Which citizenship, status or regional agreement creates the person's right to move/reside?

EU Treaty Rights (Directive 2004/38/EC) do not generally apply to Irish citizens in Ireland. An exception may apply where the Irish citizen used free-movement rights in another EU member state and a non-EEA family member who lived with them there comes back with them.

The Irish citizen must first have used free-movement rights in another member state. To stay longer than three months under EU Treaty Rights, the EU family member must be working, self-employed, studying (qualifying family members only) or self-sufficient.
