Application is made to the Minister in the form the Minister prescribes; the Minister considers each application and may take into account information about the applicant obtained from other sources. The permit may be issued to a person already in Malawi. It ceases to be valid if the holder remains outside Malawi for a continuous period of twelve months or more since its date of issue. The Minister may cancel it if the application or information supplied was false in a material particular, if the holder engages without permission in an occupation other than the one stated in the permit, if the holder does not take up residence within six months of issue, or if the holder is absent from Malawi for a continuous period longer than six months before becoming a person deemed to belong to Malawi; it must be cancelled if the holder becomes a prohibited immigrant, and the Minister must state the reasons for cancellation.

(1)The Minister may cancel a permanent residence permit in any of the following circumstances—(a)if the application for the permit contained any information which is false in any material particular;(b)if the holder of the permit, or his agent, furnished any information in connexion with the application for the permit which is false in any material particular;(c)if, without the permission of the Minister, the holder of the permit engages in Malawi in any occupation other than the occupation stated in his permit;(d)if the holder of the permit does not take up his residence in Malawi within six months of the date of issue of the permit;(e)if the holder of the permit absents himself from Malawi for a longer continuous period than six months before becoming a person deemed to belong to Malawi,and shall cancel any such permit if the holder thereof becomes a prohibited immigrant.(2)The Minister shall state to the holder thereof the reasons for the cancellation of any permanent residence permit.
