Which citizenship, status or regional agreement creates the person's right to move/reside?

A non-EEA national in Ireland may claim a right of residence under Article 20 of the Treaty on the Functioning of the European Union and the CJEU judgment in Zhu and Chen v Secretary of State for the Home Department (Case C-200/02), as primary carer of an EU citizen child.

Under which circumstances can the person reside: worker, self-employed, student, jobseeker, self-funded person or another recognised basis?

The applicant must be a non-EU national resident in Ireland; the EU citizen child must be under 18, a citizen of an EU member state other than Ireland and residing in Ireland; and the applicant must have comprehensive medical insurance and sufficient resources so as not to be a burden on the State (self-sufficiency).

What entry, registration or residence-document formalities remain?

Apply by post on Form EUCC – Chen (following pages 1–2 of the form) to Join Family, ISD, 13/14 Burgh Quay, Dublin 2, with photocopies of supporting documents and the completed checklist; incomplete forms are not processed. Evidence includes the child's birth certificate and passport, proof of the child's and applicant's residence in Ireland, relationship/custody documents, and comprehensive medical insurance policies for applicant and child.

When do permanent/long-term rights arise and what continuity, absence or retention conditions matter?
