Which citizenship, status or regional agreement creates the person's right to move/reside?

The right belongs to citizens of the EU (27 countries), the EEA (EU plus Iceland, Liechtenstein, Norway) and Switzerland (through its agreement extending the single market); an EEA national entitled to remain permanently may apply for a permanent residence certificate under Regulation 14 of the 2015 Regulations.

Under which circumstances can the person reside: worker, self-employed, student, jobseeker, self-funded person or another recognised basis?

Permanent residence is based on a continuous period of five years or more in Ireland while in employment, self-employment, study, involuntary unemployment or with sufficient resources; shorter periods apply on reaching pensionable age/early retirement (more than 3 years' residence and 12 months' prior work), permanent incapacity for work (more than 2 years), or incapacity from a work accident or occupational illness.

    (1) a continuous period of five years or more while engaged in employment, self -employment, the pursuit of a course of study, involuntary unemployment, or the possession of sufficient resources under the European Communities (Free Movement of Persons) Regulations 2015, as amended, or the European Union (Withdrawal Agreement) (Citizens’ Rights) Regulations 2020 or (2) a continuous period of more than three years in the following circumstances:a. the EEA national or United Kingdom national has reached pensionable age, as defined by the Social Welfare Acts, or has taken early retirement, and b. at the time of reaching pensionable age or taking early retirement, the EEA national or United Kingdom national has resided continuously in the State for more than three years and has been engaged in employment or self-employment in the State for at least the previous twelve months. or (3) a continuous period of more than two years if the EEA national or United Kingdom national has ceased to be engaged in employment or self-employment in the State as a result of permanent incapacity for work or (4) a continuous period for less than five years if the EEA national or United Kingdom national has been permanently incapacity from work as a result of an accident at work or an occupational illness entitling the EEA national or United Kingdom national to a pension or other benefit payable in whole or in part by the State.

What entry, registration or residence-document formalities remain?

Apply on Form EUTR2 (reading the EUTR2 explanatory leaflet first), using Annex A/B for extra address or activity history over the past five years and Annex C for spouse/civil partner/child/carer details. A non-EEA family member must not use EUTR2 but apply on Form EUTR3.

Which non-member-country family members can accompany or join, and what broad rights do they receive?

Non-EEA family members who resided with the EU citizen in Ireland in conformity with the Regulations for 5 continuous years may remain permanently and apply for a permanent residence card, which is valid for 10 years and renewable. Where a citizen gains permanent residence on retirement/incapacity grounds, family members residing with them may also reside permanently.

    (6) Where a Union citizen is entitled to remain permanently in the State pursuant to paragraph (1) or (3), a family member of the Union citizen, irrespective of the family members nationality, may reside permanently in the State where he or she is residing with the Union citizen.

When do permanent/long-term rights arise and what continuity, absence or retention conditions matter?

An EU/EEA/Swiss citizen who has lived in Ireland continuously for five years or more and complied with the regulations may apply for the certificate, valid for ten years. Continuity is not affected by absences up to 6 months in 12, military service, or one absence of up to 12 consecutive months for important reasons; the certificate ceases to be valid after more than 2 consecutive years' absence or removal/exclusion.
