What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

An asylum procedure: it determines whether the applicant is eligible for refugee status or subsidiary protection, whether the prohibition of refoulement applies, whether return or removal is possible, and whether a Dublin transfer applies.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

Under Hungary’s published Act L of 2025 transitional rules, applicable through 31 December 2026, a foreigner who wishes to enter Hungary to apply for asylum generally first files a personal declaration of intent addressed to the asylum authority at a designated Hungarian embassy in a neighbouring non-EU country. The authority examines it and may interview the person remotely. If it recommends a single-entry travel document, the person reports the intent to apply immediately to border police on entry; police bring the person to the asylum authority within 24 hours, where the asylum application is then submitted. The declaration is not a prerequisite for an unaccompanied minor already in Hungary, an eligible family member of a recognised refugee or subsidiary-protection beneficiary already in Hungary at application, or a person under a qualifying custodial sentence, measure, or coercive deprivation of liberty, excluding arrest/apprehension, being brought before an authority, and petty-offence detention; general application rules apply to these exceptions. A person who unlawfully crosses the border and declares asylum intent to police is directed to the neighbouring Hungarian embassy. These are published Hungarian domestic filing rules, and a declaration is not itself an asylum application.

A kérelem benyújtásának személyi hatálya Jelen eljárási szabályok kiterjednek arra a külföldire, aki menedékjog iránti kérelem benyújtása céljából Magyarországra kíván beutazni. A kérelem benyújtásának időbeli hatálya Az eljárást a 2025 . július 20. napján vagy azt követően benyújtott szándéknyilatkozatokra kell alkalmazni. A kérelem benyújtásának módja A kérelmet elsődlegesen szándéknyilatkozat ( magyar ; angol ) formájában, személyesen szükséges benyújtani (a továbbiakban: beadvány) a menekültügyi hatósághoz címezve, a Magyarországgal határos, nem európai uniós tagállam területén működő, a külképviseletekről és a tartós külszolgálatról szóló 2016. évi LXXIII. törvény 3. § (1) bekezdés a) pontjában meghatározott diplomáciai képviseleten (a továbbiakban: nagykövetség) lehet előterjeszteni, a menekültügyi hatóság által meghatározott és közzétett tartalommal. Az eljárás menete A szándéknyilatkozatot a menekültügyi hatóság vizsgálja meg, amelynek során a hatóság, a nagykövetségeken személyesen megjelenő külföldit távmeghallgatás útján, meghallgathatja. Amennyiben a menekültügyi hatóság által lefolytatott vizsgálat eredményeként a külföldi, a menedékjogi kérelem benyújtása céljából kiállított, Magyarországra történő egyszeri beutazásra jogosító okmányra (a továbbiakban: utazási okmány) jogosulttá válik, úgy erről a tényről a menekültügyi hatóság a nagykövetséget 60 napon belül tájékoztatja az utazási okmány kiadása érdekében. A menekültügyi hatóság tájékoztatása alapján Magyarország nagykövetsége 30 napig érvényes utazási okmányt állít ki, amennyiben a külföldi egyébként nem rendelkezik Magyarországra történő belépésre jogosító engedéllyel. Amennyiben a menekültügyi hatóság által lefolytatott vizsgálat alapján a hatóság nem tesz javaslatot utazási okmány kiadására, erről a hatóság a külföldit a nagykövetség útján tájékoztatja. Az eljárás folyamán a menekültügyi hatóság külföldivel történő kapcsolattartása kizárólag a nagykövetségeken keresztül történik. Az utazási okmánnyal rendelkező külföldire vonatkozó további szabályok Az utazási okmánnyal rendelkező külföldi menedékjogi kérelme előterjesztésének szándékát az országba történő belépéskor haladéktalanul jelzi a határrendészeti szerv felé. A határrendészeti szerv a külföldit legkésőbb 24 órán belül a menekültügyi hatóság elé állítja. Az elismerését kérő számára a menekültügyi hatóság végzéssel szálláshelyet jelölhet ki zárt befogadó intézményben. A kérelem benyújtásától számított négy hét elteltével - feltéve, hogy a menekültügyi őrizet elrendelésének feltételei nem állnak fenn -, a menekültügyi hatóság a menekültügyi eljárás általános szabályai szerint határozza meg a szálláshelyet. Különleges szabályok Az alábbi esetekben a menedékjogi kérelem benyújtásának nem feltétele az eljárás menete során említett szándéknyilatkozat benyújtása, a kérelem benyújtására az általános szabályok irányadóak - a Magyarországon tartózkodó kísérő nélküli kiskorú, - a menekültként vagy oltalmazottként elismert személynek a menedékjogról szóló törvény szerinti, a menedékjogi kérelem benyújtása idején Magyarországon tartózkodó családtagja, - a szabadságelvonással járó büntetés vagy intézkedés, illetve személyi szabadságot érintő kényszerintézkedés - ide nem értve az elfogás, az előállítás és a szabálysértési elzárás esetét - hatálya alatt álló személy tekintetében. (2) Az utazási okmánnyal rendelkező külföldi menedékjogi kérelme előterjesztésének szándékát az országba történő belépéskor haladéktalanul jelzi a határrendészeti szerv részére. (3) A határrendészeti szerv a külföldit legkésőbb 24 órán belül a menekültügyi hatóság elé állítja. (4) A menedékjogi kérelmet előterjesztő külföldi a menedékjogról szóló törvény szerinti jogait menedékjogi kérelmének a menekültügyi hatóság előtti előterjesztése időpontjától gyakorolhatja. (5) Az elismerését kérő számára a menekültügyi hatóság végzéssel szálláshelyet jelölhet ki zárt befogadó intézményben. Ha a kérelem benyújtásától számított négy hét eltelt, és a menekültügyi őrizet elrendelésének feltételei nem állnak fenn, a menekültügyi hatóság a menekültügyi eljárás általános szabályai szerint határozza meg a szálláshelyet. 5. § (1) A menedékjogi kérelem benyújtásának nem feltétele a 2. § szerinti szándéknyilatkozat benyújtása a) a Magyarországon tartózkodó kísérő nélküli kiskorú, b) a menekültként vagy oltalmazottként elismert személynek a menedékjogról szóló törvény szerinti, a menedékjogi kérelem benyújtása idején Magyarországon tartózkodó családtagja, valamint c) a szabadságelvonással járó büntetés vagy intézkedés, illetve személyi szabadságot érintő kényszerintézkedés – ide nem értve az elfogás, az előállítás és a szabálysértési elzárás esetét – hatálya alatt álló személy tekintetében. (2) A Magyarország államhatárát jogellenesen átlépő külföldit – ha a menedékjogi kérelem benyújtásának a szándékát a rendőrség előtt jelzi – a rendőrség a határátlépés helye szerinti szomszédos országban található magyar nagykövetségre irányítja. (3) Az (1) bekezdés szerinti esetben a menekültügyi hatóság a menekültügyi eljárás általános szabályai szerint jár el. 6. § A menekültügyi hatóság a menedékjogi kérelem benyújtására irányuló szándéknyilatkozattal összefüggő eljárása során a külföldiek adatait 10 évig kezeli. 7. § A menedékjogi kérelem elbírálása során nem alkalmazhatóak a) a menedékjogról szóló 2007. évi LXXX. törvény (a továbbiakban: Met.) 71/A–72. § -a és 80/H–80/K. § -a, b) a menedékjogról szóló 2007. évi LXXX. törvény végrehajtásáról szóló 301/2007. What happens after the request: registration, family handling, major support and rights where officially stated?

After an application for international protection, the asylum authority records a photograph and, for applicants aged six or over under Regulation (EU) 2024/1358, applicable from 12 June 2026, biometric data sent to Eurodac to check prior claims or residence in another EU Member State. A personal interview is included in the ordinary stated 60-day procedural period, excluding time for certain procedural steps; another Member State’s responsibility can suspend the process. First asylum proceedings in Hungary are exempt from authority and court procedural costs, and interpretation costs are covered by the Office. The authority may grant refugee or subsidiary protection, refuse or terminate the case; a grant gives a right to reside in Hungary. Detention may be ordered only under the stated asylum-detention conditions, initially up to 72 hours with court extensions and an eight-month aggregate cap.

Fingerprint and photograph Upon receipt of an application for asylum, if the applicant is 14 years of age or older, his/her fingerprint will be taken by the Hungarian authorities and transmitted to a fingerprint database of the European Union called “EURODAC” to determine if the applicant has previously applied for asylum in another EU Member State or if previously resided in another EU Member State. If the refugee authority is of the opinion that the asylum-seeker is presumably not a minor, it will appoint a medical expert to determine the asylum-seeker’s age. ASYLUM PROCEDURE Procedural time limit The asylum procedure will be carried out in 60 days, covering the asylum-seeker’s personal interview as well. The time required for procedural steps is not included in the procedural time limit. However, in some cases the authority has power to bring a decision within a shorter period of time, in a so called accelerated procedure. If there is any possibility that another EU Member State is responsible for the examination of the application, the procedure will be suspended until the competent authority of that EU Member State provides a response. The duration of such procedure depends on the co-operation of the foreign partner authorities, and may take several months. Hearing and records The asylum-seeker will be interviewed during the asylum procedure, assisted by an interpreter. During the interview the applicant is asked to provide details about the reasons for fleeing, the circumstances of reaching Hungary, and to present any evidence that may be available to support the application, including personal identification documents. During the asylum procedure, the refugee authority will inform the applicant in detail about his/her rights and obligations relating to the procedure. Decision In the asylum procedure a decision may be adopted for: ·                                 Granting refugee status ·                                 Granting subsidiary protection ·                                 Granting temporary protection, which enables the asylum-seeker to stay in Hungary on a temporary basis ·                                 Refusing the application in full ·                                 Terminating the procedure. If the application is refused in its entirety – and if the applicant does not have the right of residence in Hungary on other grounds – the refugee authority shall provide for the expulsion and deportation of the applicant, and shall set the duration of the exclusion measure. If the applicant is granted international protection as provided for above (i.e. refugee status, subsidiary protection or non-refoulement) the applicant will be given the right of residence in the territory of Hungary. The National Directorate-General for Aliens Policing provides support and assistance to the client so as to facilitate his/her integration into the Hungarian society as soon as possible.
