What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

A form of international protection decided within the asylum procedure: the procedure determines whether the applicant is eligible for refugee status or for subsidiary protection status.

The purpose of the asylum procedure is to determine whether the individual submitting the asylum application is eligible for refugee or subsidiary protection status, whether the prohibition of refoulement applies to his/her case, and, if it does not, whether the person can be subjected to return or removal, as well as whether the person concerned can be transferred under the Dublin regulation.

Which population, circumstances or geographic group does the mechanism cover?

Persons who do not meet the refugee criteria but face a risk of serious harm on return to their country of origin and are unable, or for fear of that harm unwilling, to seek their own country's protection.

Beneficiary of subsidiary protection status shall be granted to a person who does not meet the criteria for recognition as a refugee but faces the risk of serious harm upon returning to his/her country of origin and is unable to seek the protection of his/her home country or is unwilling to seek it due to fear of this harm.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

Under Hungary’s published Act L of 2025 transitional rules, applicable through 31 December 2026, a foreigner who wishes to enter Hungary to apply for asylum generally first files a personal declaration of intent addressed to the asylum authority at a designated Hungarian embassy in a neighbouring non-EU country. The authority examines it and may interview the person remotely. If it recommends a single-entry travel document, the person reports the intent to apply immediately to border police on entry; police bring the person to the asylum authority within 24 hours, where the asylum application is then submitted. The declaration is not a prerequisite for an unaccompanied minor already in Hungary, an eligible family member of a recognised refugee or subsidiary-protection beneficiary already in Hungary at application, or a person under a qualifying custodial sentence, measure, or coercive deprivation of liberty, excluding arrest/apprehension, being brought before an authority, and petty-offence detention; general application rules apply to these exceptions. A person who unlawfully crosses the border and declares asylum intent to police is directed to the neighbouring Hungarian embassy. These are published Hungarian domestic filing rules, and a declaration is not itself an asylum application. The asylum application is the process in which the authority determines refugee or subsidiary-protection status; this is not a separate subsidiary-protection visa.

UM Asylum refers to the legal title that entitles a foreigner who is granted it to reside within the territory of Hungary, while simultaneously providing protection from refoulement, return, and extradition. ASYLUM PROCEDURE The purpose of the asylum procedure is to determine whether the individual submitting the asylum application is eligible for refugee or subsidiary protection status, whether the prohibition of refoulement applies to his/her case, and, if it does not, whether the person can be subjected to return or removal, as well as whether the person concerned can be transferred under the Dublin regulation. What happens after the request: registration, family handling, major support and rights where officially stated?

After a subsidiary-protection request, the asylum authority examines whether a person who does not qualify as a refugee faces serious harm on return and cannot or will not seek protection from the home country. On application, qualifying family members may also receive subsidiary protection if they applied together or, with the beneficiary’s consent, before the decision; a child born in Hungary to a beneficiary may also receive the status on application. The authority reviews retention conditions at least every three years after recognition. The asylum process includes a personal interview; the stated ordinary procedural period is 60 days excluding certain procedural steps. Grant of subsidiary protection gives a right to reside in Hungary, with integration assistance from NDGAP.

he asylum-seeker is below the age of 18 years and arrived to Hungary unaccompanied, the guardian authority will appoint a child welfare officer to assist the asylum-seeker during the procedure. If the refugee authority is of the opinion that the asylum-seeker is presumably not a minor, it will appoint a medical expert to determine the asylum-seeker’s age. ASYLUM PROCEDURE Procedural time limit The asylum procedure will be carried out in 60 days, covering the asylum-seeker’s personal interview as well. The time required for procedural steps is not included in the procedural time limit. However, in some cases the authority has power to bring a decision within a shorter period of time, in a so called accelerated procedure. If there is any possibility that another EU Member State is responsible for the examination of the application, the procedure will be suspended until the competent authority of that EU Member State provides a response. The duration of such procedure depends on the co-operation of the foreign partner authorities, and may take several months. Hearing and records The asylum-seeker will be interviewed during the asylum procedure, assisted by an interpreter. During the interview the applicant is asked to provide details about the reasons for fleeing, the circumstances of reaching Hungary, and to present any evidence that may be available to support the application, including personal identification documents. During the asylum procedure, the refugee authority will inform the applicant in detail about his/her rights and obligations relating to the procedure. Decision In the asylum procedure a decision may be adopted for: ·                                 Granting refugee status ·                                 Granting subsidiary protection ·                                 Granting temporary protection, which enables the asylum-seeker to stay in Hungary on a temporary basis ·                                 Refusing the application in full ·                                 Terminating the procedure. If the application is refused in its entirety – and if the applicant does not have the right of residence in Hungary on other grounds – the refugee authority shall provide for the expulsion and deportation of the applicant, and shall set the duration of the exclusion measure. If the applicant is granted international protection as provided for above (i.e. refugee status, subsidiary protection or non-refoulement) the applicant will be given the right of residence in the territory of Hungary.
