Under which circumstances can the person reside: worker, self-employed, student, jobseeker, self-funded person or another recognised basis?

As a student: enrolled at an educational institution governed by the Public Education Act or the National Higher Education Act for the principal purpose of study (including accredited vocational training and adult education), with sufficient resources for themselves and their family members not to burden the social assistance system and comprehensive sickness insurance cover (or assured resources for such services).

What entry, registration or residence-document formalities remain?

An EEA national staying beyond three months must notify residence and personal data to the competent regional directorate no later than the 93rd day after entry. Registration can be submitted electronically; present a valid travel or identity document and proof of the residence basis. For the study basis, provide an admission certificate, student-status document or other reliable evidence, along with evidence of sufficient resources and healthcare cover or resources to pay for healthcare. At notification, the EEA national must also declare whether they have a specified infectious or contagious parasitic disease posing a public-health threat or receive compulsory regular treatment for such disease. On verification the authority issues a registration certificate immediately; the stated fee is HUF 1,000. First residence is registered in the same process and an official address card is posted. The registration certificate remains valid indefinitely when accompanied by a valid travel or identity document.

In the notification of residence the client is to produce his/her valid travel document or personal identification document, and enclose documents – provided for in specific other legislation – in proof of compliance with the requirements for the right of residence. In the event of verifying fulfilment of the requirements provided for by law, the competent authority shall issue a certificate of notification of residence (hereinafter referred to as “registration certificate”) immediately. REGISTRATION OF THE FIRST RESIDENCE IN HUNGARY The applicant shall notify his/her first residence in the territory of Hungary in the context of the procedure for the issue of a registration certificate. Upon receipt of notice, the Government Agency of the City of Budapest shall issue the official address card, and shall send it to the applicant by post. Registration of the place of residence in Hungary:        a residential lease contract in proof of the rental of a residence;        a document on accommodation by courtesy;        a document in proof of ownership of the residential property, by means of a certified copy of title deed issued within 30 days to date;        other documentary evidence. During the process, the immigration authority may request further documents, apart from the mandatory enclosures, for ascertaining the relevant facts of the case, and may take further procedural steps if considered necessary. The administrative time limit shall not include the length of time between the receipt of the notice for remedying deficiencies until the time of compliance. After the application is submitted the applicant or his/her representative shall be able attach documents by way of post or electronically. Which non-member-country family members can accompany or join, and what broad rights do they receive?

Third-country family members who may accompany or join are the spouse; direct descendants of the EEA national or of the spouse who are under 21 or dependent; dependent direct ascendants of the EEA national or of the spouse; a registered partner; and any person admitted on family-reunification grounds. The official sources do not describe their broad rights, such as work or benefits.

When do permanent/long-term rights arise and what continuity, absence or retention conditions matter?

For the student EEA-national route, Permanent residence status for an EEA national is granted after five years of lawful, continuous residence in Hungary. Apply at the competent regional directorate in person or through the immigration authority’s electronic platform, with a valid travel document or identity card and proof of lawful, continuous residence. Unless contrary evidence exists, continuity starts when residence beyond 90 days is reported. Absences up to six months per year, compulsory military service, or one absence up to 12 consecutive months for a material reason do not break continuity. Abandoning the exercise of the Hungarian residence right breaks the qualifying period. The permanent residence card for an EEA national has indefinite validity together with a valid travel or identity document.

Where an EEA national has acquired the right of permanent residence under either of the preferential terms enumerated above, his/her family members holding the right of residence shall also have the right of permanent residence.

EEA nationals shall present their documents evidencing their right of residence when requested so by the authority vested with powers to check their identity and their right of residence.
