Which family relationships qualify?

Category 1 covers the spouse, civil partner or de facto partner (aged 18 or over) of a UK national who came to live in Ireland after 31 December 2020.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

A UK national who lives, or intends to live, in Ireland and is self-sufficient. They must not have sponsored another spouse or partner in the previous 7 years.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Evidence includes a State-issued marriage or civil partnership certificate (plus a religious certificate for a religious marriage), a full relationship history if the couple has not lived together since marrying and, for de facto partners, evidence of at least 2 years of cohabitation.

What important financial, accommodation, insurance or maintenance responsibilities apply?

For a couple with no children, the sponsor needs a minimum assessable income of €20,000 a year over and above State benefits. The applicant needs medical insurance from an insurer authorised by the Health Insurance Authority.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

Non-visa-required nationals apply for a preclearance letter of approval. The permission and registration must be renewed about 6 weeks before they expire. If the sponsor dies or leaves, or the relationship ends, the person may ask in writing for permission to stay in their own right, decided case by case. The official source does not state the rights attached to the permission or its initial duration.
