What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

The permit is for foreign nationals who entered Ireland on a valid employment permit but fell out of the system through no fault of their own, or were badly treated or exploited at work, so they can work legally again.

Reactivation Employment Permits are designed for situations where a foreign national who entered the State on a valid Employment Permit but who fell out of the system through no fault of their own or who has been badly treated or exploited in the workplace, to work legally again.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

The permit requires a genuine job offer from an employer that employs and pays the worker directly; the applicant must first get a temporary Stamp 1 and a “Reactivation Employment Permit” letter from the Department of Justice, and no Labour Market Needs Test is required.

The permit allows employment with the named employer in the occupation and location on the permit; the holder is expected to stay 12 months with the initial employer, after which, save in exceptional circumstances, they may move with a new application. Dependants, partners and spouses cannot get a Dependant Employment Permit and must apply for their own; the official source does not state whether family members may accompany the holder.

How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

The permit is granted for up to 24 months initially and is extendable by a further 3 years, after which the holder is expected to apply for long-term residency; after 5 consecutive years of lawful work the holder may not need a permit and should apply for a temporary Stamp 4.

Applications may be granted for a maximum period of up to 24 months in the first instance and may be extended upon application by a further 3 years after which it is envisaged that a holder would apply for long-term residency from the Department of Justice.

Non-EEA nationals that have held valid Reactivation Employment Permits for 5 years or more consecutively and have been working lawfully during that time may not require an Employment Permit to work in the State. In these circumstances the proposed employee may not be required to apply for a new Reactivation Employment Permit or a renewal of their existing Employment Permit and should contact the Department of Justice to apply for a temporary Stamp 4.
