything prohibited by Malaysian laws or that touch on religious, racial issues and Malaysian culture are prohibited from all aspects of the FAs performance. 25.2 Where any performance by FA involves the distribution, sale and serving of alcoholic beverages at premises that do not possess a Public House Licence or Beer House Licence issued by the Local Authority, the Organiser shall; (a) Submit to PUSPAL Unit a copy of the Local Authority’s approval for the sale of alcoholic beverages; (b) Submit to PUSPAL Unit a comprehensive layout plan indicating designated areas for the distribution, sale and serving of alcoholic beverages; (c) Ensure that the distribution, sale and serving of alcoholic beverages are not carried out outside of the designated areas as indicated in the plan; (d) Ensure that alcoholic beverages are not distributed, sold and served to any individual under the age of 21 as stated under subsection 14A(1), Entertainment (Federal Territory of Kuala Lumpur) Act 1992 [Act 493] or under any similar written law. 33 26. RESTRICTIONS ON LARGE CAPACITY PERFORMANCES BY FOREIGN ARTISTES (FAs) ON PARTICULAR DATES 26.1 Organisers are prohibited from holding any Large Capacity Performances by FAs in Malaysia during the following period or dates: (a) On the night before or on any Islamic religious holidays, which is Awal Muharam, Maulidur Rasul, Nuzul Al-Quran, Hari Raya Aidilfitri and Hari Raya Aidiladha; (b) On the coronation day of the Yang di-Pertuan Agong; (c) On the demise of the Yang di-Pertuan Agong or Sultan or the death of any related national or state dignitary; and (d) Any other period or date deemed inappropriate by the Government or State Government as relevant. 26.2 Notwithstanding to Item 26.1, Organiser can make an appeal to hold a performance on the date deemed inappropriate by the Government or State Government as relevant. 34 GPP 6.0 PART 7: ORGANISER’S RESPONSIBILITIES

    APPENDIX G: SPECIAL CONDITIONS FOR APPROVAL 1. Pursuant to Item 14.3(b), an Applicant is also required to abide by special conditions prescribed for the categories of performance listed in this Appendix. 2. Performances under the Category of Entertainment Premise Performance. (a) Performance by FA in Hotel is only allowed to be carried out in hotels with a minimum of three (3) star rating. (b) Performance by FA in Entertainment Premise is only allowed to be carried out in premises with valid premise and entertainment licences. (c) Inclusion of performance by LA is encouraged. However, exceptions may be granted as deemed reasonable at the discretion of JK-PUSPAL. (d) Changes of performance space must be notified to PUSPAL. (e) In regards to performance space, Organisers must adhere to the following guide: Performances by FA and LA should be Single Performance Space scheduled alternately or combined together. One performance space must be filled by the Two Performance Spaces LA, while the other space may be filled by the FA. One performance space must be filled by the > Two Performance Spaces LA, while the other space(s) may be filled by the LA and/or FA as deemed appropriate. 3. Performances under the Category of Concert, Music Festival and Singing/Music. (a) Organisers are encouraged to involve LA in any performance by FA. (b) At least 30% of technical workers involved in any performance by FA must consist of LC. However, the ratio of LC involvement may be determined as deemed reasonable at the discretion of JK-PUSPAL. (c) Duration of Large Capacity Performances cannot exceed two (2) consecutive days and is subject to the approval of the relevant Local Authority. (d) Large Capacity Performances are encouraged to be held indoors to facilitate security control and avoid public disturbances. However, application for conducting the performance at an open space that is far from residential and supported by sufficient security measures can be considered, including any additional conditions that may be imposed by JK-PUSPAL. (e) Organisers must submit a security procedure plan when submitting an application to JK-PUSPAL, and will be called upon to provide explanation if necessary. An Organiser is not allowed to be represented by a representative for this matter. 61 APPENDIX G (f) Organisers must also submit the security procedure plan to PDRM for their confirmation on the following: (i) organisers must appoint trained security and medical personnel in a ratio reasonable to the expected number of attendees as per paragraph 3(j); (ii) organisers must liaise with PDRM to obtain any permits for holding performances, on matters related to traffic control, or on any matter requiring assistance and services of the police; (iii) organisers must ensure security checks, including body and bag inspections, are conducted by trained security personnel at all entry points; and (iv) organisers must ensure that the performance venue is equipped with functioning CCTVs. (g) Organisers must ensure that the performance venue has adequate parking facilities and does not disrupt public traffic flow. Organisers are encouraged to choose performance venues with access to public transportation facilities. (h) Organisers must take any necessary steps before, during and after the performance to ensure that there are no activities related to smoking, alcohol and/or drugs being carried out at the performance venue. (i) The number of attendees, taking into account the venue’s capacity, must be proposed to JK-PUSPAL. The number of attendees must not exceed 10,000 persons aged eighteen (18) or above. JK-PUSPAL may require the Organiser to submit information on ticket sales for any performance when deemed reasonably necessary. (j) Organisers are advised to appoint a reasonable number of trained security personnel, paramedics/medical personnel and ambulances, or according to the guide as follow: (i) appoint trained security personnel at a ratio of one (1) security personnel for every 50 attendees, i.e., at a ratio of (1:50); (ii) appoint trained paramedics and medical personnel at a ratio of one (1) paramedic/medical personnel for every 250 attendees, i.e., at a ratio of (1:250); and (iii) provide ambulance facilities at a ratio of one (1) ambulance for every 1,000 attendees, i.e., at a ratio of (1:1000). A designated area for medical assistance must be provided at the venue. (k) Organisers must involve relevant Government Agencies such as the relevant Local Authority, National Anti-Drugs Agency (AADK), Malaysia Volunteers Corps Department (RELA) and the Malaysia Civil Defence Force (APM) to ensure smooth and secure performances without compromising public peace. Each Agency involved must be given a designated space at the performance venue to carry out their duties. 62 APPENDIX G (l) Organisers must ensure that drinking water is available throughout the performance, and placed in areas easily visible and accessible to attendees. (m) Organisers must comply with all fire safety regulations set by the Fire and Rescue Department of Malaysia. 4. Performances under the Category of Promotion. (a) Upon lapse of TWP, an Organiser may submit a new application 90 days after the end of TWP of the FA. However, applications submitted less than 90 of such period may only be considered if there are reasonable grounds as determined by JK- PUSPAL. 5. Performances under the Category of Contract Artiste. (a) Organisers must arrange for opening of an Income Tax File for the FA within the 90 days of the TWP if the FA does not yet have a Malaysian Income Tax File number. (b) In addition to the application submitted to JK-PUSPAL, Organisers must submit the schedule of performances by the FA for the first 90 days of the TWP. The schedule of performances may be submitted to PUSPAL via email, and can be submitted in stages at least seven (7) days before the performance date. 63 APPENDIX H

However, in order to show respect to the local culture, LFPCs is required to comply the requirements as follow: (a) dressing in such a manner that resembles the opposite gender; (b) wearing clothes that are immodest or excessively revealing; (c) wearing clothes that display symbols, images or words that are obscene, culturally insensitive or politically associated; and (d) removing clothes during filming. 23.2 In reference to Item 24.1(b), clothes that are immodest or excessively revealing include but are not limited to: (a) sheer or tight clothing that reveals the person’s undergarments; and (b) clothing that fails to cover the person’s private areas. 23.3 In reference to Item 24.1(c), clothes or material that are obscene, culturally insensitive or politically associated include but are not limited to: (a) clothing containing reference to cigarettes, drugs and alcohol; (b) clothing satirising, ridiculing or mimicking any particular religious belief or ethnic group; and (c) clothing promoting any political ideology, racial conflict or sexual identity. 24. CONDUCT DURING FILMING FAs are required to observe decorum during their film shooting at all times. 25. RESTRICTIONS ON SPONSORSHIP, PROMOTION AND SALE All sponsorship by and/or direct promotion of any brands related to cigarette/tobacco/electronic smoking device, gambling, alcoholic, sexual products, and/or anything prohibited by Malaysian laws or that touch on religious, racial issues and Malaysian culture are prohibited from all aspects of the foreign filming. 29 PART 7: LOCAL FILM PRODUCTION COMPANY’S (LFPC) RESPONSIBILITIES 26. GENERAL RESPONSIBILITIES 26.1 The LFPC is responsible to ensure compliance with any applicable terms and conditions set out in these Guidelines, including: (a) ensuring all information and documents submitted in any application to PUSPAL are accurate and valid; (b) settling the payment of withholding tax for FA and/or FC to LHDNM; (c) obtaining PLIK for each FA and/or FC from JIM; (d) where the filming involves the importation of equipment and goods into Malaysia, ensuring that the management of any FA and/or FC involved has obtained Temporary Import facilities or an ATA CARNET facility available from the FA and/or FC’s country of origin; and (e) providing cooperation with PUSPAL before, during and after any film shooting by FAs in Malaysia. 26.2 Failure to abide by any of the general responsibilities set forth in Item 26.1 may result in the revocation of JK-PUSPAL’s approval for the foreign filming. 27. SPECIFIC RESPONSIBILITIES 27.1 The LFPC is also responsible to ensure compliance with the following: (a) LFPC is deemed fully responsible for the conduct of the foreign film shooting, the FFPC and the behaviour of the FA and/or FC while present in Malaysia; (b) LFPC is required to be present at the filming location or premise throughout the entirety of the filming; (c) LFPC is required to ensure that no filming is carried out by the FA and/or FC at any other venue or premise that has been approved in any PLIK issued by JIM; (d) foreign filming carried out by FFPCs that have been approved by JK-PUSPAL do not require the Filming Authentication Certificate. (e) LFPC is required to ensure that adequate security measures for FA and/or FC and guests have been established; (f) LFPC is required to ensure compliance with the relevant provisions 31 under any written law in force and the Code of Ethics under Part 6 throughout the entire film shooting; (g) LFPC is required to ensure that the FA and/or FC does not stay beyond the approved period in any PLIK issued by JIM; and (h) where applicable, the LFPC is required to ensure that the participation of LA and/or LC in the filming are in accordance with the ratio/percentage stated in these Guidelines or appendices. 27.2 Failure to abide by any of the specific responsibilities set forth in Item 27.1 of these Guidelines may result in the LFPC and/or representative being liable to administrative action by JK-PUSPAL in accordance with Part 8. 32 PART 8: ACTION FOR NON-COMPLIANCE WITH GUIDELINES
  • 13. SCRIPT REVIEW APPLICATION
    13. SCRIPT REVIEW APPLICATION 13.1 LFPCs that wish to apply for a foreign filming under the Feature (Film/Drama) category are required to submit a Script Review Application. 13.2 For the purposes of the Script Review Application, an Applicant is required to submit all documents in the manner and as prescribed in Appendix C. 13.3 Additional conditions that may cause the review application to be rejected can also be found in Appendix C. 13.4 The result of the Script Review Application will allow the Applicant to submit a Foreign Filming Application. 13.5 The result of the Script Review Application will be notified to the Applicant within 14 days from the date of acknowledgement of receipt of the Script Review Application. 14. APPLICATIONS FOR FOREIGN FILMING IN MALAYSIA 14.1 NEW APPLICATION (a) This process is for first-time applications for a foreign film title. 18 (b) A complete application must be submitted no later than 30 days before the starting date of TWP prescribed in Item 12 of these Guidelines. (c) For the purposes of such New Application, the Applicant is required to submit all documents in the manner and as prescribed in Appendix D. 14.2 ADDITIONAL APPLICATION (a) Any Applicant who intends to submit a subsequent application for the same category of foreign filming must submit an Additional Application no later than 14 working days before the start date of the TWP prescribed in Item 12 of these Guidelines. (b) For the purposes of such Additional Application, the Applicant is required to submit all documents in the manner and as prescribed in Appendix E. 14.3 SPECIAL CONDITIONS FOR APPROVAL (a) Letter of Undertaking LFPCs shall ensure that FFPCs sign a Letter of Undertaking and ensure that the FFPCs, including FAs and/or FCs, will comply with the PUSPAL requirements, provisions of prevailing laws, regulations, and codes of ethics throughout the filming process. (b) Involvement of LC in Foreign Filming LFPCs shall ensure that at least 30% of the filming crew consists of local crew members registered with any local film association. However, the ratio of local crew involvement in a foreign film production may be reasonably determined at the discretion of JK- PUSPAL. (c) Import and Export of Filming Equipment and Goods Goods imported into and exported out of the country by FAs and/or FCs are subject to declaration and approval from KASTAM. (d) Requirement of PDRM in Foreign Filming: (i) LFPCs shall liaise with the PDRM when involving assistance and services required, whether involving the role of the PDRM in the film, traffic control, use of firearms by specifying the location address, date, and time of filming, as well as the type of assistance required, within 30 days before the filming date; 19 (ii) The services of officers and members of the PDRM will be subject to government service charges, and the LFPC is responsible for ensuring that insurance coverage is provided to the officers and members involved; and (iii) The LFPC will be liable to pay compensation at the rate determined by the PDRM if it has caused any damage to the use of PDRM premises and assets. (e) Other special conditions: (i) film shooting shall be modified or postponed if the location, date, or time of shooting is deemed inappropriate after considering aspects of safety, public tranquility, local sensitivities, or other matters related to relevant Government Agency regulations; (ii) LFPCs shall ensure that no filming activities or use of images of prohibited areas, as stipulated in the Protected Areas and Protected Places Act 1959 [Act 298], occur without the approval of the responsible authority; (iii) LFPCs shall ensure that film shooting activities do not involve actions resulting in environmental damage and pollution, as well as damage to public property; (iv) film shooting is encouraged to take place in attractive tourist locations, showcasing the cultural uniqueness, artistic heritage of the country, and local products; (v) recognition that the film or specific scenes therein are made in Malaysia shall be stated either at the beginning or end of the film unless directed otherwise, subject to the discretion of JK- PUSPAL; (vi) LFPCs need to get approval from Security Division, KDN if the filming involved explosive materials; (vii) LFPCs need to ensure that the filming is performed according to the script that has been approved according to the JK- PUSPAL requirements; and (viii) LFPCs must submit the final product of the foreign film to PUSPAL Unit using any suitable format before the official screening for that film. 20
