Which citizenship, status or regional agreement creates the person's right to move/reside?

The right applies to UK nationals residing in Italy who are entitled under the Withdrawal Agreement; the residence card is issued under 'Articolo 50 TUE e Articolo 18(4) Accordo di Recesso UE-Regno Unito'.

What entry, registration or residence-document formalities remain?

The residence card (Carta di Soggiorno) is not mandatory but strongly recommended: it proves Withdrawal Agreement beneficiary status and is now needed for exemption from the EU Entry/Exit System (EES). Beneficiaries book an appointment at the competent Questura, the issuing authority, and must not use the Poste Italiane kit; they present a postal payment slip of €30,46, the tax code or electronic identity card (CIE), any previous card or a loss/theft report, and give fingerprints at the appointment. Once the card is obtained, registration of residence at the Comune is mandatory if not already done; those who lived in Italy before 1 January 2021 without a card or residence registration must bring proof of presence in Italy before that date.

Which non-member-country family members can accompany or join, and what broad rights do they receive?

Close family members of a Withdrawal Agreement beneficiary, whether already living in Italy or moving in the future, can apply for and obtain the residence card at the competent Questura: spouse, registered partner, child under 21, dependent child over 21, and dependent grandchildren, parents and grandparents. They must show the family relationship existed before and not later than 31 December 2020 (except future children, including adopted children); dependency must exist when applying for residence.

    Anche i familiari stretti di un beneficiario dell’Accordo di Recesso possono richiedere e ottenere la Carta di Soggiorno presso la Questura di competenza. Una volta ottenuto questo documento, dovranno registrare la propria residenza presso il proprio Comune. Si considerano familiari stretti sia coloro che vivono attualmente in Italia sia coloro che si trasferiranno in Italia in futuro. Un familiare può essere il coniuge, un partner registrato, un figlio di età inferiore ai 21 anni, un figlio a carico di età superiore a 21 anni, e nipoti, genitori e nonni a carico. I familiari del beneficiario dell’Accordo di Recesso devono dimostrare di essere stati tali prima del e non oltre il 31 dicembre 2020 (ad eccezione di figli futuri, compresi eventuali figli adottivi). Nel caso di familiari a carico, questa dipendenza deve esistere nel momento in cui presentano richiesta di residenza.

When do permanent/long-term rights arise and what continuity, absence or retention conditions matter?

The right of permanent residence is acquired after legal and continuous residence in Italy for 5 years; holders of a valid five-year card can then request a card valid 10 years (called permanent). Renewal applications may be filed from 60 days before the card expires.

Se si possiede una Carta di Soggiorno quinquennale in corso di validità e si è maturato il diritto al soggiorno permanente (residenza legale e continuativa in Italia per 5 anni), è possibile richiedere una Carta di Soggiorno con validità di 10 anni (detta anche permanente). Qualora si dovessero riscontrare difficoltà nel rilascio della Carta con validità 10 anni, è possibile richiamare l’attenzione della Questura al rispetto della circolare della Direzione Centrale dell’Immigrazione e della Polizia delle Frontiere del 6 giugno 2024 , che invita le Questure a facilitare tale procedura per tutti i cittadini britannici residenti in Italia in modo continuativo da oltre 5 anni. La normativa prevede che l’istanza di rinnovo del titolo sia presentata a partire da 60 giorni dalla scadenza del titolo in possesso.
