What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

Asylum under the 1951 Geneva Convention as implemented by Law L/2018/050/AN: the set of rules governing the grant of asylum, protection and refuge to a foreign national. It also covers protection granted in the form of exceptional admission to stay for a person whose life or liberty is threatened in their country, or who is exposed there to torture or other cruel, inhuman or degrading treatment.

Which population, circumstances or geographic group does the mechanism cover?

It covers a foreign national in one of the situations described in Article 4 of Law L/2018/050/AN, provided Article 5 does not apply to them. It also covers, through exceptional admission to stay, a foreign national whose life or liberty is threatened in their country or who is exposed there to torture or other cruel, inhuman or degrading treatment. The official text quoted does not set out the Article 4 situations.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

The enacted Guinean asylum law L/2018/050/AN provides a statutory route: a person seeking asylum may enter, receive a 30-day safe-conduct on entry and submit a written claim to immigration, customs, police, gendarmerie, listed regional and judicial authorities, the CNISR secretariat or UNHCR. Article 24 says these receiving bodies must forward the claim to the CNISR Permanent Eligibility Committee secretariat within 48 hours. UNHCR’s Guinea country profile reports that implementing texts were validated in 2021 but no implementing decree had been published for effective implementation as of the captured page. Thus the listed places and steps are established by the law, while the currently implemented filing channel and operation of every statutory step are not confirmed by the reviewed evidence.

  • The enacted law’s written-request and referral procedure is distinguished from present operational implementation. UNHCR reports no published implementing decree on its captured country page; this does not by itself prove that no authority currently receives asylum requests.

What happens after the request: registration, family handling, major support and rights where officially stated?

On receipt of the claim the CNISR secretariat issues an asylum-seeker certificate which serves as a temporary residence authorisation, valid for six months and renewable until the end of the procedure.

Which competent authority, UN body or official assistance channel should the person use?

The National Commission for the Integration and Monitoring of Refugees (CNISR) is the national authority empowered to exercise the legal and administrative protection of refugees and asylum seekers. Within it, the Permanent Eligibility Committee decides the substance of asylum claims, and an independent Appeals Committee is the only body competent to hear an appeal against that Committee's decision.
