What exactly is the official special programme/status and why does it exist?

The Special Stay Permit, issued, renewed, reissued and cancelled for staff of the official representations of the Central People’s Government of the People’s Republic of China in Macao (the Liaison Office and the Office of the Commissioner of the Ministry of Foreign Affairs) and their dependants, and for staff of public enterprises and public capital enterprises of the People’s Republic of China working in Macao and their dependants.

What sponsor, authority, nomination, certification, evidence or other step must occur before the status can be obtained?

The applicant submits the letter issued by the Liaison Office or the Office of the Commissioner together with the Application Form for Special Authorization to Stay (Format 3), a copy of the Permit for Travelling to and from Hong Kong and Macao for Business Purpose with its latest valid endorsement, and photos.

What immigration status and rights result, how long do they last, can family be included, and what happens if the special qualifying circumstance ends?

The result is a Special Stay Permit (MOP100 per Permit, with staff of the official representations of the Central People’s Government exempt; 8-working-day pledge). Its validity generally depends on the working period, follows the endorsement on the travel permit, and it can be renewed; holders of a business two-way permit with a working or stationing endorsement may stay within the endorsement’s validity, with a maximum of 90 days per entry. Dependants are covered. If the employment relation is terminated, the employee is accredited outside Macao or the holder is granted Residence Authorization, the Permit must be cancelled immediately; the holder may be granted Authorization to Stay, if necessary, to arrange departure.

    The validity of the Special Stay Permit generally depends on the working period and is based on the endorsement in the Permit for Travelling to and from Hong Kong and Macao. The Special Stay Permit can be renewed.

    In the case that (1) the employment relation is terminated, (2) the employee is accredited to a country or region outside Macao, or (3) the Special Stay Permit holder is granted Residence Authorization, the person making the application should immediately approach the Subdivision concerned for cancellation of the Permit.

    Upon completion of the formalities, the original Authorization to Stay of the Permit holder will immediately be cancelled. According to Article 37 of Law No. 16/2021, the holder will be granted Authorization to Stay (if necessary) for making departure arrangements.
