Which family relationships qualify?

Qualifying ties are personal or family ties falling outside the family-reunification categories, with a person the applicant wishes to join, where the ties (assessed by intensity, duration and stability) are such that refusal would disproportionately violate the right to private and family life. For partners, neither may be married or in a registered partnership with someone else.

    the third-country national does not fall into the categories giving entitlement to family reunification , but their personal or family ties with the person they wish to join - assessed in particular with regard to their intensity, duration and stability - are such that a refusal of residence would violate their right to respect for their private and family life in a way that is disproportionate to the grounds for refusal. In the case of a relationship between partners, neither of the 2 partners must be in a marriage or registered partnership with another person.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The person joined must be legally residing in Luxembourg. A financial statement of support may be signed by a third party of Luxembourg nationality or permitted to reside legally in Luxembourg for at least one year.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Applicants must provide proof of stable, long-standing and strong personal or family ties (e.g. a household composition certificate from the country of origin) and a document certifying marital status and family situation; for an unregistered partnership, both partners must prove that they are not married, in a partnership or in a long-term relationship with another person (e.g. civil-status extract, certificate of celibacy).

What important financial, accommodation, insurance or maintenance responsibilities apply?

The applicant must have stable, regular and sufficient resources for themselves and dependants without social assistance, at least equal to the social inclusion income (e.g. via a financial statement of support by a guarantor residing in Luxembourg), proof of suitable housing in Luxembourg and proof of comprehensive health insurance valid in Luxembourg.
