What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

A protection status based on the prohibition of refoulement ("tolerated status"): recognised by the asylum authority when non-refoulement is established during immigration procedures, or when an asylum application is rejected while non-refoulement is established.

Limits of the record
  • Tolerated status is not among the outcomes listed for the asylum decision (refugee status, subsidiary protection, temporary protection, refusal, termination) [a736656bd5a85e19.reextract.txt 13058:13500].
  • The asylum authority reviews annually whether the conditions for retaining it are met [a736656bd5a85e19.reextract.txt 4937:5043].
  • chars 4666-4934
The asylum authority may recognise a person as a beneficiary of tolerated status if the prohibition of refoulement is established during immigration procedures or if their asylum application is rejected while simultaneously establishing the prohibition of refoulement.

Which population, circumstances or geographic group does the mechanism cover?

Foreigners who do not meet the refugee or subsidiary-protection criteria but face persecution or serious harm in their country of origin for reasons of race, religion, nationality, membership of a social group or political opinion, and for whom there is no safe third country to accept them.

  • chars 4280-4665
Hungary grants protection to beneficiaries of tolerated status who are foreigners who do not meet the criteria for refugee or subsidiary protection status but face the risk of being persecuted or serious harm in their country of origin due to reasons of race, religion, nationality, membership in a social group, or political opinion, and there is no safe third country to accept them.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

The checked official sources did not provide enough route-specific evidence to confirm where and how protection is requested.

What happens after the request: registration, family handling, major support and rights where officially stated?

Once non-refoulement protection is granted, the person is given the right of residence in Hungary and the National Directorate-General for Aliens Policing provides support and assistance for integration.

Limits of the record
  • The cited sentence says "non-refoulement" and ties it to tolerated status only implicitly (the tolerated-status definition rests on the prohibition of refoulement [a736656bd5a85e19.reextract.txt 4666:4934]).
  • No registration, family-handling or support detail specific to tolerated status is given.
  • chars 13778-14183
If the applicant is granted international protection as provided for above (i.e. refugee status, subsidiary protection or non-refoulement) the applicant will be given the right of residence in the territory of Hungary. The National Directorate-General for Aliens Policing provides support and assistance to the client so as to facilitate his/her integration into the Hungarian society as soon as possible.

Which competent authority, UN body or official assistance channel should the person use?

The refugee (asylum) authority is the first channel; help may also be requested from lawyers, organisations offering free legal aid or the UN High Commissioner for Refugees (UNHCR).
