What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

A temporary permission-to-stay extension route under Appendix U: Ukraine Scheme of the Isle of Man Immigration Rules, for people affected by the conflict in Ukraine who are already in the Isle of Man; it is not asylum and not a route to settlement. Usually an initial grant of up to 18 months, followed by a further grant of up to 24 months.

Which population, circumstances or geographic group does the mechanism cover?

People in the Isle of Man who hold or previously held permission under the Ukraine Family Scheme, Ukraine Extension Scheme, Ukraine Sponsorship Scheme or certain leave outside the rules: Ukrainian nationals; non-Ukrainian partners, children, parents (of a Ukrainian granted before age 18), fiance(e)s/proposed civil partners and family members granted under the closed Ukraine Family Scheme; parents of children born in the Isle of Man, UK or Channel Islands with such permission; and children born in the Isle of Man, UK or Channel Islands after 18 March 2022 to a Ukrainian national parent.

    UKR 31.1. The applicant must be either: (a) a Ukrainian national who has previously been granted permission in accordance with paragraph UKR 29.3; or (b) if not a Ukrainian national, an individual who was granted permission in accordance with UKR 29.3 as, and who remains as: (i) the partner of a Ukrainian national; or (ii) the child of a Ukrainian national; or (iii) the parent of a Ukrainian national who was granted permission under Appendix Ukraine Scheme before they turned 18 years old; or (iv) the fiancé(e) or proposed civil partner of a Ukrainian national; or (v) a family member granted permission in accordance with the rules at the time in Appendix U: Ukraine Scheme on the now closed Ukraine Family scheme; or (c) an individual who is the parent of a child who — (i) was born in the Isle of Man ,UK or Channel Islands and is in the Isle of Man, UK or Channel Islands with permission under Appendix Ukraine Scheme or the equivalent permission in the UK or Channel Islands; or (ii) was born in the Isle of Man , UK or Channel Islands and meets the criteria at UKR 29.4 and who would, if they made an application, be eligible for permission under Appendix Ukraine Scheme; or (d) a child who was born in the Isle of Man, the UK or the Channel Islands after 18 728 Appendix U: Ukraine Extension Scheme March 2022 to a Ukrainian national parent.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

A direct in-country application made from within the Isle of Man using the specified paper form 'UPE' from gov.im, no more than 90 days before the current permission expires, with biometrics when required and a passport or other identity/nationality document. Applications are free of charge.

What happens after the request: registration, family handling, major support and rights where officially stated?

After applying, the Immigration Office considers the application; if the current permission expires before a decision, it continues under section 3C leave. Travelling outside the Common Travel Area while waiting withdraws the application. If granted, the applicant collects a passport visa stamp and information letter at the Immigration Office. Children are granted permission in line with their parent or legal guardian (or the parent whose permission expires last). The grant permits access to public funds, work (including self-employment and voluntary work) and study (subject to ATAS).

    After an applicant has made their application, proven their identity and provided any necessary supporting documents, the Immigration Office will consider their application. The Isle of Man Immigration Office’s processing times can be found on our website here. If the applicant’s current permission expires after submitting an application but before a decision is made on their UPE application they do not need to take any action, as their current permission will continue under section 3C leave. The purpose of section 3C leave is to prevent a person who makes an in-time application to extend their leave from becoming an overstayer while they are awaiting a decision on that application.

    Applicants should not travel outside the Isle of Man or any other part of the Common Travel Area (the Common Travel Area includes the Isle of Man UK, Ireland, Jersey, and Guernsey) whilst waiting for a decision on their application. If they do travel, their application will be withdrawn and will not be considered.

    Following a successful application, the applicant will be contacted by the Immigration Service to collect their documents at the Immigration Office. This will include a new visa stamp in their passport, and an information letter explaining the conditions that the applicant must follow. The stamp issued in their passport will prove their immigration status.

    Children will be required to be in the Isle of Man with a parent or legal guardian. Following a successful application, they will be granted permission in line with their parent or legal guardian if granted at the same time, or in line with the parent whose permission expires last if both parents have applied to the UPE.
